A Floodplain Development Permit was approved by Planning and Development staff on
February 26, 2009. "I'he work is associaicd with the construction of the Elmer's Twomile
Creek irnproverncnts.
A floodplain development permit was previously issued for the Elmer's Twomile Creek
charu~el improvements which are currently under constnrction (LUIZ2008-00068). This
previously issued permit did not include temporary construction items or permanent
structures that will be constructed after the channel improvements are complete. The
channel improvements will result in the adoption of new floodplain mapping.
A new floodplain developtncnt pernlit (LUR2009-00017) was approved on February 26,
2009 to cover items that were not included in the original floodplain development. permit
and includes:
- Temporary constnrction items such as fencing, asphalt parking areas, equipment
storage, dumpsters and recycle bins
- Permanent structures such as carports, fencing, and landscaping that will be installed
after the channel improvements are completed, but prior to the adoption of the new
floodplain mapping
"the applicant has demonstrated that the project will not adversely impact the floodplain
or cause a rise in the floodwater elevation during the lU0-year flood event. A copy of the
floodplain development permit and the application materials are attached.
"Phis floodplain development permit was approved by Planning and Development
Services staff on February 26, 2009, and the decision may be called up before Planning
Board on or before March 12, 2009. "there is one Planning Board meeting within the

The proposed projecUactivity is approved on the basis that it satisfies applicable requirements of Chapter
9-3-3, "Floodplain Regulations," Boulder Revised Code 1981. Other floodplain requirements as set forth in
Chapter 9-3-3 which are not specifically outlined in the conditions of approval below remain applicable to this
projecUactivity.
The fence shall be securely anchored to resist damage and washing away as debris during flooding
events.

Subject: Elmer's "I'womile Flood Permit Amendment
I would like to request that the Elmcr's Twomile Flood Permit be amended to include the temporary
impacts during construction, as well as permanent structures associated with the project that were not
shown in the original flood permit application, but will be constructed prior to the completion of the
Letter of Map Revision. After meeting with several Project Specialists and both of you, I now
understand that this information should have been included in the original flood permit application.
Given the complexity of this project and the city's unique flood regulations, the consultant
submitting the original Hood permit was not aware that these additional issues would trigger a flood
permit requirement. I am therefore requesting that this be considered as an amendment to the
original permit.
It is my understanding that the requirements for flood permits for this project fall under three
general areas:
• the channel improvements
• temporary impacts that result from the construction of the channel improvements within
the floodplain
• permanent structures that arc part of the channel improvement project that were not
submitted with the original flood permit application, but will be constructed before the

't'emporary impacts at 2727 Valmont are associated with a temporary parking lot which the city is
providing for the residents of Shady I-Iollow and the employees of the Platte River Associates
while the contractor is installing the box culvert for the flood mitigation improvements through
tl~cir parking lot. "1'he temporary impacts resulting from the construction of this parking lot (Sheet
39 of the construction plans) include the temporary installation of four 9" diameter light poles,
387 feet of temporary chain link fence (running in the direction of flood water flow). The
placement of 4" of recycled asphalt will be offset by the material removed so that the parking lot
will match existing grade. Attached is a letter ti-om W H Pacific, the design engineer for these
flood improvements, indicating that these impacts aze "immeasureable".
'I~he permanent structures that are part of the channel improvement project include the removal
and replacement of the Shady I Iollow carports and storage shed, trash and recycle enclosures, a
mail box structure, bike racks, steel and chain link fence and landscaping. These elements of the
project will be constructed after the completion of the (loud mitigation improvements on each
parcel, but prior to the submittal of the Letter of Map Revision. Attached are the appropriate
pages of the construction plans that identify the removal and installation of these structures.
Please let me know if there is any additional information needed. [would appreciate a review
and approval of'this amendment to the existing flood permit for this project as soon as possible.

Re: Floodplain Development Permit for Elmer's Two Mile Creek
Dear Ms. Noble:
The construction of the Elmer's Two Mile Creek Trail Connection and Drainageway project
requires the construction of a temporary parking lot on the north side of Valmont Road. We
understand that the temporary parking lot will include four 9-inch diameter light poles, spaced
approximately 80 feet apart, along the west side of the parking lot. Also, a temporary chain link
fence will be constructed along the east side of the parking lot, from the northwest comer of the
existing building near Valmont Road north to the existing fence along the Tebo property line.
The temporary parking lot, light poles and chain link fence are within the existing 100-year
Floodway (conveyance zone) for Elmer's Two Mile Creek.
The light poles and chain link fence will be installed in an orientation that is generally parallel to
the flow direction on Elmer's Creek. It is our opinion that the installation of the temporary light
poles and chain link fencing will have an immeasurable effect on the 100-year floodway
elevation.
