Agenda Item: i. Instructions for Virtual Hearing; Raymond Jefferson, Licensing Specialist, provided instructions to the BLA members, city staff, and hearing participants on how to participate during the virtual hearing. ii. Member Roll Call; Authority member roll call was completed with a quorum of 3 members (Carr, Califano and Wallace) present. The Authority was informed that board member, Michael Absalom, would be absent for this hearing. Member Califano would then be the Acting Chair for this meeting. The members were also advised that all actions would require a unanimous vote to pass as the board is at the minimum quorum of 3. iii. Election of Chair and Vice-Chair Ms. Cook informed the BLA that City Council appointed Leah Roberts as the fifth BLA member during their June 14, 2022 meeting. It was stated that BLA Vice Chair Absalom is expected to be in attendance at the BLA’s July 20, 2022 BLA hearing and Ms. Roberts was expected to be sworn in as a new BLA member at that time. Member Califano moved, Carr seconded, to continue the board election item to the July 20, 2022 hearing. Motion approved 3:0. iv. Approval of Beverage Licensing Authority (BLA) minutes from April 20, 2022 Member Wallace moved, Carr seconded, to approve the minutes from April 20, 2022 hearing. Minutes approved 3:0. Minutes approved 3:0 v. Hearing agenda issues from Licensing Clerk; Mishawn Cook noted that it was not expected that the BLA would convene Agenda item 11, Rayback Collective, as no comments were received for its’ modification application for a Father’s Day event. City Licensing was still awaiting return of 10 day posting affidavit. 2. Matters from the Boulder Police Department (BPD). Officer Rich Denig presented no matters. Member Wallace questioned Officer Denig concerning digital ID acceptance. Officer Denig explained that although the digital ID is accepted, that is still the responsibility of customers to carry and present, if requested, the physical ID issued by the State of Colorado and that out of state digital ID’s are not accepted. 3. Matters from the Responsible Association of Retailers (RAR). Nathan Dewey with RAR appeared and spoke concerning TIPs training returning to pre COVID levels. He also reported that RAR meetings are not being attended by members as regularly. He attributed this to staffing issues. He informed the BLA that he would skip the June 2022 meeting and resume in July. It was also mentioned that he would be conducting fake ID training with Officer Denig and Mr. Dewey noted the new addition of a new RAR member, Bluff Street Bar and Billiards. He also stated that he has been contacted by the new manager at Torchy’s Tacos and would provide further information to the BLA if requested. In response to the question of digital ID acceptance asked of Officer Denig, he replied that the membership is aware of the digital ID requirements and this issue is covered in his server training. 4. General Public Comments for Future Beverage Licensing Authority Hearings. No members of the public came forward to supply general public comments to the BLA. 5. Public hearing and continued consideration of an application filed on February 4, 2022, from Boulder’s Tavern, LLC d/b/a Bluff Street Bar and Billiards,2690 28th Street, Unit E, Boulder, CO 80301-1254; Richard Weiman, Managing Member, Robert Ware, and Jose Emmanuelli Members, with a premise business mailing address, for a renewal of a Tavern type liquor license David Wunderlich, Esq. appeared as the licensee’s attorney, and he waived procedures reading on behalf of his client. Acting Chair Califano inquired if there were any ex-parte BLA 6/15/2022 Draft Minutes Page 3 of 9 communications or conflicts of interest for the Authority members and none were disclosed. No public comment was given, and other interested parties appeared for this matter. Mr. Richard Weiman, owner, and Mr. Brooks Ficket, manager of security, were sworn in with Mr. Weinman confirming the required 10 day posting requirement. Mr. Wunderlich opened with a statement outlining his clients meeting with Officer Rich Denig, City Alcohol Enforcement Officer and implementing changes to the operation of his establishment and the joining of the RAR. Mr. Weinman, owner, testified confirming his ownership, along with other co-owners and describing his general cliental of his establishment, nature of his business and operating hours, and his current staff (bartenders and security staff). When questioned about his delay in his renewal filing, he stated that it was in part due to his being unable to access the required site due to the system issues with safari brower. Mr. Weiman was questioned concerning the updated alcohol policy. He further summarized his meeting with Officer Denig and Officer Denig’s concerns with the bar’s operations to include better lighting and addressing responsible serving of patrons. Member Carr asked Mr. Weiman to address on the other issues surrounding his renewal application, such as the untimely filing of registered manager changes. Ms. Cook then spoke and advised that she was in receipt of the manager change and that sales tax would at this time approve this renewal, but the lease expiration date was omitted of the state renewal, although if Mr. Weiman could supply the date and agree that she may add it, she would do so. Mr. Brooks Ficket was called to testify, and he explained his involvement