The following are the action minutes of the April 2, 2008 City of Boulder Landmarks
Preservation Advisory Board meeting. A permanent set of these minutes and a tape recording

The roll having been called, Chair T. Plass declared a duorum at 6:06 p.m. and the
following business was conducted.

The board voted unanimously for both nominations.
T. Plass was voted chair. N. Kornblum was voted Vice-Chair.
4. APPROVAL, OI+' MINUTES
On a motion by N. Kornblum, seconded by 1.. Podma,jenky, the Landmarks Preservation
Advisory Board approved (4-0, Spitzer recused) the minutes as amended of the March 12,
2008 board meeting.

No one from the public addressed the Board.
6. DISCUSSION OF LANDMARK AI,TERA1'ION AND DEMOLITION
AI'I'I,ICATIONS ISSUED AND PENDING
• 819 6`" Street
On a motion by T'. Plass, seconded by J. Spitzer, the Landmarks Board voted (5-0)
that in the event that Historic Boulder withdraws its third-party request for an
initiation hearing for the property located at 819 6`h Strcet, a separate initiation
hearing will be scheduled for the property at a time before the expiration of the stay
of demolition with the Landmarks Board as the applicant.
7. ACTION ITEMS
A. Public hearing and consideration of an application to designate the barn and a
portion of the property at 4051 Broadway Avenue us a local historic landmark as
per Section 9-11-5 of the Boulder Revised Code, 1981 (HIS2008-00010). Applicant:
Cornerstone, Inc., Dean 'I'hedos Owner: Cornerstone, Inc., Dean Thedos
This item was continued at the request of the applicant.
B. Public hearing and consideration of a Landmark Alteration Certificate to construct
a 768 sq. ft. free-standing two-car garage/wood shop at 580 Spruce Street, non-
contributing property located in the Mapleton Hill Historic District: per Section 9-
11-18 of the Boulder Revised Code (HIS2008-00040). Applicant/Owner: Dan
Hersh/Koger Pomainville, Architect: Kristin Lewis
Board members were asked to reveal any ex-pane contacts they may have had on this item.
All of the Board members received an emtul from a neighbor regarding the proposal "I'. Plass,
N. Kornblum, L. Podmajersky and J. Spitzer visited the site. N. Kornblum reviewed the case
at a Design Review Committee meeting and spoke to neighbor Phil Robertson about comments
made at the meeting. L. Podmajersky reviewed a previous case for additions and a garage at a
Design Review Committee meeting.
Applicant's Presentation
Daniel Herst, potential owner, 1050 6`'' Street, applicant, spoke in support of the application and
clarified his relationship to the project.
Kristen Lewis, Kristen Lewis Architects, 1928 14`h Street, spoke in support of the application,
and clarified the change in grade.
Public hearing
Phil Robertson, 550 Spruce Street, spoke in support of the project, and was grateful that a peach
tree on the site is to be preserved.
Rebuttal
The applicant waived their right to a rebuttal.
Motion
On a motion by N. Kornblum, seconded by J. Spitzer, the Landmarks Board approved (5-0) a
Landmark Alteration Certificate to construct a 768 sy. ft. free-standing two-car garage/wood
shop at 580 Spruce Strcet in the Mapleton Hill historic District in that the pri>posed new
construction meets the requirements set forth in Chapter 9-11-18, B.R.C. 1981, subject to the
conditions below, and adopts staff's April 2, 2008 memorandum as findings of the Board.
1. The Applicant shall be responsible for ensuring that the project shall he
constructed incompliance with all approved plans on file in the City of Boulder
Planning Department, except as modified by these conditions of approval.
2. Prior to issuance of a building permit application, the applicant shall submit,
subject to the final review and approval of the Design Review Committee, final
architectural plans showing details regarding materials and colors, including the
following design details: windows, doors, roofing, finish material, paint color,
railings, lighting, driveway and stair materiality. The applicant shall demonstrate
that the design details are compliance with the intent of this approval, the General
De.ti~i,~n Guidelines, and the Mapleton Hill Historic District Design Gacideliites.
3. "I'he applicant shall take proper precautions to preserve a neighboring peach tree.
4. The motion references the most recent set of plans (with the garage shown 1' to
the east)

