4 - Call Up: Wetland Permit (LUR2008-00030) - West Nile Virus Program to control mosquito larve in wetlands within th city limits and on CIty owned parcelsMEMORANDUM TO: Planning Board FROM: Katie Knapp, Civil Engineer, Floodplain and Wetlands Permitting DATE: Apn14, 2008 SUBJECT: Call Up Item: Wetland Permit (LUR2008-00030) West Nile Virus Program A Wetland Permit to continue the implementation of the West Nile Virus (WNV) Program was approved by Planning and Development staff on April 4, 2008. The program involves performing mosquito control measures that focus on controlling the larvae of the two mosquito species that are the primary vectors for WNV, Culex tarsalis and Culex pipiens. City-owned land which contains the habitat to support the target species will be monitored and the larvicide Bacillus thuringiensis israelensis (Bti) will be applied where the vector species have been found. Data will also be collected on the locations of WNV occurrences on city of Boulder owned lands for mosquitoes, birds, and mammals. The Department of Environmental Affairs will also continue their public education and awareness program to inform the public of the need for the control efforts and describe what the control efforts entail. Any person aggneved by the granting of a floodplain development permit may appeal this determiriation within 15 days of the date of issuance, as set forth under Subsection 9-3-9(~, by filing a written request for appeal by April 17, 2007. The Floodplain Development Permit will be effective April 18, 2007. Conditions of Approval ' The proposed projecUactivity is approved on the basis that it satisfies applicable requirements of Chapter 9-3-9, "Wetlands Protection," Boulder Revised Code 1981. Other wetland requirements as set forth in Chapter 9-3-9 which are not specifically outlined in the conditions of approval below remain applicable to this project/activity. ' Mosquito treatment activities shall conform to Attachment K of the City of Boulder Wetland Permit Application dated February 29, 2008. ' All work activities in the regulatory wetland and wetland buffer area shall comply with the "City of Boulder Wetlands Protection Program Best Management Practices (BMPs) and Revegetation Rules." ' Prior to the application of microbial insecticide to a wetland, a notice will be posted at the wetland to be treated. The notice will remain for seven days or until the wetland is retested for the target mosquito larvae. ' The applicant shall maintain documentation of the wetlands which have received treatment with microbial insecticide. This documentation shall be transmitted to Planning and Development Services at the end of the treatment period or when requested. In addition, the applicant shall document any observed adverse effects on wetlands beyond the effects on targeted larvae and flies described in the permit application, and notify Planning and Development Services of these impacts. ' The applicant shall notify City of Boulder Open Space and Mountain Parks staff prior to accessing areas closed by city manager rule and any other environmentally sensitive areas (e.g., endangered species habitat, critical bird nesting habitat, etc.). ' Permit approval, if not appealed, is final on April 17, 2008.
