4 - Call Up: 585 Pleasant St. and 576 University Ave - Highland Lawn Block "F" Replat A (LUR2009-00059) Ml MORANDUM To: Planning Board I'Rom Jessica Vaughii, Plamier I DATE: November 2, 2009 SUBJECT: Call Up Item: 585 Pleasant Street and 576 University Avenue MINOR SUBDIVISION in which two lots are created: Lot I of 7,012 square feet and Lot 2 of 7,971 square feet. This approval is subject to call-up on or before November 19, 2009. Attached is the disposition of the approval for a Minor Subdivision request to replat two lots by adjusting a common lot line (see Attachment A, November 5, 2009 Planning Board Notice of Disposition). The shared rear property line will be moved 9.5 feet to the north resulting in two lots totaling 7,012 square feet and 7,971 square feet, respectively. This Minor Subdivision request also vacates a 10 foot-by-9.5 foot portion of an existing utility casement located in the northwesterly corner of proposed Lot 2 (585 Pleasant Street)_ Background: The site is zoned RL-i (Residential Low-1) which is defined as "Single-family detached residential dwelling units at low to very low residential densities" (subsection 9-5-2 (c)(1)(A), B.R.C. 1981). Pursuant to section 9-8-1, "Schedule of Intensity Standards," B.R.C. 1981, the minimum lot area for the RL-I zone district is 7,000 square feet and the maximum floor area ratio is 0.8:1. Existing Conditions.- Currently, 585 Pleasant Street is comprised of a single lot totaling 7,500 square feet with a single-family residence. 576 University Avenue is also a single lot totaling 7,500 square feet with an existing single-family residence. Both properties are zoned RL-1, Residential Low-l, and arc in conformance with the zone district regulations. Proposal: The purpose for the applicant's request for a replat is to adjust the shared property line by moving it approximately 9.5 feet to the north. The adjustment will result in the transfer of approximately 470 square feet of land from 576 University Avenue to 585 Pleasant Street resulting in Lot i of 7,012 square feet and Lot 2 of 7,971 square feet, respectively. Please refer to Attachment B, Highland Lawn Block F Replat A Preliminary Plat and Attachment C, Highland Lawn Block F Replat A Final Plat for a detailed site map. The replat request will also vacate a 10 foot-by-9.5 foot portion of an existing utility casement located in the northwesterly corner of proposed Lot 2 (585 Pleasant Street). The utility easement along the west property line of existing Lot I provides for sanitary sewer service to 585 Pleasant Street (Lot 2) from University Avenue. Since the rear lot line of Lot 2 is being adjusted to the north, a portion of the existing easement, that was once across Lot 1 (576 University Avenue), will now be on Lot 2. The vacation is necessary since the sewer line will be on the property for which it provides service and the easement is no longer required for maintenance and access. Conclusion: Staff finds that this application meets the criteria for final plat set forth in section 9-12-8, "Final Plat," B.K.C. 1981 and the lot standard criteria set forth in subsection 9-12- 12(a)(1), "Standards for Lots," B.R.C. 1981. This proposal was approved by Planning and Development Services staff on November 5, 2009 and the decision may be called up before Planning Board on or before November 19, 2009. There is one Planning Board meetings within the 14-day call up period on November 19, 2009.