with bar security as a bouncer, his length of employment and his employment role. When questioned about how often he experiences issues at the bar he stated “only twice a month” on average, but clarified that was a difficult question to answer due to the varying number of patrons especially for sports season i.e. CU games. When questioned concerning any specialized experience, Mr. Ficket replied that he has worked at various bars in the same capacity for 30 years With no further questions of Mr. Ficket, City Assistant Attorney Witt stated that under BLA rules that Officer Denig could ask witnesses questions concerning the issues raised during questioning. Officer Denig declined but stated that he would later have a statement to provide to the Authority. Member Wallace asked about the number of patrons on an average night, frequency of events, and the reason that the previous manager left. Mr. Weiman replied that. Jose Emmanuelli was the previous manager but clarified that he has not left the bar ownership structure, just his day-to-day operations role, and that Robert Ware was the original registered manager. Mr. Weiman did note that Mr. Ware is no longer an owner, but the required registered manager change was not filed at the time of his departure in May of 2020. Member Carr asked about security at closing and the possible addition of outside lighting. BLA 6/15/2022 Draft Minutes Page 4 of 9 Mr. Ficket replied that often individuals wait outside for rides before leaving the bar and that the addition of more lighting is an expense that could not be absorbed due to the age of the property, noting that the alley is not part of the licensed premises, and the bar has is to ask those gathering there to disperse. With no further questions from the BLA members, Acting Chair Califano invited Officer Denig to make his statement. Officer Denig noted that with Bluff Street Bar he detected a pattern of calls that pointed to behavior issues, lack of security and alcohol over service at this establishment that resulted in the number of calls. He used April 2021 to March 2022 as the original date range used to provide his findings, with additional data provided from April2022 to June 2022 specifically for this hearing, and the subsequent data showed a total of 49 calls were received with 25 of those being of concern. Officer Denig advised the BLA that nothing submitted to the BLA was in his own words but were from actual police reports. Officer Denig further stated that during his meeting with Mr. Weiman that he discussed the culture of his bar and how it influences calls for service. In his opinion, the lack of policies and enforcement was a major issue of concern. Several recommendations were made during his meeting one of which was the wearing of clothing by security to identify them as employees and enhanced lighting. The patio area was also identified as a major concern with many calls involving its use and Mr. Weiman’s consumption of alcohol while operating the bar was noted. Officer Denig acknowledged that this is not a college bar and with the right policies and management in place that the bar could and would improve, but that there was a need for better control of the patio, suggesting the addition of railings. The challenge of determining when a person is intoxicated was also mentioned, but Officer Denig stated that his goal is to have the number of calls for service decrease at this location. Member Carr recapped Officer Denig recommendations as increasing security, better lighting, better oversight of the patio and better monitoring of the rear entrance. Officer Dening confirmed that was correct and added that the physical condition of an establishment can also lend cause to the way a place is treated, noting that bar operations may not change overnight, but that further calls could result in an affidavit filed with city prosecutors for a show cause for conduct of the establishment initiated. Member Wallace stated physical conditions can set the tone, but that the business culture was the most important part. Officer Denig responded by stating that he agreed that there needs to be a culture change, and that since his meeting with Mr. Weiman, there have been a decrease in calls. Member Carr asked if people identified in BPD reports were intoxicated, and Officer Denig replied that no investigation was initiated to make this determination, but that it would be difficult to determine after the fact. Assistant City Attorney Witt asked if Mr. Weiman registered manager change and any ownership change was reported as required within 30 days of the change. Mr. Weiman replied that he was assumed that his attorney at the time had submitted this change. Ms. BLA 6/15/2022 Draft Minutes Page 5 of 9 Witt requested, and Mr. Weiman agreed to submit this change to City Licensing. Mr. Wunderlich then asked to question Officer Denig concerning the statements he had made. Officer Denig was asked if her thought that his client was receptive of his suggestions made during their meeting, and Officer Denig replied that he thought so. He then asked if he had reviewed the new alcohol service plan submitted to the BLA to which Officer Denig replied he had not. He asked if Officer Denig’s opinion would change if the changes testified to were put into practice and enforced, and Officer Denig replied that often alcohol policies are well written, noting that