Proposed Project. The applicant is proposing a covered front porch on the existing residence that will change the location of
the low point used for measuring height on the property and result in a height measurement over the maximum height
permitted on the non-standard lot under the zoning district. Located in the Residential - Estate (RE) zoning district, the
property is smaller in size than the standard RE lot, and is therefore considered non-standard with a maximum height
permitted to be 28.7 feet, rather than the 35-foot height maximum that is permitted on standard lots. The existing house was
previously granted a height of 32.2 feet that is over the permitted height and the proposed front porch will establish the height
of the existing house at 32.8 feet in height. A request to modify a building's height that is over the allowed height on a lot is
subject to a Site Review application and as a part of the approval a portion of the front porch is approved for encroachment
into the front yard setback. Figures 1 and 2 illustrate the existing condition and the proposed porch
Protect Analysis: The means for determining "height" is defined in the land use code (section 9-16) as, "the vertical distance
from the lowest point within twenty-five feet of the tallest side of the structure to the uppermost point of the roof."The proposed
covered porch will shift the location of the "lowest point within twenty-five feet" to be six inches lower in elevation and, in turn,
the documented height of the residence will be six inches taller.
Staff finds that the addition of a porch onto the existing single family residence in the Residential - Estate zone is consistent
with the comprehensive plan policies and the Site Review criteria of section 9-2-14(h), B.R.C. 1981 in that it will provide a
welcoming street face and enhance the existing context.
Public Comment.
Required public notice was provided in the form of written notifications of the application for Site Review to property owners
within 600 feet of the subject property. In addition, a public notice sign was posted on the property and therefore, all public
notice requirements of section 9-4-3, "Public Notice Requirements," B.R.C. 1981 were met. No comments were received from
the public on this application.
Conclusion.
Staff finds that the application for Site Review- Height meets the relevant criteria pursuant to section 9-2-14(h), "Site Review,"
B.R.C. 1981. The proposal was approved by staff on March 3, 2011 and the decision may be called up before Planning
Board on or before March 17, 2011. There is one Planning Board hearings scheduled during the required 14 day call-up
