Alteration Certificate to relocate (previously demolish) the
contributing garage at 413 Spruce Street, per Section 9-11-18 of the
Moulder Revised Cade (HIS2008-00177).

STAFF RECOMMENDATION:
Staff recommends that the Landmarks Board adopt the following motion:
With the conditions listed below, the Landmarks Board approves the request to
relocate the contributing garage on the property at 413 Spruce Street as requested
in the revised application dated 09.04.2008, finding that it meets the standards for
issuance of a Landmark Alteration Certificate in Chapter 9-11-18, B.R.C. 1981 and
is substantially consistent with section 7 "Garages, Carports, and Accessory
Buildings", of the General Design Guidelines and section U of the Mapleton Hili
Historic District Design Guidelines. The Board adopts this memo as findings for its
decision.

CONDITIOt~tS OF APPROVAL:
1. The applicant shall be responsible for constructing the house in
compliance with the approved plans dated 10.01.2008, except as modified
by these conditions of approval.
2. Prior tv submitting a building permit application and final issuance of the
Landmark Alteration Certificate, the applicant shall submit the following,
subject to the final review and approval of the Landmarks Design Review
Committee: final architectural plans for the move and rehabilitation of the
garage that include materials and colors of roofing, windows, doors, and
paint colors tv insure that the approval is consistent with the General
Design Guidelines and the Mapleton Hill Historic District Guidelines and the
intent of this approval.
SUMMARY:
• At the August 20th, 2008 meeting, the Landmarks Board and the applicant
agreed to continue the item until the October 1S; 2008 meeting in order to
allow time to more definitively determine the age of the garage on the
property.
• On April 5, 2006, Landmarks Board approved a request for a Landmark
Alteration Certificate to relocate the historic garage on the property and for
the construction of a new garage.
• The 2005 accessory building survey recorded the garage and established a
pre-1929 date of construction with recommendation of its contribution to the
Mapleton Hill Historic District.
• Examination of the 1938 aerial photograph of Boulder indicates that the
garage was extant on the property in that year and, therefore, constructed
within the period of significance for the Mapleton Hill Histoxic District.
• Staff recommends the Landmarks Board approve the revised application,
provided stated conditions are met, finding that it meets the standards for
issuance of a Landmark Alteration Certificate irn Chapter 9-11-18, B.R.C. 1981.

On August 20, the Landmarks Board and the applicant agreed to continue the
consideration of a landmark alteration certificate for the demolition of the garage
to October 1, 2008 in order to provide time to conduct research on the building's
date of construction.
Prior to this hearing on Apri15, 2006, Landmarks Board approved a request for a
Landmark Alteration Certificate to relocate the historic garage on the property
and for the construction of a new garage. During construction of the new garage,
the historic frame building was moved off-site. Upon completion of the new
builduZg the frame garage was recently relocated on the property as per the
original application.

ANALYSIS OF HISTORIC SIGNIFICANCE OF PROPERTY:
Constructed about 1900, the one and one-half story masonry and frame classic
cottage at 413 Mapleton featuxes a low hip roof, south facing dormer, segmental
arch window openings and turned spindle work on the half-width porch. The
Historic Building Inventory Form (1988, Front Range) identified the house as
representing "a type, period, or method of construction" and mentions the
adjacent garage (Attachment A). At the time the property was surveyed this area
had not yet been added to the Mapleton I-Iill Historic District. The 2005 accessory
building survey (Ramsay & Barth) recorded the garage and established apre-
1929 date of construction. 'I'bis survey recommended that the building be
considered a contributing feature to the Mapleton Dill Historic District.
The 1929 tax assessor card photograph is taken from the southwest and as a
result the location of the garage until 2007 is not visible; being blocked by the
main house. However, the tax assessor card does refer to a 10' x 20' frame
"private garage" with a concrete floor and wood shingle roof being located on
the property in 1929 (Attachment B). The1958 aerial photograph of Boulder
shows what appears to be the garage in question at the north end of the property
(see Figure 4). While not as clear as the 1958 aerial, the 1938 aerial photo of the
city does indicate that, at the time, the building was extant at the north end of the
property (see Figure3).

