RESOLUTION NO. 1041
A RESOLUTION OPPOSING PROPOSED AMENDMENT 52 TO THE COLORADO
CONSTTTUTION CONCERNING USE OF SEVERANCE TAX REVENUE FOR
HIGHWAYS
FINDINGS
The City of Boulder City Council finds as follows:
1. Amendment 52, a proposed amendment to the Colorado Constitution that concerns use of
severance tax revenue for highways, has been placed on the statewide ballot for 2008,
and
2. The City of Boulder suppoRS the collaborative process being led by the Colorado
Transportation Finance and Implementation Panel, which has developed consensus
proposals for addressing transportation needs on a statewide basis that recognize the
existing state and regional planning processes and which is anticipated to be making
specific recommendations to the governor and General Assembly for consideration at the
next legislative session; and
3. Amendment 52 preempts this regional and statewide planning processes by
constitutionally designating a funding mechanism and a priority corridor; and
4. Amendment 52 establishes a priority for allocating the new funds to I-70 but does not
guazantee that the new money will be in addition to current funding for existing projects
on I-70; and
5. To provide additional transportation funding, Amendment 52 diverts severance tax
revenues that would otherwise be available under current law for projects to help meet
growing water supply demand and infrastructure maintenance, as well as water
conservation and other programs determined by the General Assembly; and
6. Amendment 52 places spending earmarks in the state constitution without an adequate
public policy discussion and embeds another fiscal constraint in the state constitution;
RESOLUTION
The City of Boulder does hereby declare its opposition to, and urges a NO vote on, the ballot
question known as Amendment 52, which will appear on the November 4, 2008 election ballot. ~ ~
