4. Continuation of a public hearing and consideration of an application filed on March 7, 2025
from Ado’s LLC dba Ado’s, 1143 13th St, Unit 101, Boulder CO 80302; Jose Ado Salguero, 100%
owner and Registered Manager with a premises mailing address for a renewal of a Hotel-
Restaurant type liquor license.
Jose Ado Salguera, licensee, appeared for this matter and was sworn in. The Chair read the
procedures into the record. No ex-parte communication or conflicts of interest were disclosed.
Mr. Salguera gave testimony as to the late filed renewal and suspension of alcohol sales.
Member Roberts moved, Member Carr seconded, to approve the renewal application with the
condition that the licensee appear for 8 monthly check-ins, is paying sales tax timely and is
responsive to city staff. Motion passed 4:0.
5. Continuation of a public hearing and consideration of an application filed on June 13, 2025
from The Riverside Group Ltd. dba Riverside, 1724 Broadway St, Boulder CO 80302; Richard
Moser, Member with 62% Ownership and Registered Manager; Andries Loubser, Member
with 22% ownership and with no other member over 10% ownership for a renewal of an
Entertainment type liquor license.
Richard Moser, licensee, appeared for this matter and was sworn in. The Chair read the
procedures into the record. No ex-parte communication or conflicts of interest were disclosed.
Mr. Moser gave testimony as to the late filed renewal and sales tax issues. Penelope Rhodes
appeared and requested monthly check-ins for the next year to ensure sales tax compliance.
Member Roberts moved, Member Carr seconded, to approve the renewal application with the
condition that the licensee appear for 12 monthly check-ins and is compliant with the
requirements of the liquor license with the option to extend monthly check ins after the period
of 12 months. Motion passed 4:0.
6. Public hearing and consideration of an application filed on August 6, 2025 from CiaoLuv LLC
dba Morso, 627A S Broadway, Boulder CO 80305; Hosea Rosenberg, 75% Owner and
Registered Manager and Peter-Christian Olivo, 25% Owner with a business mailing address
of 1606 Conestoga St, Boulder CO 80301 for a New Hotel-Restaurant type liquor license.
Hosea Rosenberg and Peter-Christian Olivo, applicants, appeared for this matter and were

sworn in. The Chair read the procedures into the record. No ex-parte communication or
conflicts of interest were disclosed.
Mr. Hosea and Mr. Olivo provided testimony regarding the operations of the new business,
past experienced with liquor licenses, employee training plans and the premises diagram. The
applicants answered questions from the Board regarding operating characterizes and the liquor
license.
Member Roberts moved, Member Carr seconded, to approve the New Hotel-Restaurant type
liquor license. Motion passed 4:0.

Katelyn Kellogg confirmed that the Board would be available to host a hearing on December 17, 2025.
The Board confirmed. Ms. Kellogg also informed the Board that they have an opportunity to provide
City Council with comments by December 19, 2025. The Board agreed to discuss if they would like to