LANDMARK ALTERATION CERTIFICATE REQUEST:
At the August 20~'' Landmarks Board meeting the applicant requested approval
to demolish the contributing frame garage finding that its historic significance is
questionable, that it does not fit aesthetically with the existing house, that it has
no doors, and is structurally deficient. The application has been modified and
now proposes that the garage be moved from its current location in front of the

recently constructed studio building, to a location approximately 1T north of the

CRITERIA FOR THE BOARD'S DECISION:
The Historic Preservation Ordinance specifies that a Landmark Alteration
Certificate may not be approved by the Board or City Council unless it meets the
conditions specified in Section 9-11-18, B.P.C. 1981. Specifically:
(b) Neither the Landmarks Board nor the City Council shall approve a Landmark
Alteration Certificate unless it meets the following conditions:
(1) The proposed work preserves, ei~llances, or restores and does not
damage or destroy the exterior architectural features of the
landmark or the subject property within a historic district;
(2) The proposed work does not adversely affect the special character

or special historical, architectural, or aesthetic interest or value of
the landmark and its site or the district;
(3) The architectural style, arrangement, texture, color, arrangement of
color, and materials used on existing and proposed structures are
compatible with the character of the existing landmark and its site
or the historic district;
(4) With respect to a proposal to demolish a building in a historic
district, the proposed new construction to replace the building
meets the requirements of paragraphs (b)(2) and (3) above.
(c) In determining whether to approve a Landmark Alteration Certificate, the
Landmarks Board shall consider the economic feasibility of alternatives,
incorporation of energy-efficient design, and enhanced access for the
disabled.
ANALYSIS:
1. Does the proposed application preserve, enhance, or restore, and not damage or
destroy the exterior architectural features of the landmark or the subject property
within an historic district?
.The 2005 accessory building survey of Mapleton Hill recommended the garage at
413 Spruce Sheet be considered a contributing building to the Mapleton Hill
Historic District based upon assessing it to be awell-preserved example of early
twentieth-century automobile architecture. At the August 2008 Landmarks Board
meeting there was some question as to whether the garage was built during the
1865-1946 period of significance for the district. Subsequent research shows the
building on the 1938 aerial photograph of the city, and therefore constructed
during the period of significance. Despite some alterations over the years
(including removal of the historic garage doors), staff considers the building to
be a contributing feature to the district.
Moving the building to the rear of the existing house would lessen its visibility
from the street. However, this relocation would be closer to its original location
where the studio has been built. For this reason, staff considers that relocating
the garage to the rear of the house would not damage the character of the
property or the district as a whole provided adequate steps are taken to ensure
that the building will not be damaged during the move and that it will be
rehabilitated to (or better than) its condition prior to the move from its original
location..

2. Does the proposed application adversely affect the special character or special
historic, arclitectural, or aesthetic interest or value of the district?
The staff considers that the contributing garage is a familiar visual feature in the
district. While the relocation to the rear of the house would limit its view from
the street, the proposed new siting is more in keeping with the original location
than its existing location. As such, staff considers the proposed relocation would
not adversely affect the special historic, architectural, and aesthetic interest or
value of the district.
3. Is the architectural style, arrangement, texture, color, arrangement of color, and
materials used on existing and proposed buildings compatible with the character
' of the historic district?
Staff considers that the proposal will meet this condition provided the building is
rehabilitated to a state similar to (or better) than it was pxior to the original move.
4. Does the proposal to demolish the building within the Mapleton Hill Historic District
and the proposed new construction to replace the proposed demolished building meet
the requirements of paragraphs § 9-11-18(b)(2) and 9-12-18(b)(3)#-13-18(b)(4) of
this section? ,

The Historic Preservation Ordinance sets forth the standards tl2e Landmarks
Board must apply when reviewing a request for a Landmark Alteration
Certificate. The Board has adopted. the Design Guidelines to help interpret the
Historic Preservation Ordinance. The following is an analysis of the proposed
demolition with respect to relevant guidelines. Design guidelines are intended
to be used only as an aid to appropriate design and are not intended as a
checklist of ifems for compliance.

