CONSIDERATION OF INITIATION HEARING
Public hearing to consider adopting a resolution to initiate the process for landmark
designation of 1741 Walnut St. pursuant to Section 9-11-3 of the Boulder Revised Code, 1981 or
alternatively issue a demolition approval pursuant to Section 9-11-23 B.R.C, 1981.

EXECUTIVE SUMMARY
The decision in front of the Landmarks Board is whether to initiate the landmark designation
process or not, or alternatively issue a demolition approval for the building at 1741 Walnut St.
In December 2022, the owner submitted an application for full demolition of the 1922
commercial building, which historically served as the Boulder Preparatory School Annex and
the meeting space for the Knights of Columbus. The Landmarks Board placed a stay-of-
demolition on the application on March 1, 2023.

During the stay, staff and Landmarks Board members met with the applicant team to discuss
alternatives to demolition. On May 3, the board voted to hold a hearing to take action prior to
the expiration of the stay of demolition. On Aug. 9, the owners’ representative signed a Tolling
Agreement to extend the stay of demolition to Nov. 8 to provide time to continue to consider
alternatives.
On Oct. 17, the applicant revised their request from full demolition to partial demolition,
proposing the north (alley) façade and 6 ft. of the east and west elevations be preserved. Staff
recommends the Board approve the partial demolition request, finding it is a suitable
alternative to demolition that will preserve the character-defining features of the building.
STAFF RECOMMENDATION
Staff recommends the Landmarks Board approve the partial demolition request.
RECOMMENDED MOTION
Approve Partial Demolition
If the Landmarks Board chooses to issue a demolition approval pursuant to Section 9-11-23
B.R.C, 1981 of the Boulder Revised Code, 1981, staff recommends the following motion
language:
I move that the Landmarks Board approve the application for partial demolition as shown on
partial demolition proposal (see Attachment C) dated November 2023, finding that while the
building at 1741 Walnut St. is potentially eligible for landmark designation, the proposed scope
of work would not be detrimental to the historic character of the building, as the character-
defining features of the alley façade and portions of the east and west elevations will be
preserved.
As a condition of approval, prior to approval of the partial demolition application, the
applicant shall submit to staff for review and approval:
A. Documentation of the portion of the building proposed to be retained:
1. A site plan showing portion of the building proposed to be retained.
2. Measured elevations drawings of the North, East and West Elevations showing
portion of building to be retained.
B. Archival Documentation of the Building as it exists today, to be housed at the Carnegie
Library for Local History:
1. A site plan showing the location of all existing improvements on the subject property;
2. Measured elevation drawings of all exterior elevations of the building depicting existing
conditions, fully annotated with architectural details and materials indicated on the
plans; and

3. High resolution and professional quality digital color images of all exterior elevations.
4. A signed release form to gift the archival documentation of the building to the Carnegie
Library for Local History.
ALTERNATIVE MOTION(S)
Initiate Landmark Designation
If the Landmarks Board chooses to initiate the process for landmark designation pursuant to
Section 9-11-3 of the Boulder Revised Code, 1981, staff recommends the following motion
language:
I move that the Landmarks Board adopt the resolution (Attachment A) to initiate the process
for landmark designation, finding that it meets the criteria for such initiation pursuant to
Section 9-11-3 “Initiation of Designation for Individual Landmarks and Historic Districts” of the
Boulder Revised Code 1981, and, in balance, is consistent with the goals and policies of Section
2.27 of the Boulder Valley Comprehensive Plan.
Do Not Initiate Landmark Designation
I move that the Landmarks Board adopt the staff memorandum dated Nov. 1, 2023, as the
findings of the board and not initiate the process for landmark designation, finding that it
does not meet the criteria for such initiation pursuant to Section 9-11-3 “Initiation of
Designation for Individual Landmarks and Historic Districts” of the Boulder Revised Code 1981,
and, in balance, is not consistent with the goals and policies of Section 2.27 of the Boulder
Valley Comprehensive Plan.
If the Landmarks Board does not take action on the demolition application prior to Nov. 8,
2023, the expiration of the stay of demolition, the demolition will be approved per Section 9-11-
23, B.R.C. 1981.
BACKGROUND
• In August 2019, the Landmarks Design Review Committee (Jellick, Daniels, Gerwing)
reviewed a demolition application (HIS2019-00251) and referred it to the Landmarks
Board for review in a public hearing, finding there was “probable cause to believe that
the building may be eligible for designation as an individual landmark.” The application
was later withdrawn.
• The current applicants commissioned independent documentation and analysis of the
property at 1741 Walnut Street, Boulder, Colorado 1 (link and Attachment D - Colorado

