code enforcement. Our neighbor 1035 Kalmia Ave (owners, Kristin and Orion Creamer)
have built a drainage system (which includes piping and grade alterations) to expel water
directly into our yard without a permit. We have tried (politely) talking with the owners. Our
requests for information and remedy were refused.
The codes being violated are:
1. expelling water directly into another (our) property
2. significantly and consequentially (for us and the neighborhood) altering the topography of
the lot without a permit
3. We don't know if this is a code violation: misrepresenting the City (owners initially
claimed that they had permits --there are no permits associated with the alteration at issue)
4. We don't know if this is a code violation: flooding a fire hydrant
Note: Prior to their drainage system and grade alterations, no water was running to our lot,
the RoW, or the street.
Documentation for all above available.
The damages are:
a. flooding our yard
b. killing a mature tree that my mom planted 15 years ago and damaging 2 other trees
c. increasing risk of property/building damage during severe weather

Much thanks to your office for sending someone out from the Ditch Company to my mom's
house. He said that RoW asked someone to come out. We have no idea what he did but
impressively the problem was fixed the very next day. There has been no water for nearly a
week. And the sidewalk was cleaned even before our order of algae remover arrived.

Coincidentally we have another unrelated ditch water issue -different ditch. Our neighbors
have built a drainage/piping system that empties water directly into our lot. This floods our
front yard and puts us at risk during severe weather. They have provided no information other
than that their civil engineer designed and approved it and that your office signed-off on it.
We have attached a letter describing the problem (and supporting materials) but didn't know to
whom to send them. If we've contacted you in error, if you could point us in the right

Does Energov have an interface with GIS for in-city out of city addresses? A common theme from
landlords in the comments about the tax was “I didn’t vote for this tax” It would be interesting to
look at the mailing addresses for the owners and see exactly how many are located in the city.
If it would require extra work it might not be worth it, but if it’s already there it could be an
interesting data point.

Looking at the rental tax language drafted by NEWR, the only renters exempted from the tax are
“exempt from a rental license in Section 10-3-2, B.R.C. 1981.”
Do you ever issue a license to someone who is exempt from the license requirement?
I’m just trying to refine the estimate for the tax, and I’m thinking it may just be all of the active
licenses on the license spreadsheet. The group may have a few policy decisions to make, like do we
charge the tax to affordable housing licensees and short-term rental licenses.

Thanks for being on the call this morning and good info from Anne on putting delinquencies on the
property tax bills – that will definitely help with compliance.
I think we still need to clarify the number of dwelling units we expect to be subject to the tax (vs.
license numbers) before our budget discussion? In the attached spreadsheet (that I think you got
from Planning, from EnerGov), the number of dwelling units totals ~ 19K but I have heard other
numbers like 15K units subject to the tax??

Hi All,
Below are some notes from a conversation I had with Tonia Pringle in P&DS this afternoon about
rental licenses. Apologies, they’re pretty rough. I’ve also attached a spreadsheet with rental housing
license information from Energov. I hope these will be helpful for our conversation tomorrow.
Appx 10,600 RHLs, ~9,600 would be subject to the tax
Expiration date can differ from issue date for multiple reasons, best to drive renewals based on issue
date
Contacts:
Always has an owner
90% of time P&DS creates a second contact if there is a spouse
Applicant is usually the property agent, but owner will always be on the case
Professional license holder is always the owner
LLC/company won't have an email, but their agent will
Energov constraint due to the way contacts work on professional licenses
Could prove a challenge for data imports
Agents will often give their email address for owner's email – will have to work to clean this up
RHL application has a way to list a contact preference (e.g. owner or agent)
P&DS may be able to add a taxpayer contact field to the RHL application
Energov case has dwelling and rooming units – tax is based on dwelling units
Energov is not secure enough to store Federal Tax IDs – this is a challenge for GenTax, but we
overcame it with Short-Term Rentals
P&DS will only close a license if notified by the owner (i.e. there may be hundreds of “stale” licenses
in Energov)
Renewals :
Long-term rentals renew every four years
P&DS goes into renewals with assumption that they are eligible (i.e. they give licensees time
to resolve outstanding renewals)
If get a new application for the same address - verify ownership change with assessor, close
out old license, issue new license
Average 100-300 renewal notices a month
15-18/mo with ownership changes
~100/mo new applications
