Applicant: Jeffrey Stein, Forum Real Estate Group as representative of 2"d Level Investors, LLC PRESENTERIS: Planning & Development Services David Driskell, Executive Director of Community Planning Ruth Mcl leyser, Deputy Director of Community Planning Mary Margaret Little, Associate Planner EXECUTIVE SUMMARY: 2nd Level Investors, LLC, has submitted for Site Review amendment (L.UR2008-00063) for significant development of an existing parking lot at the northwest corner of 30°i and Walnut Streets- This development project, which was approved by the Planning Board on December 18, 2008 (LUR2008-00063), allows for 240 for-rent dwelling units within the Twenty Ninth Street development. Other changes include access improvements, drainage, landscaping, and utilities. City staff is currently reviewing the Technical Documents for this project. The proposed Residences at Twenty Ninth Street building encroaches into two existing sidewalk casements. One casement runs along the eastern property line adjacent to 30`1' Street and the other one runs along the northern property line across Outlot B and Lot 4 of the Twenty Ninth Street Subdivision (see Attachments C and D). These sidewalk casements will be entirely vacated so that the proposed buildings will not encroach into the existing easements. "then, they will be rededicated to maintain the connections with modified alignments (see Attachment E). The applicant has indicated that Outlot 13 soon will be transferred from Macerich Twenty Ninth Street, LLC, to 2`1 Level Investors, LLC. Second reading will be scheduled upon prool'of this transfer of ownership of Outlot B to 2"d Level Investors, LLC and conveyance of required replacement easements to the City. ~(=,h~I~)A 17 C i~l Pair 1 STAFF RECOMMENDATION: Suggested Motion Languape: _ ~ -a~- Staff requests council consideration of this matter and action in the form of the following motion: Motion to introduce and order published by title only two ordinances authorizing the City Manager to execute two deeds of vacation for two sidewalk easements as part of the Residences at Twenty Ninth Street project. COMMUNITY SUSTAINABILITY ASSESSMEN'T'S AND IMPAC'T'S: • Economic: No direct economic impact is anticipated from the sidewalk casement vacations although it will allow for additional residential space in which the residents are expected to contribute to positive economic growth of the city. • Environmental and Social: No environmental impacts are anticipated from the proposed vacation. Socially, the new sidewalks will offer a better pedestrian environment and connect the development to the multi-use path and sidewalk along 30'h and Walnut Streets. OTHER IMPACTS: • Fiscal: No fiscal impact as a result of vacating the sidewalk easements is expected. • Staff time: The applicant has submitted the required fee to cover the staff review time of the proposed vacations. BOARD AND COMMISSION FEEDBACK: A copy of this report will be sent to Planning Board on July 9, 2009, in conformance with section 79 of the City of Boulder Charter. Any comments from the Planning Board will be included with this second reading to City Council. PUBLIC FEEDBACK: Public notice of the proposed vacations was mailed to property owners within 600 feet of the project on March 11, 2009. At this time, no comments from neighbors have been received. ANALYSIS: Detailed development plans depicting the building locations, sidewalk and parking configurations and other site improvements have been approved by staff for the Residences at 'T'wenty Ninth Street project. The existing sidewalks were built without the knowledge of the future project requirements. With the approval of the Residences at Twenty Ninth Street project, the existing sidewalk easements are to be realigned to accommodate project construction and enhance the sidewalk system. The new alignment of the sidewalk casements are more than adequate to meet all current and anticipated future sidewalk needs as identified in the Boulder Valley Regional Center Guidelines and the 2003 Transportation Master Plan. Therefore, the sidewalk easements can be vacated because they will be subsequently rededicated in the improved alignments. A comprehensive sidewalk system exists around the perimeter of the site and additional connections are proposed as part of the redevelopment plans (See Attachments E and F). AGENDA ITEM Page 2 City Council adopted the following guidelines for the vacation of public rights-of-way and public access easements in section 8-6-.9, "Vacation of Public Rights-of-Way and Public Access Easements," B.R.C. 1981. 1. It is presumed that easements or rights-of--way were originally acquired or dedicated for a valid purpose. Applicants seeking to vacate said portions of properties bear the burden to show that the change is not contrary to the public interest. 'I'lhe applicant has adequately demonstrated that the vacations of the sidewalk easements would not be contrary to the public interest, since the easements will be replaced with new sidewalk easements that will coincide with the planned development on the site. 2. All agencies and departments having a conceivable interest in the easement or right-of-way must indicate that no need exists, either at the present or conceivable in the.future, to retain the property as an easement or right-of- way, either for its original purpose or for some public purpose. The city has already approved the location of the new sidewalk easements and, therefore, does not sec any fixture interest in retaining the existing sidewalk easements. 3. The applicant must demonstrate, consistent with the Boulder Valley Comprehensive Plan and the city's Land Use Regulations, either: a) that./ailure to vacate an existing right-of way or easement on the property would cause substantial hardship to the use of the property consistent with the Boulder Valley Comprehensive flan and the city's 1,and Usc Rc,(,ulations; Or b) that the vacation of the easement or right-of--way would actually provide a greater public benefit than retaining the property in its present status. The dedication of the two replacement sidewalk easements are superior to the existing sidewalk casements and constitute a greater public interest, since they would he constructed to current Americans with Disabilities Act (ADA) and city of Boulder standards. The new sidewalk easements were included as part of the overall development plans. OPTIONS: Council may approve, amend or deny the proposed ordinances (sce Attachments C and D). Approved By: Jane S.
