Federal Aviation Administration (FAA) - Request release of airport parcel r CITY OF BOULDER OFFICE OF THE CITY MANAGER November 1, 2012 Marc Miller Federal Aviation Administration Denver Airports District Office 26805 E. 68th Ave, Suite 224 Denver, CO 80249-6361 Re: Request release of 2.6 acres of airport property at Boulder Municipal Airport Dear Mr. Miller, On the boundary of the Boulder Municipal Airport, there is a 2.6 acre parcel of land that the city has planned for several years to release, in accordance with FAA Order 5190.6B. The property is not conducive to construction of improvements related to the airport for several reasons, primarily because of its sloping terrain and small, narrow configuration. The parcel currently costs money to maintain, and there is no value in retaining it for airport uses. This letter is to request release of this parcel so that the proceeds of its sale can be used for important airport improvement projects. Parcel Information The parcel is located on the southwest corner of Track 7A, as depicted on the airport's property map (see Exhibit A) of the 2007 Airport Master Plan Update ("Master Plan"). The parcel was also depicted on the Airport Layout Plan for future release (see Exhibit B), so this request is to formalize the process. The dimensions and size of the parcel are depicted on the enclosed survey (see Exhibit C) as approximately 2.6 acres. The parcel slopes downward to the southwest, away from the closest taxiway, at gradients up to 23 percent. Due to the sloping terrain and its narrow, triangular shape, it would be financially and technically unfeasible to build a hangar and taxiway on this parcel. The parcel abuts a manufactured housing residential area to the west and on the south and east by Airport Road. The north divider line matches up with a pre-existing fence that already divides this parcel from the main airport. Tract 7A was purchased on Aug. 8, 1958, solely with City of Boulder funds. No FAA funds were used in its purchase and no improvements have been conducted on the parcel using FAA funds. P.O. Box 791 • Boulder, Colorado 80306-0791 - www.bouldercolorado.gov • (303)441-3090 • Fax (303)441-4478 Purpose of Release Release of this parcel is requested because the terrain and size do not afford its use in an aviation capacity and the proceeds from its sale will provide critically needed funds for airport improvement projects (see below for more details). The parcel is an unimproved grassy slope. The sloping terrain not only prohibits construction of a hangar, which needs a large flat space, but the terrain would not meet the minimum requirements for taxiway grade. "Thus, any future construction would not have access to the runway. In addition to the center of the parcel sloping at 13 percent grade, its elevation is approximately 15 feet below the taxiway, making it cost- prohibitive for aviation use now or at any time in the future. In addition, the parcel does not provide aeronautical protection due to its location not being near a runway, safety area, or extended centerline. Lastly, this parcel is located in the same vicinity as Tracts 7B, 7C, and 7D, which have already been released by the FAA (see Exhibit A). Because the charter of the city limits leases of city property to 20 years, there is not a viable market for use of the parcel for construction of a non-aviation use. Therefore, the city has determined that sale of the property is the best option. Proceeds from Sale All proceeds from the sale of this parcel will remain in the airport fund and treated as airport revenue. The sale of this unneeded parcel will provide the airport with matching funds for FAA and state grants, in addition to improving airside infrastructure. In addition, airport operational costs will be reduced slightly when it no longer has to mow and maintain this parcel. The city of Boulder commits that the property will be sold in compliance with FAA Order 5190-613 Section 22.17d. Future Use The airport will ensure that the property carries an avigation easement when sold and that no hazards will be created. Additionally, all future development will be submitted for FAA review, in accordance with 14 CFR Part 77. The airport will also ensure that conditions of the sale require the purchaser to adhere to all applicable laws for the use or development of the released land (e.g., environmental requirements, obtaining all necessary permits, etc.). As airport land, the parcel was originally zoned "Public." Earlier this year, in preparation for release, the parcel was given a new zoning of "bight Industrial." The "Light Industrial" designation is the closest equivalent to its "Public" zoned designation; thus, its potential use remains generally unchanged. In addition, the zoning is the same that was given to Tracts 7C and 7D when they were released. After reviewing FAA Order 5050.413, National Environmental Policy Act Implementing Instructions for Airport Projects, the airport does not feel an environmental assessment would be required or necessary.