The Board's 2006 decision to allow for the construction of a new garage in the
location of the cozltributulg garage at 413 Spruce Street was based upon the
understanding that the contributing building would be re-located in front of the
new building on the property and rehabilitated. The basis for. the decision was

that the garage is a contributing feature of the Mapleton Hill Historic District.
This fact is reflected in the analysis section of the staff memo (adopted by the
Board as findings for the decision) which reads,
"Staff considers the proposed relocation of the existing garage and
adjacent new construction appropriate in terms of site planning, mass,
scale, materials, and detailing. Many of the other lots within the
immediate neighborhood also have smaller backyards due to the smaller
lot size. The proposed footprint indicafes it will be secondary to the main
home and will be similar in size to other historic buildings in the area. In
addition the proposed re-location of the historic garage set forward in
front of the proposed new construction means that it will remain a
_ character defining feature of the property and the stxeetscape of the 400
block of Spruce Street."
In light of the fact that an addition to the rear of the existing house at 413 Spruce
Street was approved by the Landmarks Board, but never constructed, locating
the garage in the approximate location of that addition is appropriate. Staff also
considers the proposed new location of the garage more in keeping with its
original location at the back of the buildable portion of the property and will not
affect the character prominence of the property.
Staff considers that issuance of a Landmark Alteration Certificate for the
proposed relocation of the contributing garage would be consistent with the
Historic Preservation Ordinance, the General Design Guidelines, and the Mapleton
Hill Historic District Guidelines. As such, staff finds the application inconsistent
with Section 9-11-18(a)&(b)(1-4) B.R.C., the General Design Guidelines, and the
Mapleton Hill Historic District Design Guidelines; provided the conditions listed
below are met prior to issuance of a building permit far the project.
FINDINGS:
The Landmarks Board finds, with the conditions listed, that the proposed
Landmark Alteration Certificate application is consistent with the purposes and
standards of the Historic Preservation Ordinance, and:
1. The relocation of the historic garage will not damage the contributing
architectural features of the subject property or the Mapleton Hill Historic
District.

2. The proposed demolition will not adversely affect historic architectural

Dear Board Members,
We are writing at the request of our client, Bruce Oreck, who owns the property at 413 Spntce St. in
Boulder's Mapleton Hill District. We are contuiuing our landmark alteration application (HIS2008-00177)
with a request to move the historic garage (which now sits at the front of the property) to a location behind
the historic home on the east side of the property.
During the construction of new buildings on both the 413 and 429 Spruce St. properties (both owned by
Mr. Oreck), we.secured a landmark alteration certificate to move the garage to a remote location, then
brought it back and set it upon a new foundation at the front of the property. The garage had come to lean
on the earth over the last decades, and is now dependent on bracing for structural integrity. This extensive
bracing prevents it from being used for storage or parking. Having invested heavily in the historic aesthetics
of both properties, our client would like to move the garage behind the house to reduce the visual density
of the site and to provide open space for landscape and parking on the streetfront.
Tlie garage would be moved by the same careful process used to move it previously. It is already braced
from the previous move. It would be placed on a treated wood foundation in the location shown on the
site plan (Attachment A).
Our client has invested a great deal in the preservation of this structure, and respectfully requests that he be
allowed to move it within the site to enhance the usability and open space of the streetfront.

Dear Board Members,
We are writing at the request of our client, Bruce Oreck, who owns the property at 413 Spruce St. in
Boulder's Mapleton Hill District. We are continuing our landmark alteration application (HIS2008-00177)
with a request to move the historic garage (which now sits at the front of the property) to a location behind
the historic home on the east side of the property.
During the construction of new buildings on both the 413 and 429 Spruce St. properties (both owned by
Mr. Ureck), we secured a landmark alteration certificate to move the garage to a remote location, then
brought it back and set it upon a new foundation at the front of the property. The garage had come to lean
on the earth over the last decades, and is now dependent on bracing for structural integrity. This extensive
bracing prevents it from being used for storage or parking. Having invested heavily in the historic aesthetics
of both properties, our client would like ro move the garage behind the house to reduce the visual density
of~ the sire and ro provide open space for landscape and parking on the strcetfront.
"I~he ~;arar~e ~~•ould be moved by the same careful prcx:ess used to move it previously. It is already braced
from the previous move. It would be placed on a treated wood foundation in the location shown on the
site plan (Attachment A).
Our client has invested a great deal in the preservation of this structure, and respectfully requests that he be
allowed to move it within the site to enhance the usability and open space of the streetfront.