HEARING PROCEDURES OUTLINE
City of Boulder Beverage Licensing Authority
Suspension or Revocation Hearing with or without Stipulation
1)The Chair will call the meeting item to order, and the Licensing Clerk then reads the matter into
record
(a)The Licensing Clerk swears everyone in
2)The Chair, after calling the meeting item to order, then makes the following opening comments:
This is a public hearing before the Beverage Licensing Authority of the City of Boulder to determine
whether or not the license of [Business Name]: , d/b/a
[Trade Name]: , with a [Type of License]: license
shall be suspended or revoked on the basis of the violations alleged in the Order to Show Cause served
upon the licensee and requiring the licensee’s present here today. Because this is a disciplinary
proceeding, the Authority shall not ask for or allow comment from members of the general public on the
guilt of the licensee or the appropriate discipline to be imposed. The purpose of this hearing is to receive
testimony presented by the City and by the licensee in order to enable this Authority to make findings
and to determine by a preponderance of the evidence whether or not the licensee has violated the
various laws as alleged. If, in the course of th e he aring, testimony or other evidence establishes the guilt
of the licensee of a violation of some other law, rule, or regulation than those stated in the notice, the
licensee shall be afforded a reasonable continuance upon any offer th at evidence in defense,
explanation, and mitigation is not then available to the licensee, but can be obtained within the period
of a continuance not to exceed ten days.
A record is being made of these proceedings. All testimony shall be given under oath. The rules of
evidence and requirement of proof and procedure shall confirm to the extent practicable to those in
civil non-jury cases, but when necessary to ascertain facts affecting the substantial rights of the public or
of the licensee, the Authority may receive and consider evidence not admissible under such rules if such
evidence possess probative value commonly accepted by reasonable and prudent persons in the
conduct of their affairs. The rules of privilege required by law shall be respected in this proceeding, and
the Chair may exclude incompetent and unduly repetitious evidence. The Chair shall rule upon all
questions of evidence cand procedure, subject to being overruled on motion sustained by a majority
vote of those members of the Aut hority present.
Should a licensee wish to request a fine in lieu of active suspension days, they should notify the
Authority of this after a penalty is determined, if any, but before suspension posting is discussed, and
the licensee should be prepared to supply an estimated per day suspension dollar amount for the
Authority’s deliberations.
Those who desire to be heard shall identify themselves by stating their name, spelling their last name,
and stating their pertinent address. They shall also be sworn in by the Board Secretary.
3)The Chair, then asks the Authority members if anyone has a conflict of interest for this item or if
they have and ex -parte contacts regarding this item that they wish to disclose. If there is a
conflict of interest or ex-parte contact for an Authority member disclosed, the City Attorney may
inquire as to the details of the disclosure.
4) The following is an outline of the way in stipulated to hearings shall generally proceed:
(a) STIPULATION OFFER: The representative of the City shall be given the opportunity to make a
brief statement that a stipulation agreement has been reached. The representative of the
City shall then state to the Authority what agreement has been reached with the licensee.
(b) STIPULATION ACCEPTANCE: An Authority member must move, and a board member must
second, to accept the Offer of Stipulation. A vote will be held. If the Stipulation Offer is
rejected by the Authority, a full hearing mist take place as set forth in the “Hearing
Procedures for a Suspension or Revocation Hearing without Stipulation.”
5) The Authority shall then afford the licensee the opportunity to present evidence in mitigation
and to make argument in the course of the hearing. The City’s representative shall then be
afforded the opportunity to present any additional evidence in aggravation, and to make a
recommendation as to the discipline to be imposed.
6) After the Authority has discussed the matter of the appropriate disciplinary action, the Chair
shall poll each member of the Authority for their preferred level of discipline, and shall
thereafter first recognize for the purpose of making a motion setting the discipline that member
whose views are the most severe but still appear likely to receive three positive votes. An
Authority member shall move, and a member must second, the motion to set the penalty. At
this time, the licensee should raise the Authori ty’s acceptance of a fine in lieu of suspension.
7) If the Authority votes to order that the license be suspended, then the Chair shall state that
unless there is an objection from the member of the Authority, the order of suspension shall
include a requirement that the licensee post two conspicuous notices specified in the
Department of Revenue Liquor Regulations 47-600(f).
8) The Chair will then announce that the hearing of the Order to Show Cause is concluded, and that
the next item in the agenda should be called.

44-3-901. Unlawful acts – exceptions – definitions. (1) Except as provided in section 18-
13-122, it is unlawful for any person:
(6) It is unlawful for any person licensed to sell at retail pursuant to this article 3 or article 4
of this title 44:
(a) (I) To sell an alcohol beverage to any person under the age of twenty-one years, to a
habitual drunkard, or to a visibly intoxicated person. If a person who, in fact, is not twenty-
one years of age exhibits a fraudulent proof of age, any action relying on such fraudulent
proof of age shall not constitute grounds for the revocation or suspension of any license
issued under this article 3 or article 4 of this title 44.