Cultural Resource Survey Architectural Inventory Form 5BL2232). The survey
determined the building was not potentially eligible for local landmark designation.
• On December 2, 2022, the Planning & Development Services Department accepted a
demolition application for the building at 1741 Walnut St. County records indicate that
the building was constructed in 1940; other sources including the Historic Building
Inventory Record (link), Sanborn Fire Insurance maps, and photographs confirm that
the building was constructed in 1922.
• On December 14, 2022, the Landmarks Design Review Committee (Pelusio, Daniels,
Gerwing) referred the application to the Landmarks Board for review in a public
hearing, finding there was “probable cause to believe that the building may be eligible
for designation as an individual landmark.”
• On March 1, 2023, the Landmarks Board voted (4-1, C. Castellano dissenting) to place a
stay-of-demolition on the building, finding the building may be eligible for designation,
it contributes to the character of the neighborhood, and it had not been demonstrated
to be impractical or economically unfeasible to rehabilitate the building. See 03.01.2023

• At the March 1 hearing, two members of the public spoke regarding the application in
support of preservation. During the stay of demolition, the Landmarks Board has
received no formal public comment regarding the property, although two members of
the public attended site visits.
• During the stay, representatives of the Landmarks Board and staff met with the owners
to discuss alternatives to demolition, including preserving the alley façade and a
portion of the east and west walls.
• On May 3, 2023, the Landmarks Board voted (4-0) to schedule a hearing to consider
whether to initiate landmark designation or to issue a demolition permit for the
building at 1741 Walnut St. See 05.3.2023 Landmarks Board Meeting Record (link).
• On Aug. 9, 2023, the City and applicant signed a Tolling Agreement extending the Stay
of Demolition to Nov. 8, 2023. See Attachment B – Tolling Agreement.
• On Oct. 17, 2023, the owner revised the request from full demolition to partial
demolition and submitted plans showing the extent of the proposed partial demolition.

PURPOSE AND CRITERIA FOR THE BOARD’S DECISION
The Landmarks Board may hold a public hearing to consider initiating landmark designation
and may consider, without limitation § 9-11-3 Initiation of Designation for Individual
Landmarks and Historic Districts B.R.C. 1981, § 9-11-1, Purpose and Legislative Intent, and § 9-
11-2, City Council May Designate or Amend Landmarks and Historic Districts. Initiation
hearings are legislative, not quasi-judicial.
STAFF ANALYSIS
The following is the staff’s analysis of the standards for determining whether to initiate the
designation of an individual landmark designation:
Section 9-11-1, Purpose and Legislative Intent
(a) The purpose of this chapter is to promote the public health, safety and welfare by
protecting, enhancing and perpetuating buildings, sites and areas of the city reminiscent

