HomeMy WebLinkAbout1328 - CONCERNING THE EXPANSION OF PROPERTY BOUNDARIES OF THE UNIVERSITY HILL GENERAL IMPROVEMENT DISTRICT TO INCLUDE 1155 PLEASANT STREET, BOULDER, COLORADO 80302; AND SETTING FORTH RELATED DETAILS1 RESOLUTION 1328 A RESOLUTION CONCERNING THE EXPANSION OF PROPERTY BOUNDARIES OF THE UNIVERSITY HILL GENERAL IMPROVEMENT DISTRICT TO INCLUDE 1155 PLEASANT STREET, BOULDER, COLORADO 80302; AND SETTING FORTH RELATED DETAILS A.WHEREAS, Hill Hotel Owner, LLC filed a Petition for Inclusion of the property located at 1155 Pleasant Street, Boulder, Colorado, 80302 (the “Property”), into the boundaries of the University Hill General Improvement District (“UHGID”); and B.WHEREAS, the Property is adjacent to the boundaries of UHGID; and C.WHEREAS, consideration of the Petition for Inclusion is governed by Sections 2-3-20, “University Hill Commercial Area Management Commission,” and 8-4-24, “Inclusion and Exclusion of Additional Property in District,” B.R.C. 1981; and D.WHEREAS, the University Hill Commercial Area Management Commission (the “Commission”) has reviewed the Petition for Inclusion submitted by Hill Hotel Owners, LLC and held a public hearing on March 7th, after notice thereof was published in a newspaper of general circulation with the city of Boulder and mailed to all of the property owners and each elector of the district within the boundaries of UHGID. The Commission moved to recommend that the Property be included within the UHGID boundaries based on the following requirements: 1.The Petition for Inclusion submitted is consistent with the requirements of the Boulder Revised Code; and 2.It is in the best interest of UHGID to have the Property included within its boundaries because: a.the evidence shows that inclusion does confer a general benefit for the ease of assessment and taxation of the Hill Hotel development of which the Property is a part; b.the evidence shows that inclusion would result in benefits to UHGID in kind or extent from any benefits accruing from the city as a whole; and c.the evidence shows that any special terms and conditions in the Petition are reasonable. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO, ACTING AS THE BOARD OF DIRECTORS FOR THE UNIVERSITY HILL COMMERICAL AREA MANAGEMENT COMMISSION THAT: Section 1. The Board of Directors, based on the evidence presented in the Petition for Inclusion and at the public hearing, finds and determines that: A.The Petition for Inclusion submitted is consistent with the requirements of the Boulder Revised Code; and B.It is in the best interest of UHGID to have the Property included within its boundaries because: i.the evidence shows that inclusion does confer a general benefit for the ease of assessment and taxation of the Hill Hotel development of which the Property is a part; ii.the evidence shows that inclusion would result in benefits to UHGID in kind or extent from any benefits accruing from the city as a whole; and iii.the evidence shows that any special terms and conditions in the Petition are reasonable. The Petition for Inclusion of the Property into the boundaries of UHGID is Section 2. granted. Section 3. This Resolution shall take effect upon adoption unless the Petition for Inclusion is denied and subsequently called-up by the Boulder City Council on _____________________.