To Licensee:
YOU ARE HEREBY ORDERED to attend a virtual Beverage Licensing Authority
(the Authority) hearing via video appearance at 3:00 p.m. on Wednesday, November 19, 2025, to
show cause why the above-referenced Hotel Restaurant type liquor license should not be
suspended or revoked, for the following violations:
On September 25, 2025, the licensee did unlawfully permit the sale, serving, giving, or procuring,
of an alcohol beverage to a person who is under twenty-one years of age, 44-3-901(6)(a)(I) under
the Colorado Revised Statutes, as more fully set forth on Exhibit A, attached hereto and
incorporated herein by this reference.
You should be prepared at the above stated time and place to cross-examine any witnesses
who appear against you and to present such evidence as you desire in defense, explanation, and
mitigation. The City's penalty schedule is enclosed. If you are found responsible for the violation,
you will have an opportunity to provide mitigating evidence during the sentencing portion of the
hearing. For a suspension less than the table value found in the penalty schedule, please focus your
efforts on providing evidence of mitigating factors identified on the second page of the penalty
schedule.
This notice was issued pursuant to C.R.S. § 44-3-601, and Section 10-2-2 of the City of
Boulder Licensing Authority Rules of Procedure.
Please be advised that in the event the Authority determines that the facts alleged in this
notice are sufficient to impose a suspension of your license, the Authority will select the specific
days to be served for any imposed suspension. Please be further advised that any imposed
suspension period falls within a 30-day time period from the date of the hearing; 2) the suspension
days are consecutive business days; and 3) that the suspension days are days that your business
would ordinarily and otherwise be open. Once a suspension period is set and approved by the
Authority, it will generally not be modified unless as directed by written order by the licensing
clerk or Authority.

In determining whether or not a second or subsequent violation occurred within a one-year period for abeyance days,
the Authority will use the date of conviction for the first violation (usually the date of the show cause hearing) to the
actual date of the second violation. For example, if a licensee was “convicted” of their first violation at a March 1, 2001
hearing and had ten days held in abeyance for one year and then they were cited on February 1, 2002, that would be
considered a second violation within a year. The licensee would automatically have to serve the ten days held in
abeyance from the first violation, plus their new suspension days determined by the Authority. If however, the licensee
were cited on March 9, 2002, then it would not be considered a second violation within a year.

Important Notice
This handbook is a summary of the policies and procedures in place at all of Birdcall’s (the
Company) fast casual service restaurants. Employees should read and understand the
policies in this handbook. Employees who have questions about any policy should speak to
their supervisor or contact the Human Resources Department.
This edition supersedes and replaces all previously issued editions and any inconsistent
verbal or written policy statements issued prior to this handbook.
Nothing in this handbook creates a contract of employment between Birdcall (the
Company) and any employee. All employees are employed “at will,” which means that
employees can terminate their employment at any time for any reason, and Birdcall can
terminate any employee's employment at any time for any reason.
No employee handbook can anticipate every circumstance or question. In addition, the
need may arise to revise, delete, or add to the provisions in this handbook, except for the
at-will nature of the employment. Birdcall reserves the right to change or delete and
replace the policies in this handbook at any time, with or without notice to employees.
Nothing in this handbook prohibits or restricts employees from exercising rights or
engaging in activities protected by the National Labor Relations Act.

