4 - Call Up: Floodplain Development Permit (LUR2008-00031) and Wetland Permit (LUR2008-00011) for Goose Creek improvementsMEMORANDUM TO: Planning Board FROM: Katie Knapp, Civil Engineer, Floodplain and Wetlands Permitting DATE: March 28, 2007 SUBJECT: Call Up Item: Floodplain Development Permit (LUR2008-00031) and Wetland Permit (LUR2008-00011) for Goose Creek improvements A floodplain development permit and a wetland permit for channel improvements in Goose Creek were approved by Planning and Development staff on March 21, 2008. The project is located along Goose Creek east of 47`h Street and north of Pearl 5treet. Proposed improvements include rehabilitation of a drop structure by repiacing grouted boulders and removing sediment accumulation, and regrading the low flow channel to restore it to its original grade. Also included in the project is stabilizing the existing multiuse trail by removing loose material from undercut portions of tbe trail and filling it with a sand/concrete mix. The proposed Goose Creek improvements occur within the 100-year floodplain and the high hazard and conveyance zones. The applicant has illustrated that the project will not adversety impact the floodplain or change Yhe high haaard or conveyance zones. The project includes impacts to 0.014 acres of wetlands and less than 0.001 acres of impacts to wetland buffer azeas. Wefland impacts will be mitigated onsite by creating 0.028 acres of new wetland areas along Goose Creek. Any person aggrieved by the granting of a floodplain development permit or wetland permit may appeal this determination within 15 days of the date of issuance, as set forth under Subsection 9- 4-4(a), by filing a written request for appeal by Apri13, 2008. The Floodplain Development Permit and Wetland Permit will be effective April 4, 2008. Other wetland requirements as set forth in Chapter 9-3-9 which are not specifically outlined in the conditions of approval below remain applicable to this project/activity. The wetland mitigatin work shall be constructed in accordance with the approved mitigation plan. The applicant and any successor owner of any portion of the property is responsible for the implementation of the approved wetland mitigation plan per section 9-3-9(j) B.R.C., 1981. Any failure of the mitigation plan during the five-year monitoring period shall be remedied by the applicant and any successor owner of any portion of the property. The applicant is responsible for maintenance and monitoring of the wetland mitigation site and shall submit annual monitoring reports to the Department of Planning and Development Services.