of past eras, events and persons important in local, state or national history or providing
significant examples of architectural styles of the past. It is also the purpose of this
chapter to develop and maintain appropriate settings and environments for such
buildings, sites and areas to enhance property values, stabilize neighborhoods, promote
tourist trade and interest and foster knowledge of the city’s living heritage.
Historic Significance:
Staff considers that the building has historic significance. The building was constructed
in 1922 as a classroom annex for the Colorado State Preparatory School which stood
across the alley to the north (1895 – 1939). It was purchased in 1956 by the Columbian
Home of Boulder for use as a meeting place for the Knights of Columbus, a Catholic
fraternal organization. It is notable for the development of Boulder’s High School system
and the social clubs and fraternal organizations popular in Boulder in the early to mid-
twentieth century. The Boulder Survey of Historic Places, 1988 considered the property
significant as representative of type, period, or method of construction. See Historic
Building Inventory Form (link).2 F.O Repplier writes an account of the school and the
construction of the annex in his book about the growth of Boulder school in As A Town
Grows.3
Architectural Significance:
Staff considers the building to have architectural significance. The building is typical of
the early Twentieth Century Commercial building style 4 with window and door transoms, a
corbelled cornice, pilasters acting as brick ornamentation, and a parapet alongside a flat
roof. The general brickwork, including the cornice, pilasters and the detailed curved and
stepped symmetrical pediment represent skilled craftsmanship. It is an uncommon
example of historic alley buildings downtown. Other examples include the carriage building
behind the former James Hotel (1922 13th Street) and the Lund Building (1918 ½ Pearl
Street).
Environmental Significance:
Staff does not consider the building to have environmental significance. The property is
not located in an identified potential historic district.

(b) The city council does not intend by this chapter to preserve every old building in the city
but instead to draw a reasonable balance between private property rights and the public
interest in preserving the city's cultural, historic and architectural heritage by ensuring
that demolition of buildings and structures important to that heritage will be carefully
weighed with other alternatives and that alterations to such buildings and structures and
new construction will respect the character of each such setting, not by imitating
surrounding structures, but by being compatible with them.
Analysis:
Staff considers that approval of a partial demolition application for this building is an
appropriate balance between private property rights and the public interest in preserving
the city’s cultural, historic and architectural heritage. The building is uniquely oriented
toward the alley; the street-facing wall (south elevation) is utilitarian in nature and devoid
of ornament. However, the alley-facing wall (north elevation) has architectural merit and is
a tangible link to its history as the school annex. Staff considers that preserving the north
façade and a 6 ft portion of the west and east walls and incorporating them into the
redevelopment of the property to be an appropriate alternative to full demolition.
Section 9-11-2. - City Council May Designate or Amend Landmarks and Historic Districts.
(a) Pursuant to the procedures in this chapter the city council may by ordinance:
(1) Designate as a landmark an individual building or other feature or an integrated group of
structures or features on a single lot or site having a special character and historical,
architectural or aesthetic interest or value and designate a landmark site for each landmark.
On May 3, 2023, the Landmarks Board voted (4-0) to schedule a hearing to consider initiation
of landmark designation. See 05.3.2023 Landmarks Board Meeting Record (link).
Section 9-11-3(d), Initiation of Designation for Individual Landmarks and Historic Districts –
CRITERIA FOR REVIEW
(1) There is probable cause to believe that the building or district may be eligible for
designation as an individual landmark or historic district consistent with the purposes
and standards in sections 9-11-1 Legislative Intent, 9-11-2 City Council May Designate or
Amend Landmarks and Historic Districts, and 9-16-1, General Definitions B.R.C. 1981;
Analysis
See above regarding historic, architectural, and environmental significance.

(2) There are currently resources available that would allow the city manager to complete
all of the community outreach and historic analysis necessary for the application;
Analysis
Initiation of landmark designation over an owner’s objection requires additional staff
resources including outreach and analysis. There are limited staff resources available to
process applications for designation of a property without the owner’s input or community
support. Diverting resources away from other Board and program priorities is not
recommended.
The partial demolition request is supported by both the owner and staff.
(3) There is community and neighborhood support for the proposed designation;
Analysis
There has been limited demonstrated community support for the preservation of the
buildings since the application was submitted in December 2022. At the March 1
Landmarks Board hearing, two members of the public spoke regarding the application in
support of preservation. During the stay of demolition, the Landmarks Board has received
no formal public comment regarding the property.
(4) The buildings or features may need the protection provided through designation;
Analysis
There is an active application for demolition of the building. If the Landmarks Board does
not take action on the demolition application prior to the Nov. 8, 2023 expiration of the
stay of demolition, the demolition will be approved per Section 9-11-23, B.R.C. 1981.
(5) The potential boundaries for the proposed district are appropriate;
Analysis
Not applicable for individual landmarks.
(6) In balance, the proposed designation is consistent with the goals and policies of the
Boulder Valley Comprehensive Plan;
Analysis
Policy 2.27 of the Boulder Valley Comprehensive Plan states that, “The city and county will
identify, evaluate and protect buildings, structures, objects, districts, sites and natural
features of historic, architectural, archaeological or cultural significance with input from
the community.”