In the unlikely event that meal breaks are impractical due to business operations, all non-exempt
employees who work more than 4 hours in a workday may eat a meal of their choice (within the limits of
the Employee Meal policy located in Handbook Addendums) while performing their duties. Employees will
be paid for time worked while consuming on-duty meals.
Paychecks
The Company’s pay period for all employees is bi-weekly on Friday. If a pay day falls on a federal holiday,
employees will receive their paycheck on the preceding workday. Paychecks are directly deposited into
your checking and/or savings accounts, or the Company will provide you with a pay card for direct deposit
needs (if the employee does not have a bank account).
On each payday, employees will be provided with an electronic statement showing gross pay, deductions,
and net pay which is accessible in the employees Paylocity self-service portal.
Administrative Pay Corrections
The Company takes all reasonable steps to ensure that you receive the correct amount of pay in each
paycheck and that you are paid on the scheduled payday. In the unlikely event that there is an error in the
amount of pay, you should promptly advise the Human Resource Department (HR@eatbirdcall.com) so that
the discrepancy can be investigated, and any corrective action is taken as quickly as possible.
Meetings, Workshops, Projects, and Training Programs
The Company will pay non-exempt employees for their attendance at meetings, workshops and training
programs and time spent on assigned projects when attendance at the training or completion of the
project is mandatory.
Garnishments
The Company complies with applicable federal and state laws regarding the garnishment and assignment
of wages.
Deductions from Wages
Employees’ wages will be deducted for taxes, Social Security, Medicare, court-ordered garnishments and
other legally mandated payroll deductions or deductions elected by the employee. The Company may also
deduct from an employee’s wages for theft, or any amount of money or value of property entrusted to an
employee that the employee mishandles, loses, or fails to return to the Company, in accordance with state
law.
Code of Conduct and Workplace Practices
Disciplinary Action
As an at-will employer, the Company does not require any particular form or number of disciplinary
warnings prior to termination. The Company reserves the right to discipline and terminate employees.
When, in the opinion of the Company, a problem with your performance, attendance, or any other problem
becomes apparent, disciplinary action may be taken, up to and including termination. The use of
progressive discipline is left to the sole discretion of the managers and other supervisory individuals
involved. Nothing in this disciplinary policy limits the policy of employment at-will or restricts the right of
either party to terminate employment at any time, with or without cause, prior warnings, or counseling.

Participation in Human Resources Investigations
Birdcall is committed to ensuring that all Company-initiated investigations are conducted in a fair,
impartial, thorough, thoughtful manner and in compliance with all state, federal, and local laws. If an
employee is interviewed as part of the investigation, confidentiality must be upheld, and good-faith
statements must be provided to the Human Resources Department during the investigative process.
Failure to comply in investigations or making unfaithful statements during the investigation process may
be grounds for corrective action, up to and including suspension and/or termination of employment.
Job Performance Evaluations
The purpose of a performance evaluation is to communicate to employees their level of development.
Verbal and written performance evaluations will include positive recognition and specific
recommendations for improvement.
Employees are given the opportunity to discuss their performance evaluation with their manager. This is a
good time to ask questions. Performance evaluations help the Company make important decisions about
job placement, training, development and pay increases.
A satisfactory performance evaluation does not guarantee a pay increase, nor does it alter, modify, or
amend the at-will employment relationship between the employee and the Company. Employees are given
a performance evaluation at least once a year.
Work Schedules, Tardiness and Absences
Employees are expected to report to work as scheduled, on time and prepared to start work. Employees
also are expected to remain at work for their entire work schedule, except for meal periods or when
required to leave on authorized business by the Company. Late arrivals, early departures or other absences
from scheduled hours are disruptive and must be avoided.
A tardy or absence is considered “excused” when the employee calls ahead of time, and the tardy or
absence is for a reason that the Company considers satisfactory in accordance with applicable law.
Otherwise, the absence is considered “unexcused.”
Employees who are not going to report for work as scheduled must call the store and speak to the
supervisor on duty via phone as far in advance as possible but not later than four (4) hours prior to the
start of their shift to report their absence (except in cases of emergency where the employee must notify
their supervisor as soon as practical). It is the employee’s responsibility to continue contact until they
speak with the supervisor on duty. Employees who rely on others to report their absences, or who report
absences to anyone other than their immediate supervisor, do so at their own risk and may be subject to
corrective action, up to and including termination.
Excessive unexcused absenteeism (including tardiness and early departures) will result in disciplinary
action, up to and including termination. No specific number or type of prior warnings is required before
termination.
Any employee who is absent from work without properly reporting their absence for any period of two (2)
consecutive scheduled shifts will be considered to have abandoned and voluntarily resigned from their
employment.
Work schedules for restaurant employees are posted online in the online scheduling software and in the
restaurant in advance, every Wednesday by EOD. Each employee is responsible for checking the schedule
weekly to see if there have been any changes. Non-illness or emergency related absences must be covered
in the online scheduling software. The shift must be released, picked up and approved by management at
least twenty-four (24) hours prior to the employee’s shift. From time to time, the Company will schedule

