By signing this ROW Permit, the Contractor accepts full responsibility for damage done to the City Right-of-Way (this
may include, but is not limited to damage to the street pavement, sidewalk, trees, and curb & gutter); and further
understands and acknowledges that he/she will be held liable for all required repair work. Further, pursuant to 9-5-11
B.R.C., 1981, the Contractor shall warrant all public improvements constructed under this permit for a period of two years
after final acceptance by the City.
If utility facilities are placed in the City Right-of-Way at the above-referenced location, the City hereby grants to such
utility a revocable permit for those facilities.

Right-of-Way Permit Approval Conditions
The traffic and pedestrian control plan must meet The Manual on Uniform Traffic Control Devices
Standards. All traffic control must be in place before work begins.

Contractor may not block through access of vehicles or pedestrians without approval from the
R.O.W. Inspector. A traffic/ pedestrian control plan must be submitted and approved by the R.O.W.
Inspector.

Applicant agrees to perform all work in accordance with the City of Boulder Design and
Construction Standards, The Manual on Uniform Traffic Control Devices, and the City of Boulder
Tree Protection Criteria for Public Right-of-Way.

OSHA (Occupation Safety Health Administration) requirements will be strictly enforced.
All work must be done per approved engineering plans.
No work shall proceed beyond the end date specified on the permit without approval from the
R.O.W. Inspector.
Call the R.O.W. Inspector before any work begins.7.

Additional fees will be charged for reinspections and after hour inspections per Section 4-20-6.
All streets and paved surfaces shall be restored within 2 weeks of their excavation. Per BRC,
Section 8-5-12, "Standard for Repairs and Restoration of Pavement or Sidewalks."
Landscape must be restored to original or better condition.
Maintain 5' horizontal separation from existing utilities and 18" at all crossings.
Written approval from the city forester is required prior to removing or disturbing any tree in the
public right-of-way. Contact the city forester at 303-441-4406 for details on obtaining approval.

As of Nov. 18, 2019, customers who need to purchase meter-related parts and meter-pit parts from
the City of Boulder, must now call ahead to make an appointment for parts pick up. Please call
303-413-7114 to schedule an appointment. The City of Boulder’s Municipal Services Center’s
Material Supply area is closing. Parts will be sold by appointment to ensure staff are available to
help the customer.

Coordination with adjacent business/residents regarding parking, deliveries and access impacts
must occur.

The applicant is required to ensure that Public Right-of-Way adjacent to this site is kept free and
clear of mud and debris that result from construction activities related to this project.

No Parking signs must be purchased from the City and placed 72 hrs before starting work. Signs
shall be placed at a spacing no less than 19' apart for parallel, on-street parking areas. The back of
the "No Parking" sign must be signed, dated and time of placement written in black marker. Photos
must be taken of front and back of signs. A landscape photo must be taken showing all signs, each
day of placement. The day before working, fliers must be installed in windshields and a photo
taken notifying of possible tows for the following day.

No inspections between noon and 1pm, or after 3:30pm.
You must request the inspection two hours in advance.
Contractor must supply their company name, permit address, permit number, day/time of
inspection request, and type of inspection.
After hour fees will apply for inspectors time extending beyond 4:00 PM.

The City of Boulder Design and Construction Standards defines boring as an alternative installation
method requiring special approval. As a condition of said special approval, Contractor shall locate
all sanitary sewer services in the work area. Contractor shall immediately notify the City and any
impacted property owners of damages to service lines and shall immediately repair damaged
services in accordance with B.R.C., 1981. Failure to promptly identify damage shall not relieve the
Contractor of the obligation to repair the service and remedy any associated damage to property.
20.
Contractor shall resolve any property damage claims associated with this permit within 30 days of
the date of claim. Failure to promptly resolve claims may result in penalties including but not
limited to issuance of a stop work order, withholding issuance of other permits, revocation of
contractor license, claims against the contractor license bond, criminal penalties including
issuance of a municipal court summons, and/or other civil or criminal penalties.