The plan does not speak specifically to landmark designation over an owner’s objection.
Staff and members of the Landmarks Board met with the owner to discuss possible
alternatives to demolition for the building during the stay and consider approval of a partial
demolition application, which the property owner supports, to be an appropriate
alternative to demolition.
(7) The proposed designation would generally be in the public interest.
Analysis
Staff considers that preserving the north façade and a 6 ft portion of the west and east
walls would retain the historically significant portion of the building and result in its
incorporation into redevelopment of the property and would generally be in the public
interest.
BOARD OPTIONS
1. DO NOT INITIATE LANDMARK DESIGNATION
The Landmarks Board may make a motion to not initiate landmark designation, in which case
the stay of demolition will continue until Nov. 8, 2023. If the Landmarks Board allows the stay
of demolition to expire, the city manager will approve the partial demolition application after
Nov 8, 2023.
As a condition of approval, prior to approval of the demolition application, the applicant shall
submit to staff for review, approval, and recording with the Carnegie Library for Local History:
1. A site plan showing the location of all existing improvements on the subject property;
2. Measured elevation drawings of all exterior elevations of the building depicting existing
conditions, fully annotated with architectural details and materials indicated on the
plans; and
3. High resolution and professional quality digital color images of all exterior elevations.
2. INITIATE DESIGNATION OF THE PROPERTY AS AN INDIVIDUAL LANDMARK BY ADOPTING
THE RESOLUTION UNDER ATTACHMENT A.
If the Board chooses to initiate the process for reviewing the designation, it must do so by
resolution. A draft resolution is included in Attachment A: Draft Resolution. If initiated, the
application will be scheduled for a public hearing before the Landmarks Board between 60 to
120 days in order to determine whether the proposed designation conforms with the purposes

and standards in Sections 9-11-1 Legislative Intent and 9-11-2 City Council May Designate
Landmarks and Historic Districts B.R.C. 1981. The owner must obtain a Landmark Alteration
Certificate prior to the submission of building permit applications for the property if they
choose to proceed while the application is pending, or they may choose to wait until the
application process is complete.
3. APPROVE THE PARTIAL DEMOLITION APPLICATION.
The Landmarks Board may make a motion to issue a partial demolition approval, based on the
proposal submitted (Attachment C) pursuant to Section 9-11-23 B.R.C, 1981. The demolition
approval is valid for 180 days and cannot be extended. If the scope of demolition changes, a
new application would be required.

RESOLUTION NO. _______
A RESOLUTION OF THE LANDMARKS BOARD INITIATING THE DESIGNATION OF 1741 WALNUT ST.,
BOULDER, COLORADO AS AN INDIVIDUAL LANDMARK.
WHEREAS, on May 3, 2023, the Landmarks Board voted to schedule an initiation hearing for 1741 Walnut
St.; and
WHEREAS, on Aug. 9, 2023, the Applicant and the City entered into a Tolling Agreement to extend the
Stay of Demolition until Nov. 8, 2023; and
WHEREAS, on Nov. 1, 2023, the Landmarks Board held an initiation hearing to determine whether to
initiate designation of the property at 1741 Walnut St. and determined that the property meets the standards for
initiation;
NOW, THEREFORE, BE IT RESOLVED BY THE LANDMARKS BOARD OF THE CITY OF BOULDER,
COLORADO:
The City of Boulder Landmarks Board hereby initiates the designation of 1741 Walnut St. as an individual
landmark and will schedule a designation hearing in accordance with the historic preservation ordinance no fewer than
sixty days and no greater than one hundred-twenty days from the date of this resolution.
ADOPTED this 1st day of November 2023.