mandatory paid employee meetings. Attendance is required at these meetings unless the employee’s
absence is pre-approved by the manager.
If an employee is sick (some symptoms may include, but not limited to fever, vomiting, diarrhea, sneezing
and coughing), it is the employee’s responsibility to report their condition to their manager or supervisor. If
a restaurant employee has an open sore or rash, they must immediately call and report the condition to a
manager and may be excused.
In the event of an illness, injury, or an absence lasting more than three (3) consecutive shifts, your
manager or the Human Resources department may require documentation to support your absence.
Acceptable documentation may include a doctors’ note or equivalent, verifying that your absence was
medically necessary and/or confirming your fitness to return to work (with or without limitations). Failure
to provide return to work documents when requested may result in corrective action, up to and including
termination of employment.
Work Rules and Performance Standards
Standards of conduct are necessary for the orderly operation of the Company’s business and for the
protection and fair treatment of all employees. All employees of the Company are expected to render
services in an honest, efficient, and courteous manner. All the Company employees are responsible for
adhering to the Company’s policies, rules, directives, and procedures outlined in this handbook.
In determining appropriate discipline, the Company will consider the seriousness of the infraction, the
employee’s past record with the Company and the circumstances surrounding the matter. Disciplinary
action may include verbal or written reprimand, pay reduction, disciplinary demotion, suspension with or
without pay and termination of employment. However, no disciplinary action needs to be taken prior to
termination of employment, as all employees are employed at-will and thus may be involuntarily or
voluntarily terminated with or without notice or cause.
While it is not possible to identify every work rule or performance standard, the following list provides
examples of employee misconduct that will result in disciplinary action, up to and including immediate
termination of employment.
• Failure to abide by the Company’s policy set forth in the Handbook.
• Insubordination, including but not limited to, failure or refusal to obey orders or instructions of
members of management or disregard of proper authority.
• Abuse, misuse, theft, unauthorized possession or removal of the Company’s property or the
personal property of others.
• Falsifying or making a material omission on the Company’s records, reports, or other documents,
including time, payroll, personnel, and employment records.
• Disclosing confidential Company information or trade secrets (including recipes) to unauthorized
outside entities or persons.
• Fighting, attempted bodily injury, or other violation of the workplace violence policy on Company
property, parking lots or adjoining premises.
• The use of profane, abusive, threatening, or intimidating language toward others.
• Neglect of duty or failure to meet the Company’s expectations for the quality and quantity of work.
• Threatening, intimidating, coercing, or otherwise interfering with the job performance of fellow
employees.
• Violation of the Company’s policy on alcohol, drugs, and controlled substances.
• Clocking in or out for another employee or knowingly allowing another employee to clock in or out
for the employee.
• Participating in horseplay or practical jokes on Company time or on Company premises.
• Using or possessing firearms, ammunition, knives, explosives, or any other dangerous materials on
Company premises, parking lots or adjoining premises at any time.