the BLA has made comments for improvements today, but the implementation needed to be fully made, along with the change of culture. Mr. Wunderlich then asked about the calls for service logs that were submitted asking if the 49 calls having the notation “ CB Clear” to explain what that means, and Officer Denig replied that this meant that the responding officer did not find a need to file a report. Prior to discussion City Attorney Witt provided the different options available to the BLA concerning the renewal of this applicant’s license. Member Carr voiced his concerns and stated that he would like to see stipulations if the license was to be approved for license renewal, with Members Califano and Wallace in agreement. Acting Chair Califano made the motion to approve this renewal with the city condition of a non-administrative renewal in 2023. Member Carr suggested an addition to the motion which Califano accepted that that the applicant should provide an update on progress to the BLA mid-renewal term. Member Carr then seconded the motion. Motion to approve this renewal with these city conditions approved 3:0. After the vote Officer Denig addressed the Authority stating that he would conduct regular site visits to this location to monitor activities, provide feedback concerning progress of necessary changes, and to assess whether new policies were being enforced, and if not, would then pursue an affidavit for a show cause hearing if warranted. The BLA agreed and requested updates from him monthly. Ms. Cook added that if any BPD comments or issues were reported that they would be included in the November packet. 6. Public hearing and consideration of an application filed on April 7, 2022, from SREIT Boulder Opco, LLC, d/b/a Hyatt Place Boulder,2280 Junction Place, Boulder, CO 80301, SREIT HP Boulder Opco, LLC, Licensee LLC with Ruby Huang as Officer and Senior Vice President, SREIT TRS HotelCo, LLC as 100% 1st underlying Owner with John McCarthy as CEO, SREIT TRS MasterCO, LLC as 100% 2nd underlying owner with John McCarthy as CEO, Starwood REIT Operating Partnership LP as 100% 3rd underlying owner also with John McCarthy as CEO, and with Starwood Real Estate Income Trust as 100% 4th underlying owner which is publicly held and traded, and no other owners with over a 10% interest, John McCarthy as CEO, President, and Director, Christopher Graham as Director, Mark Deason as Director, and Barry Sternlicht as Director, and with Highgate Hotels LP, as Management Company with Paul Ray Womble, VP of Highgate Hotels Ops, and Edward Winslow Martin III, VP of Highgate Hotels Ops, with Monica Pitt, Registered Manager, and with a premise business mailing address. for renewal of Hotel-Restaurant liquor license Mr. Nick Griess, General Manger, appeared without legal representation. Mr. Griess was sworn in confirming the 10-day posting requirement completed. Acting Chair read rules of procedure. No public comment was given, and other interested parties appeared for this matter. Mr. Griess provided testimony about this late filed renewal. The BLA was advised that due to staffing changes this renewal was not timely submitted. Member Wallace spoke of his knowledge of this location and that he personally had spoken with the then GM concerning the issue of a non-operational kitchen. Mr. Griess stated that he has only been the current GM since February and that several issues have been discovered since his arrival to include kitchen operations and the need of TIPs training with no cards being provided at the time of renewal. Mr. Griess agreed to complete TIPs training of staff, as well as cease all liquor sales until the kitchen is fully operational and able to resume food sales in accordance with this liquor license type. Member Wallace moved to continue this matter until the July 20, 2022 hearing, seconded by Califano, with the stated condition that no liquor sales would take place until the continued hearing. Motion approved 3:0 to continue matter. 7. Public hearing and consideration of a application filed on April 7, 2022, from Dillion Companies LLC d/b/a King Soopers 33, 3600 Table Mesa Drive, Boulder CO 80305: Kroger Co. as 100% Owner, and with Steven J. Dreher as President, Thomas J. Sullivan as Vice President, Christine R. Wheatley as Director/VP/ Secretary, Carin L. Fike as VP and Treas, Phillip B. Nelson as VP, and with Tony Woodward as Store Manager; with a business mailing address of P.O. Box 305103, Nashville, TN 37230, for a renewal of a Fermented Malt Beverage Off- Premise type liquor license. Adam Stapen, Esq. appeared as the licensee’s attorney, and he waived procedures reading on behalf of his client. Acting Chair Califano inquired if there were any ex-parte communications or conflicts of interest for the Authority members and none were disclosed. No public comment was given, and other interested parties appeared for this matter. Store Manager, Sheri Bosman, was sworn in and confirm required 10 day posting and supplied testimony about this late filed renewal. Mishawn Cook noted for the BLA that at this time City sales Tax would also not approve this renewal. Mr. Stapen stated that he was unaware of this outstanding issue. Because events at this location and its’ reopening, a continuance was requested by Mr. Stapen. Member Califano moved, Carr seconded, to continue this matter until the July 20, 2022 hearing. Motion approved 3:0 