TOLLING AGREEMENT
1741 Walnut Group, LLC, a Colorado limited liability company("Owner"), and the City
of Boulder, a Colorado home rule municipality("City"), hereby enter into this Tolling
Agreement regarding Owner's demolition permit application, number HIS2023-00307 (the
Application"). The City and Owner may be referred to singly as a"Party" or collectively as the
Parties."
RECITALS
A. Owner is the owner of 1741 Walnut St, Boulder, Colorado.
B. Subsection 9-11-23(g), Boulder Revised Code 1981, allows the Board to place a 180-
day stay on the issuance of the demolition permit if it finds that the building proposed
for demolition may have historical significance under the criteria set forth in subsection
9-11-23(f) and that the stay begins on the date a complete demolition permit application
is accepted by the City Manager.
C. Subsection 9-11-23(h)provides that if individual landmark designation has not been
initiated during the stay, the city manager shall issue a permit if all other requirements
of the permit process have been met.
D. The City received and accepted the Application on December 16, 2022.
E. On March 1, 2023, the City of Boulder Landmarks Board(the "Board")held a hearing
pursuant to section 9-11-23(f) and imposed a stay of demolition (the "Stay")pursuant
to section 9-11-23(g), Boulder Revised Code1981.
F. On May 3, 2023, the Board voted to schedule a hearing to consider initiation of
landmark designation or approval of a demolition request ("Initiation Hearing"). The
Initiation Hearing is currently scheduled, due to a prior tolling arrangement, for
September 6, 2023.
G. However, to provide time for the Owner to consider alternatives, including the revision
of the application to propose partial demolition, Owner has requested that the
Landmarks Board extend the Stay so that the Initiation Hearing can take place at the
Board meeting scheduled for November 1, 2023.
H. Given the acceptance date of December 16, 2022 and the prior tolling agreement,
without this Tolling Agreement, the Stay for this Application would terminate on
September 13 2023, and the city manager would issue a permit if individual landmark

designation had not been initiated during the Stay and all other requirements of the
permit process had been met.
AGREEMENT
1. Based on these understandings and acknowledgements and the Applicant's
request to schedule the Initiation Hearing for the regular meeting of the Board of July 12
and a tolling agreement rescheduling the Initiation Hearing for September 6, 2023, the
Parties agree that the 180-day period of the Stay shall be tolled from September 13, 2023,
until November 8, 2023. Taking into account this tolling, the Parties agree that the Stay
shall expire on November 8, 2023.
2.The City agrees to reschedule the Initiation Hearing to November 1, 2023 and
Owner agrees to accept this scheduling subject to the tolling described in this agreement.
Owner agrees to waive any claim that the Stay expires prior to November 1, 2023 and fully
accepts that the stay shall not expire until November 8, 2023.
3.The Parties agree that the mutual promises in this Tolling Agreement constitute
good and valuable consideration.
4.Owner agrees not raise any claims as to the invalidity or unenforceability of all or
any part of this Tolling Agreement.
5.The undersigned representatives of Owner certify that they are fully authorized to
enter into this Tolling Agreement and to legally bind Owner to all terms and conditions.
This Tolling Agreement shall be binding upon each Parry and its successors.

Background
application process
•Applicant filed a full demolition permit application on December 16, 2022,
after having commissioned independent analysis by Tatanka Historical
Associates which concluded 1741 Walnut does not meet any city, state, or
national criteria for significance.
•The full demolition permit application was referred to the Landmarks Board
for consideration, who met on May 1, 2023 and placed a stay of demolition
that was extended via a tolling agreement and expires November 8, 2023.
•Landmarks Board members and staff conveyed support for preserving the
front (alley facing) facade, noting its architectural attributes and historical
use.
•In an effort to incorporate input provided through this process, applicant
has revised their plans and is applying to permit a partial demolition that
preserves the front (alley) facade.