• Unexcused absence from work, failure to promptly report an absence, failure to report to work at
the time the Company was advised to expect a return or failure to notify the Company of the need
for an extension to the absence.
• Failure to observe working schedules, including rest and meal periods, or leaving work early without
permission.
• Violation of the Company’s policy on dress and appearance.
• Failure to provide a health care provider’s notice when the information is requested or required.
• Violation of any safety, health or security policies, rules, or procedures.
• Creating or contributing to unhealthy or unsanitary conditions.
• Committing a fraudulent act or a breach of trust under any circumstances.
• Violation of the Company’s Equal Employment Opportunity and Discrimination, Harassment, and
Retaliation Prevention Policy, including unlawful discrimination, prohibited harassment or retaliation
based on sex, race, color, national origin, age, religion, disability, or other classification protected by
applicable law.
• Excessive, unexcused absenteeism or tardiness.
• Engaging in unlawful conduct.
• Failing to perform work duties as outlined in the job description or as required by the Company.
Nothing in this policy, or any discipline that may be implemented, alters the at-will status of employment
with the Company. Both the employee and the Company can terminate the employment relationship at any
time with or without cause or prior notice.
Nothing in this policy is intended to, in any way, interfere with, coerce, or restrain any employee from
exercising their rights under any federal or state labor law including the NLRA.
Responsible Alcohol Service
Birdcall is committed to the responsible service of alcoholic beverages to responsible guests. We are also
dedicated to safeguarding our employees and the broader community.
All Front-of-House and management employees of legal serving age must successfully complete an alcohol
awareness training/serving program prior to or within 30 days of employment. Employees must also
participate in timely recertification of their alcohol awareness training to maintain compliance. The Human
resources department will track certification expiration dates and will cover the cost of the recertification
by providing a pre paid voucher or reimbursement.
Alcoholic beverages will not be served to anyone under 21 years of age or to individuals exhibiting visible
signs of intoxication. Before serving alcohol, employees are required to verify the identification of guests
who appear to be under the age of 50. Identification must show that the guest is at least 21 years old, be
valid and not expired, display the date of birth, supporting identifying factors such as height and hair color,
and a clear photo of the guest, and show no signs of tampering such as peeling, cracking, bending, or hole
punches. Acceptable forms of ID include a driver's license, valid passport or passport card, state-issued
identification with a photo and birthdate, or a military ID. It is the Company’s policy to not accept vertical
IDs. Any other forms of ID must be reviewed and approved by a manager before alcohol is served.
Employees must immediately notify the manager on duty when a guest shows visible signs of intoxication.
Once identified, the guest will be informed that the service of alcoholic beverages will be discontinued. An
incident report will be completed and kept on file. Intoxicated guests will be strongly encouraged to use
alternative transportation options. If the guest refuses and leaves in their vehicle, employees may notify
the appropriate law enforcement officials if they feel comfortable doing so and should notify the manager
on duty.

to read and comply with the policies in the handbook.
I understand that, except as may be required by state law or otherwise agreed to, my employment with the
company is at will. This means that neither I nor the company is committed to an employment relationship
for a specific period of time and the employment relationship may be terminated by me or the company at
any time, for any reason.
I understand that the handbook and all other written and oral materials provided to me are intended for
informational purposes only. I understand that the policies and benefits, both in the handbook and those
communicated to me in any other fashion, are subject to interpretation, review, and change by
management at any time without notice.
I further agree that neither this document nor any other communication shall bind the Company from
employing me now or hereafter and that my employment may be terminated by me or the Company

commitment for employment. I also understand that if such an agreement is made, it must be in writing
and signed by the CEO of the Company.
I also agree that the Company may deduct from my paycheck the cost of any unreturned Company
property, including aprons, keys, or other property belonging to the Company that I did not return at the
time of my termination.

therefore are not all inclusive. This handbook supersedes all previously issued editions. No oral statements
or representations can change the previsions of the handbook or ANY supplement. Except for the at-will

