STATISTICS: Proposal: Use review for construction of a 630 square foot pump booster station facility to enhance flexibility, help sustain water delivery in drought conditions, increase water transmission from the Boulder Reservoir Water Treatment Plant and improve transmission of water from the city's lowest pressure zone to higher pressure zones. Location: 3715 Iris Ave. (see map location below) Size of Parcel: 20,143 square feet (0.46 acres) Zoning: Residential High Density Four (RH-4) Comprehensive Plan: High Density Residential (HR) AGENDA ITEM Paee# 1 KEY ISSUES: 1) Does the proposed pump station facility meet the criteria for Use Review? BACKGROUND: City-Wide Water Delivery System Due to Boulder's topography, the city-wide water delivery system must serve both low areas adjacent to Boulder Creek in the eastern portion of the city to higher areas against the foot hills in the western area of the city. To adequately serve this wide variation in ground elevation, the city- wide water distribution system is divided into three main pressure zone areas. There are currently seven pressure-regulating stations in the system that regulate pressure and flow between pressure zones or into storage reservoirs. There are currently four booster pumping stations serving the system, as well as a pumping station at the Boulder Reservoir Water Treatment Plant. These booster pumping stations are able to pump water from a lower elevation pressure zone into a higher elevation pressure zone. The subject property already has an identical booster pump station structure on the property. Process The proposed pump station facility is considered an Essential Municipal Public Utility Service and is defined by Section 9-16, B.R.C. 1981 below: "Essential municipal anal public utility services" means distribution, collection, communication, supply, or disposal systems, including, without limitation, poles, wires, transformers, disconnects, regulators, mains, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, hydrants, and other similar equipment and accessories that are reasonably necessary for public utilities or the city to furnish adequate service or for the public health, safety, or welfare. Per Section 9-6-1(d), B.R.C., 1981, Essential Municipal Public Utility Service uses in the RH-4 zone district require Use Review approval. Per Section 9-2-15(d)(1), B.R.C. 1981, Use Review applications for a nonresidential use in a residential zone district requires the approval of Planning Board. Concept Plan and Site Review are not required for the proposal and no land use code modifications have been requested for the proposed facility. Zoning / Boulder Valley Comprehensive Plan Context As indicated by the map below, the subject property as well as the entire surrounding area is zoned RH-4. Section 9-5 B.R.C. 1981, defines the RH-4 zone district as: High density residential areas primarily used for a variety of types of attached residential units, including, without limitation, apartment buildings, and where complementafy uses may be allowed. The site has a curb cut accessed directly from his Ave. The site contains mature landscaping (although no landscape is proposed to be removed as a part of the scope of work) and is surrounded by a mix of existing uses. To the north is an existing day care facility; to the south are the existing Talisman Wonderland Gardens condominiums. To the east is the Iris Office Park (and associated surface parking lot). To the west are the existing Rugby Row condominiums. Iris Ave. terminates to a dead end directly to the east of the site at Foothills Parkway. AGENDA ITEM Pa eff 4 4 r T ~ {v *Aerial May Proposed Development As indicated in Attachment A, the applicant proposes to construct an additional 630 foot booster pump station identical to the facility that currently exists on site. The proposed facility will be one story at 16.11 feet high and will have a pitched roof with a wood and stone veneer. Access doors will be oriented to the east. The facility is not considered habitable area or commercial or office space, therefore density is not a consideration for the site. Although an asphalt driveway and fire turn around exist on-site, parking is not a consideration as the facility will be unmanned except for facility maintenance. Setbacks are compliant with the R14-4 zone district. The current pump station has existed for over 20 years and there have not been any noise or nuisance complaints regarding the existing facility. ANALYSIS: Planning staff s analysis of the applicable Use Review criteria are based on the criteria specified in Section 9-2-15(e), B.R.C., 1981 and are found below: AGENDA ITEM 56 Page# 5 Section 9-2-15(c), B.R.C. 1981 - USE REVIEW CRITERIA X (1) Consistency with Zoning and Non-Conformity: The use is consistent with the purpose of the zoning district as set forth in Section 9-5, "Modular Zone System," B.R.C. 1981, except in the case of a non-conforming use; Per Section 9-5-2(c)(1)(1), B.R.C. 1981, areas zoned XH-4 are defined as high density residential areas primarily used for a variety of types of attached residential units, including, without limitation, apartment buildings, and where complementary uses may be allowed. The proposed governmental facility is considered compliant with the intent of the RH 4 zone district as a complimentary use permitted through the Use Review process. X (2) Rationale: The use either: X (A) Provides direct service or convenience to or reduces adverse impacts to the surrounding uses or neighborhood; The proposed pump station will enhance flexibility and help sustain water delivery in drought conditions. The pump house will help to increase transmission of water from the Boulder Reservoir Water Treatment Plant to the city 's three main pressure zones and therefore provides a direct service to the entire city. X (B) Provides a compatible transition between higher intensity and lower intensity uses; Not applicable, the proposed pump house site is not considered a transitional property- • (C) Is necessary to foster a specific city policy, as expressed in the Boulder Valley Comprehensive Plan, including, without limitation, historic preservation, moderate income housing, residential and non-residential mixed uses in appropriate locations, and group living arrangements for special populations; or BVCP Policy 3.10 states: The city will consider the importance of the other objectives of the comprehensive plan in the planning and operation of the water, wastewater, stormwater and flood management utilities. These other objectives include in-stream flow maintenance, enhancement of recreational opportunities, water quality management, preservation of natural ecosystems, open space and irrigated agricultural land, and implementation of desired timing and location of'growth patterns. Section 7 of the BVCP states: The BVCP as well as the Treated Water Facilities Master Plan contains goals and policies regarding the delivery of water and the provision of future service projections and services. The Treated Water Facilities Master Plan is available on- line at http://Ci.bouldei-.co.us/fleslUtilities/Plansltreatedwatei_mp_sumniary.pdf. AGENDA ITEM 58 Page# 6 As part of the master planningprocess, the city adopted the following reliability criteria for delivery of treated water. The proposed booster pump station facility will help to improve water transmission throughout the city: 1. The city will ensure the delivery of the water required to satisfy essential needs including the maintenance of basic public health, safety and welfare such as indoor domestic, commercial and industrial uses and fire fighting uses, except fbr droughts and system failures having a frequency of no more than once in 100 years. The average winter consumption plus afire-flow reserve demand is established as a measure of this demand. 