4 - Call Up: 3153 and 3171 9th St - Newland Addition Replat (LUR2008-00084) MEMORANDUM To: Planning Board Fwm: Jessica Vaughn, Planner I DATE: October 27, 2009 SUBJECT: Call Up Item: 3153 and 31719"' Street MINOR SUBDIVISION in which Lots 37-43, Newland Addition, are being replatted into 2 lots: Lot I of 14,046 s.f, and Lot 2 of 7,806 s.f. which increases the size of Lot 2 by 1,563 feet making it a standard lot. The properties are zoned RL-1. This approval is subject to call-up on or before November 12, 2009_ Attached is the disposition of the approval for a Minor Subdivision request to replat Lots 37-43, Newland Addition, into 2 lots (Exhibit A, October 26, 2009 Planning Board Notice of Disposition). The purpose of this replat is: (1) to document the merger of the original historic platted lots into two existing lots: Lot 1 (formerly Lots 39-43) of 15,609 s.f. and Lot 2 (formerly Lots 37 and 38) of 6,243 s.f.; and (2) to adjust the southern lot line of Lot 1 transferring 1,563 square feet to Lot 2. This results in Lot I being 14,046 s.f and Lot 2 being 7,806 s.f. Please refer to Exhibit B, Newland Addition Replat Block 19 Preliminary Plat, and Exhibit C, Newland Addition Replat Block 19 Final Plat, for a site map reference. Background: The site is zoned RL-I (Residential Low-1) which is defined as "Single-family detached residential dwelling units at low to very low residential densities" (subsection 9-5-2 (c)(1)(A), B.R.C. 1981). Pursuant to section 9-8-1, "Schedule of Intensity Standards," B.R.C. 1981, the minimum lot area for the RL-I zone district is 7,000 square feet and the maximum floor area ratio is 0.8:1. Existing Conditions: Currently, 3153 9" Street is comprised of Lots 37 and 38, Newland Addition, which have merged into a single lot comprised of 6,243 square feetwhich is nonstandard and does not meet the minimum lot requirement for the RL-1 zone district. 3171 9"' Street is comprised of Lots 39-43, Block 19, Newland Addition, which have merged into a single lot comprised of 15,609 square feet. Proposal: The purpose for the applicant's request for replat is twofold: (1) to document the merging of the original historic platted lots to create the two existing lots; and (2) to adjust the southern lot line of Lot 1 transferring 1,563 square feet to Lot 2. The result of the first request will create Lot 1 (3171 9"' Street) comprised of 15,609 square feet and Lot 2 1 (3153 9"' Street) comprised of 6,243 square feet. The second request for the lot line adjustment will transfer 1,563 feet of land from Lot I to Lot 2, making Lot 2 a standard lot. Conclusion: Staff finds that this application meets the criteria for final plat set forth in section 9-12-8, "Final Plat," B.R.C. 1981 and the lot standard criteria set forth in subsection 9-12- 12(a)(1), "Standards for Lots," B.R.C_ 1981. This proposal was approved by Planning and Development Services staff on October 26, 2009 and the decision may be called up before Planning Board on or before November 12, 2009.