Application for a Change of Location of a Liquor License
1) The Chair will call the meeting item to order, and the Licensing Clerk then reads the matter into
record
2) The Chair, after calling the meeting item to order, then makes the following opening comments:
This is a public hearing before the Beverage Licensing Authority of the City of Boulder to determine
whether or not the application of Applicant [Business Name]: ___________________________, d/b/a
[Trade Name]: _________________________, for a change of location of a [Type of License]:
____________________________license shall be granted or denied. This hearing is conducted pursuant
to the laws of the State of C olorado and the Rules of the Beverage Licensing Authority of the City of
Boulder.
The purpose of this hearing is to receive information, data, and testimony by interested parties in order
to enable this Authority to make the findings and to reach the conclusions required to be made by state
law as to whether or not the license applied for shall issue. Interested parties are the Applicant,
residents of the neighborhood under consideration, and the owners and managers of a business located
in the neighborhood under consideration. For purposes of determining who is an interested party at this
hearing, the neighborhood under consideration is the neighborhood previously defined by the
Authority. The Authority shall make a final determination of the affected neighborhood prior to
determining whether the license shall be issued. Any interested party may speak to the question of
neighborhood designation, as well as other information relevant to the granting or denial of the
application.
A record is being made of these proceedings. Those who desire to be heard shall identify themselves by
stating their legal name, spelling their last name, and stating their pertinent address. They shall also be
sworn in by the Board Secretary.
3) The Chair, then asks the Authority members if anyone has a conflict of interest for this item or if
they have and ex-parte contacts regarding this item that they wish to disclose. If there is a
conflict of interest or ex-parte contact for an Authority member disclosed, the City Attorney may
inquire as to the details of the disclosure.
4) The Chair, then inquires whether there are:
i) interested parties present or persons who will act as witnesses for interested parties
(they have standing because they reside in or own or manage a business in the
designated neighborhood to provide testimony, submit evidence, or cross examine
witnesses), or
ii) members of the general public who wish to supply comment (they do not have standing
as interested parties because they are not located in the designated neighborhood)
5) The Chair asks the Applicant whether they are ready to proceed. If the Applicant answers in the
affirmative, then the Chair inquires whether the Interested Parties are ready to proceed and, if
they are not, asks for reasons why the application hearing shall not now proceed.
6) If the Applicant and Interested Parties state that they are ready to proceed, then public
comment is taken. Public comment is supplied in 3 minutes per person timed increments.
7) The Applicant then presents their evidence. The Applicant and the applicant’s witnesses may be
cross-examined by members of the Authority, by Interested Parties, by the City Attorney and by
representatives of the Boulder Police Department.
8) The Interested Parties may then present their evidence in support of or in opposition to the
application. The Interested Party and the interested parties’ witnesses may be cross-examined
by members of the Authority, by Interested Parties, by the City Attorney and by representatives

9) At the Authority’s discretion, the Applicant may present rebuttal evidence.
10) The Chair then closes the matter for Authority deliberations. After this time, no further evidence
or testimony may be taken.
11) A member of the Authority then moves, and a member must then second, to approve or
disapprove the application or, for good cause, to continue the matter. Authority discussion on
the basis for their upcoming vote to the motion should be undertaken by all members. After