2. The city will ensure delivery of the water required to provide for the continued viability of exterior landscaping, except for droughts and system_failures having a frequency of no more than once in SO years. 3. The city will ensure delivery of'the water required to.fully satisfy all uses, except_for droughts and system failures having a frequency of-no more than once in 20 years. The peak hour demand or the peak day demand plus afire-flow reserve demand is established as a measure of this demand. 4. Providing redundant facilities where practical will minimize complete interruptions to the delivery of water. 5. A reserve capacity of 10 percent will be maintained in the water delivery system. The maintenance of'such a reserve capacity will allow a degree of planningflexibility and mitigate water delivery problems that might be caused by operator error. N/A (D) Is an existing legal non-conforming use or a change thereto that is permitted under subsection (e) of this section; Not applicable. The use is not considered non-conforming. X 3) Compatibility: The location, size, design, and operating characteristics of the proposed development or change to an existing development are such that the use will be reasonably compatible with and have minimal negative impact on the use of nearby properties or for residential uses in industrial zoning districts, the proposed development reasonably mitigates the potential negative impacts from nearby properties; The proposed pump house will be smaller in scale than the surrounding three-story apartment buildings to the west and the three story office building to the east. The facility will be unmanned except for when city staff is required to perform maintenance and will have minimal parking or noise impacts on the surrounding areas. Additionally, the proposed architecture is compatible the existing pump house on the site. X (4) Infrastructure: As compared to development permitted under Section 9-6, "Schedule of Permitted Uses of Land," B.R.C. 1981, in the zone, or as compared to the existing level of impact of a non-conforming use, the proposed development will not significantly adversely affect AGENDA ITEM 56 R.i e# 7 the infrastructure of the surrounding area, including, without limitation, water, wastewater, and storm drainage utilities and streets; While the site is not considered non-conforming, the proposed pump house will positively impact citywide infrastructure by improving the transmission of waterfront the city's lowest pressure zone to the highest pressure zones. X (5) Character of Area: The use will not change the predominant character of the surrounding area; and The predominant character of the area is defined by two and three story apartment buildings, a large, three story office building, a single story day care and surface parking lots. A single story pump station has been located on the site for over 20 years and the proposed single story pump station will not change thepredominant character of'the surrounding area or the site. N/A (6) Conversion of DweIlingUnits to Non-Residential Uses: There shall be a presumption against approving the conversion of dwelling units in the residential zoning districts set forth in Subsection 9-6-3, B.K.C. 1981, to non-residential uses that are allowed pursuant to a use review, or through the change of one non-conforming use to another non-conforming use. The presumption against such a conversion may be overcome by a finding that the use to be approved serves another compelling social, human services, governmental, or recreational need in the community including, without limitation, a use for a day care center, park, religious assembly, social service use, benevolent organization use, art or craft studio space, museum, or an educational use. Not Applicable. The proposed application does not involve conversion of residential units. PUBLIC COMMENT AND PROCESS: Required public notice was provided in the form of written notifications of the application for Use Review and neighborhood meeting mailed to property owners within 600 feet of the subject property. In addition, a public notice sign was posted on the property. All notice and meeting requirements of Section 9-4, B.R.C. 1981 have been met. Staff has received no opposition from immediately adjacent property owners or tenants. STAFF FINDINGS AND RECOMMENDATION: Staff finds that the proposed Use Review application meets the applicable Use Review criteria found in Section 9-2-15(e), B.R.C., 1981. -Therefore, staff recommends that Planning Board approve Use Review #LUR2009-00072 incorporating this staff memorandum as findings of fact and using the following recommended conditions of approval. RECOMMENDED CONDITIONS OF APPROVAL 1. Prior to a building permit application, the Applicant shall submit revised plans for review of the following items, subject to the review and approval of Planning and Development Services Division: AGENDA ITEM 56 Paue# 8 a. NA Agenda Item 58 lac 1 ADDITIONAL CRITERIA FOR MODIFICATION TO NON-CONFORMING USES: A non-conforming use is described as any use of a building or use of a lot that is not permitted under Section 9-6- 1, "Schedule of Permitted Uses of Land", B.R.C. 1981, but excludes a conforming use in a non-standard building or on a non-standard lot; a legal existing use that has been approved as a conditional use or a use review use, or a use approved pursuant to a valid special review or a use review approval. A non-conforming use also includes an otherwise conforming use, except a single dwelling unit on a lot, that does not meet the parking and residential density requirements, including, without limitation, the requirements for minimum lot area per dwelling unit; useable open space per dwelling unit, or required off-street parking requirements for Section 9-6-1, "Schedule of Bulk Requirements", B.R.C. 1981. 1. Reasonable Measures Required: The applicant has undertaken all reasonable measures to reduce or alleviate the effects of the non-conformity upon the surrounding area, including without limitation objectionable conditions, glare, visual pollution, noise pollution, air emissions, vehicular traffic, storage of equipment, materials and refuse, and on-street parking, so that the change will not adversely affect the surrounding area; NA 2.
