A RESOLUTION ESTABLISHING THE BOULDER PUBLIC
LIBRARY DISTRICT, APPOINTING TWO MEMBERS OF
CITY COUNCIL TO A COMMITTEE TO APPOINT THE
INITIAL BOARD OF TRUSTEES OF THE DISTRICT, AND
AUTHORIZING THE CHIEF OF STAFF TO THE BOARD OF
COUNTY COMMISSIONERS OF BOULDER COUNTY TO
NOTIFY THE BOARD OF COUNTY COMMISSIONERS OF
THE DISTRICT’S INITIAL CERTIFICATION OF THE MILL
LEVY APPROVED BY THE ELECTORS; AND SETTING
FORTH RELATED DETAILS
THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO, FINDS AND
RECITES THAT:
A. On November 8, 2022, the electors approved a citizen petition to form and fund
the Boulder Public Library District (“District”) pursuant to Sections 24-90-101 to 606, C.R.S.
(“Library Law”).
B. Section 24-90-107(3)(a) of the Library Law requires that a petition to establish a
library district contain a request for the establishment of the district and the names of the
governmental units establishing the district.
C. The petition that was submitted to place the establishment of the District on the
November 8, 2022 ballot identified Boulder County and the City of Boulder as the establishing
governmental units.
D. Section 24-90-107(3)(g) of the Library Law states that if a majority of the electors
vote in favor of the establishment of a library district, the legislative bodies of each establishing
governmental unit shall forthwith establish such library district and provide for its financial
support by January 1 of the year following the election.
E. Section 24-90-108(2) of the Library Law further requires the establishing
governmental units to appoint two of their members to a committee that shall appoint the initial
board of trustees.
F. City Council wishes to appoint council members Aaron Brockett and Nicole
Speer to such committee.
G. The electors approved funding for the District through an ad valorem property tax
mill levy at a rate of 3.5 mills.
H. Section 29-5-128(1), C.R.S., requires that taxing entities must certify the levy for
the entity to the Board of County Commissioners by December 15 of each year.
I. City Council wishes to authorize the Chief of Staff to the Board of County
Commissioners to notify the Board of County Commissioners of the initial certification of the
mill levy approved by the electors, in satisfaction of the city’s obligation to provide for the
financial support for the District by January 1 of the year following the election as required by
Section 24-90-107(3)(g) of the Library Law.
BASED ON THE FINDINGS MADE IN THIS RESOLUTION, ABOVE, BE IT
RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO,
THAT:
1. Pursuant to the requirements of the Library Law, the city, in cooperation with
Boulder County, hereby establishes the Boulder Public Library District as directed by the
electors; provided, however, that such action is contingent upon the Board of County
Commissioners of Boulder County taking similar action.
2. Council members Aaron Brockett and Nicole Speer are hereby appointed to
represent the city on the committee that shall appoint the initial board of trustees for the Boulder
Public Library District.
3. Council authorizes the Chief of Staff to the Board of County Commissioners of
Boulder County to provide written notification of the initial certification of the mill levy
approved by the electors to the Board of County Commissioners.