approved by the Design Review Committee. N. Kornblum accepted the friendly
amendment.
I,. Podmajersky offered a friendly amendment that the stair reconstruction materials
be reviewed and approved by the Design Review Committee. N. Kornblum and J.
Spitzer accepted the friendly amendment.
C. Public hearing and consideration of a demolition permit for the buildinK located at
2727 Valmont Road, per Section 9-11-23 of the Boulder Revised Code (IIIS2008-
00039). Applicant: City of Boulder Owner: Stephen 'Cebo
Board members were asked to reveal any ex-parse contacts they atuy have had on this item.
'1'. Plass, N. Kornblum and J. Spitzer visited the site. L. Podmajersky reviewed the case at a
Design Review Committee meeting and called the project up to the Board. 'T. Plass reviewed the
case in 2004 under a Section 106 Review where the building was determined to have no
significance.
Applicant's Present<~tion
Annie Noble, City of Boulder Transportation Department, 1739 Broadway, spoke in support of
the demolition application and described the Elmer's Two-Mile Creek project.
Public Hearing
No one from the public addressed the Board.
Rebuttal

Motion
On a motion by N. Kornblum, seconded by L. May, the Landmarks Board issued (.5-O) a
demolition permit for the building located at 2727 Valmont Road, subject to the applicant
submitting archival quality photographs of the exterior of the building in accordance with HABS
Level IV documentation standards to the Planning Department for archiving with the Carnegie
Branch Library for Local History, and requested that a plaque commemorating the building with
a photograph be placed on the site, and adopts the following as findings of the board:
Issuance of a demolition pemrit for the house at 2727 Valmont Road is appropriate based
on the criteria set forth in Section 9-11-23(fi) B.R.C, in that the identified building:
a} Is not eligible for individual landmark designation based upon its historic,
architectural, and environmental significance; due to significant alterations
resulting in a loss of integrity;
b) Does not contribute to the character of the neighborhood as an intact
representative of the area's past.

Government program
B. Discussion of board and commission conflicts of interest- postponed until 1Vlay

C. Review of proposed signs for Historic Districts designated since 1997
D. Review of plaque language for recently designated landmarks
E. Consideration of interim approaches to regulating floor area ratios/pops & scrapes
On a motion by 'C. Plass, seconded by L. May, the Landmarks Board unanimously
recommended (5-0) to Planning Board and City Council the adoption of an interim
ordinance with regard to Floor Area Ratio, including provisions listed nn page 2 of
the Planning Board memorandum dated April 3, 2008, as outlined/detailed below:
1. Use a sliding scale approach in the RL-1, RE, and RR zoning districts
along the lines of the versions in Attachment C, using a baseline FAR of
.~25 for 7,000 square foot lots.
The Landmarks Board agrees that it is important to include RL-2 and
RMX-1 districts in an interim ordinance both for reasons of equity and to
address concerns that limits in the other -rones may lead to more
redevelopment pressure in these districts. 'I'he Landmarks Board supports
a sliding scale for the RMX-1 district that is comparable to the RL-I, RE
and RR zoning districts, but with a separate, unspecified baseline number.
The RMX-1 district includes areas such as the Whittier neighborhood, a
potential historic district, and the Landmarks Board is concerned that
applying a maximum FAR would possibly lead to deterioration of the
historic resources. A par-ticuiar methodology is not specified for the RL-2
district, but the Landmarks Board finds that it is important to include in
the interim ordinance for the reasons stated above.
3. Continue to include garages and other above ground square footage in the
maximum floor area calculations, incorporate Option 2 on page 7 for
calculating basement square footage (proportional approach), and Option
1 for addressing ceiling heights on page 7, finding that the Landmarks
Board is most concerned with the overall massing of a building, rather
than specific ceiling heights.
4. Provide for a variance procedure through the Board of Zoning Ac~justrnent
subject to call up by Planning Board as described in Option 1 on page 8.
5. Provide grandfathering provisions and address nonconformities as
described on page 9.
6. Apply the ordinance to all building permit applications filed after City
Council first reading of the interim ordinance, thereby exempting permits
already in the review process. Without this provision, the pending
ordinance would apply to all applications not yet approved.
7. Include a sunset date of March 31, 2009.