to continue item. 8. Public hearing and consideration of an application filed on April 27, 2022, from Tiffin Wallah Inc d/b/a Tiffins India Cafe, 2416 Arapahoe Ave, Unit 320, Boulder, CO 80302; Rajeev Thapa, President and Owner, Lama Sandeep, Vice President and Owner and Rabi Gurung, Secretary and Owner, with a premise business mailing address, for a renewal of a Hotel-Restaurant type liquor license. BLA 6/15/2022 Draft Minutes Page 7 of 9 Rajeev Thapa, President, and Rabi Gurung, Secretary, appeared without legal representation. Acting Chair read rules of procedure for this matter. Acting Chair Califano then inquired if there were any ex-parte communications or conflicts of interest for the Authority members and none were disclosed. No public comment was given, and no other interested parties appeared for this matter. Both Messrs. Thapa and Gurung, were sworn in, with Mr. Thapa confirming the 10-day posting requirement completed. Mr. Thapa supplied testimony about this late filed renewal. BLA was advised that no TIPs cards were being provided at the time of renewal. Mr. Thapa agreed to mail cards to City Licensing because staff had been trained. Member Wallace moved, Carr seconded, to approve this license renewal application. Motion approved 3:0. 9. Public hearing and consideration of an application filed on April 12, 2021, from Coco, Inc d/b/a Doug’s Diner, 2574 Baseline Road, Boulder, CO 80305; Rickey Bruening, President and Treasurer, Ermalinda Hernandez, Vice President and Secretary, Matthew Prentiss, Proposed Registered Manageress with a business mailing address of 131 Hunters Cove Road. Mead, CO 80542, for a New Hotel-Restaurant type liquor license Adam Stapen, Esq. appeared as the licensee’s attorney, and he waived procedures reading on behalf of his client. Ricky Bruening, Owner, and Sylvie Cimino of Liquor Pros petitioning, were sworn in, and Mr. Bruening confirm required 10 day posting and supplied testimony about this new license application. Acting Chair Califano inquired if there were any ex-parte communications or conflicts of interest for the Authority members and none were disclosed. No public comment was given, and other interested parties appeared for this matter. Mr. Bruening testified concerning his liquor service experience and his business model. Member Califano suggested he join the RAR and about the benefits of membership. Member Wallace moved, Carr seconded, to approve this new liquor license application. Motion approved 3:0. 10. Public hearing and consideration of an application filed on on April 15, 2022, from Barchetta d/b/a Barchetta, 1644 Walnut Street, Boulder, CO 80302; Jesse Jensen 45% owner and Sydney Miller 45% owner with no others holding more than a 10% ownership, with a premise business mailing address, for a Permanent Modification of Hotel-Restaurant type liquor license Mr. Jesse Jensen, Co-owner, and Mr. Tim Miller, Co-owner, and Sylvie Cimino of Liquor Pros Petition were all sworn in. Temporary Modification Outdoor Dining Pilot Program Update Mishawn Cook spoke concerning the 2nd reading at City Council of the 5-year pilot program and referred to a provided cover letter and attachments sent to the Authority on May 16, 2022 for this upcoming expected pilot program for the outdoor dining program. Ms. Cook also supplied an update of the city’s COVID 19 situation. b. Virtual and In-Person Meeting Update Mishawn Cook noted that the City of Boulder will continue with virtual meetings at the direction of City Council. c. Neighborhood boundary setting for applications for July 20, 2022, BLA hearing The following neighborhood boundaries were discussed: i. The Waffle Lab Boulder LLC d/b/a The Waffle Lab for a New Hotel-Restaurant type liquor license application at 1155 13th Street, Boulder CO 80302 City staff suggested neighborhood boundaries set for the December of 2021 application for Sherry’s Soda Shoppe as follows: Marine St. Ext on North, Columbine Ave Ext on South, Folsom to Colo to 28th on East, 6th Street on the West. Member Wallace moved, Carr seconded, to set the boundaries for this application as above listed. Motion approved 3:0. d. Roe Shrestha, Manager, was sworn in and confirmed the 10 day legal posting. Dinesh Shrestha and Dhirendra Shrestha were also sworn in. Ms. Kellogg informed the authority that sales tax and occupation tax would approve the renewal, however, no training documents were submitted with the renewal. Member Absalom read the hearing procedures. No ex-parte communications or conflicts of interest were disclosed by the members. No public comment was given, and no interested parties supplied testimony. Roe Shrestha testified that the business missed the application deadline accidently due to a number of reasons. Member Wallace asked if employees have proper training and Roe Shrestha stated that evidence of training was submitted with the renewal. Ms. Cook clarified that no evidence of training was submitted. The Authority and Ms. Cook clarified what is acceptable training per the BLA rules. Roe Shrestha confirmed that the employees do not have sufficient training at this time. Member Carr added that the business should also have sufficient alcohol sales policies and Roe Shrestha confirmed that the business does not have that on hand. Incident Report Form – Page 17-18 2 DDS Liquor & Food Mart Policy We recognize that it is a privilege to buy and sell alcoholic