GREETINGS:
Pursuant to C.R.S. 44-3-312(1) and the below referenced State laws and the city of
Boulder Beverages Licensing Authority (BLA) Rules of Procedure, you are hereby advised
that with regard to the application for a Change of Location of a Hotel-Restaurant type
liquor license, an investigation has been made and based on the results thereof the
following has been determined:
1. APPLICATION PACKET
Responsive to C.R.S. §44-3-311(1) and BLA Rules of Procedure Section 4-3, the
applicant, as stated above, submitted an application packet, which was
substantially complete, to the City Clerk's Office on September 24, 2025.
2. PREVIOUS DENIALS AT THE SAME LOCATION
Responsive to C.R.S. §44-3-313 (1)a et seq. and BLA Rules of Procedure,
Subsection 5-1-1 (A), as this is an application for a malt, vinous, or spirituous
liquor license, that within two (2) years, preceding the date of the application,
neither the state nor Authority has denied an application for the same class of
license at the same location or within 500 feet of the same location, for the
reason that the reasonable requirements of the neighborhood and the desires of
the inhabitants were satisfied by the existing outlets. This requirement is not
applicable to applications for Bed and Breakfast Permits.
3. POSSESSION OF PREMISES
Responsive to C.R.S. §44-3-313 (1)b and BLA Rules of Procedure, Subsection 5-1-
1 (B), it appears from the evidence submitted that the applicant is entitled to
possession of the premises where the license is proposed to be exercised until
August 31, 2010.
4. ZONING AND HEALTH DEPARTMENT REGULATIONS COMPLIANCE
Responsive to C.R.S. §44-3-313 (1)c and BLA Rules of Procedure, Subsection 5-1-
1 (C), selling alcohol in the manner proposed in the application is not in violation
of any zoning laws of the City of Boulder and the use is consistent with the
location’s permissible planning conditions and zoning district. The applicant must
meet all applicable laws, rules and regulations of the City’s Planning Department
as to construction and building safety requirements at the premise, and if
applicable, the Boulder County Health Department and the State Board of Health
for food preparation and service.
5. PROXIMITY TO SCHOOLS
Responsive to C.R.S. §44-3-313 (1)d et seq. and BLA Rules of Procedure,
Subsection 5-1-1 (D), the building in which the liquor is to be sold has a local
distance waiver enacted or is not located within five hundred (500) feet of any
public or parochial school or the principal campus of any college, university or
seminary. This requirement is not applicable to applications for Bed and
Breakfast Permits.
6. BACKGROUND INFORMATION
Responsive to C.R.S. §44-3-307 and BLA Rules of Procedure Subsection 5-1-3, this
topic was intentionally omitted from investigation by Licensing Clerk.
7. APPLICANT FINANCIAL INTEREST
Responsive to C.R.S. §44-3-308 and BLA Rules of Procedure Subsection 5-1-1 (G),
the applicant’s financial interest and associated parties disclosures are to be
found in the submitted city of Boulder BLA Financial Statement with
attachments, the submitted Colorado Liquor Retail License Application or
Colorado Fermented Malt Beverage (3.2% Beer) License Application with
attachments, and the submitted Individual History Record with attachments. A
copy of each of these mentioned documents should have been retained by the
applicant at the time of application and a copy of these mentioned documents
will be provided to the BLA for the purposes of local licensing authority
deliberations.
9. NEEDS AND DESIRES EVIDENCE
Responsive to C.R.S. §44-3-312 (2)(a) and (b) and BLA Rules of Procedure Section
4-1 through Section 4-4, the applicant is reminded that they have the burden of
proof to provide to the Authority for consideration sufficient evidence
confirming that the adult residents and business owners and managers within
the prior established boundaries of Authority designated Neighborhood both
need and desire proposed liquor license at the new location in type, manner and
location.
10. PUBLIC HEARING INFORMATION
Responsive to C.R.S. §44-3-311 and BLA Rules of Procedure Section 5-1, you are
hereby notified that a public hearing on this application will be held on virtually
on Wednesday, November 19, 2025 at 3:00 p.m., At said hearing, you will have
the opportunity to be heard regarding all matters pertaining to the application,
including all matters herein set forth.
You are advised to obtain a copy of the State Laws, Rules, and Regulations pertinent to

Survey Methodology
The circulators were over 18 years old.
Each circulator had a clipboard with the following:
1. A map of the designated area provided by the City of Boulder Clerk’s Office
describing the boundaries of the defined neighborhood.
2. A petition/signature page where people contacted could indicate their
support or opposition for the license.
3. A tally sheet to record the results of those who did not sign.
People were shown the petition, the neighborhood map, and were verbally told of
the Change of Location for the Hotel and Restaurant Liquor License being applied
for, site location, applicant’s name.
Each person who signed the petition indicated they were either an owner/manager
of a business or resident located within designated area and were 21 years of age
or older.
Each signature was freely and voluntarily given without any influence from the
circulator.

Statistical Analysis For Needs and Desires
There was one (1) signature in opposition to the liquor license (mentioned
earlier). In order to show “needs and desires,” it should consider whether there
are enough same license types in the designated neighborhood. In my opinion,
the signature opposed does not fit the definition of “needs and desires.”

Clerk’s email, cityclerksoffice@bouldercolorado.gov, by Friday December 19th 2025.
For winter 2025, city council is seeking priority recommendations from boards and
commissions to inform discussions at their 2026 Council Retreat, which will include
setting one-year council priority projects. Priorities this year will be limited in number
and expected to be able to be completed in 12 months or less, due to the change in
council election cycles leading to a November 2026 election. Proposed priorities
should align with the citywide strategic plan and/or existing department plans
for each board/commission.
Please do not exceed two (2) pages total.