beverages in the State of Colorado and with that privilege, realizes that it is our legal and social responsibility to comply with all Colorado laws, rules and regulations and follow best practices as they pertain to the service of alcoholic beverages. We are committed to the safe and responsible sale of all alcoholic beverages to only those patrons who are 21 years of age and older and to refuse service of alcoholic beverages to those individuals that are visibly intoxicated or, in those cases where we deem necessary to prevent a person from being visibly intoxicated. In order to achieve these goals, we have adopted the following policies: General 1. All new employees will review, with a member of management, the laws, rules, and regulations and best practices as described in the mission statement prior to making any sale of liquor. Once trained, all employees will regularly review those laws, regulations and best practices with a member of management, asking for clarification on topics they don't understand and upon completion of the review, sign off that they understand and will comply with all of the premise policies governing the sale of liquor. We Set the following opinions and policies to be followed by all employees/agents/volunteers. • Recognize that we should strive to be a leader in our community regarding community safety and welfare. • We will strive to be a vibrant business presence in our community. • Agree that over service of alcohol, serving visibly intoxicated persons, and any alcohol service to a person under 21, is not only illegal but creates a negative experience for our guests; as well as casting our order in a negative light to the community we wish to serve. 1. Employees shall comply with all the Colorado Liquor Laws and Rules and Regulations governing the sale of alcoholic beverages. 2. When an employee is carding an individual, they will always observe the patron retrieving their ID from the wallet and noting fine motor skills. 3. A manager or their designee will make regular rounds, interacting with patrons assessing sobriety and when appropriate, re-check identification of youthful patrons possessing or consuming alcohol. Carding Practices 1. Colorado Law requires a licensee or licensee's employee or agent may not sell, furnish, give or deliver liquor to a person under 21 years of age unless the licensee or licensee's employee or agent verifies that the person is not a minor by means of reliable photographic identification containing that person's date of 2. An employee must ask for reliable identification from anyone under 21 years of age every time they enter the establishment to purchase alcohol. 3. Our policy is to card anyone that orders liquor, beer or wine in order to comply with Colorado law. 4. The Employee will ask for current, reliable and verifiable pictured identification containing the patron's date of birth. (Acceptable forms of ID are: a) any state drivers' license or state non-drivers identification card b) a passport issued by a state or federal government agency c) Military ID card d) Alien registration card e) Valid Employment Card w/Photo and DOB issued by the Department of Homeland Security). All out of state driver's licenses or 3 identification cards will be verified with the drivers license guide. If the patron appears to be under 21 years of age, the employee will ask for secondary form of identification, such as military ID, passport, credit/debit card etc. 5. The employee will request that the patron remove their ID from their wallet and take physical control of the identification, checking the back and front for signs of forgery such as: Poor photo quality, blurred imagery, or digitized lettering. Disclaimers like 'non-government ID' or 'nontransferable ID card' Statements of authenticity such as 'Genuine', 'Authentic', 'Secure', etc. 6. The employee will verify that the information and picture on the identification match the person presenting it, paying special attention to the date of birth in order to confirm that the individual is old enough to purchase and that the DOB has not been altered (are the numbers the same size, color, evenly spaced and level with one another?). 7. Business policy that an employee will not accept an expired identification card. 8. In the event any patron fails to show proper identification or if there is doubt by the employee of the validity of an ID, the sale will be refused. All refusals for failure to meet the requirements of the identification policy are final. 9. When a patron displays an identification card that is obviously false, the employee will refuse entrance/sale of liquor, beer or wine and report it to a manager who will explain to the patron that they are going to retain the identification for the purpose of verifying their age. A premise representative will call the police and surrender the identification to the authorities for that purpose. 10. No consumption of alcohol or smoking by on duty employees will be tolerated 11. Any incident regarding alcohol service will be immediately be logged into the “incident log” 12. Any incident involving bodily harm / Physical injury / will be documented on an official incident report form and be signed by witnesses. Photos must be taken ASAP. Offer to call 911 for the individual injured. If the individual injured refuses treatment they must sign a waiver or 911 will be called regardless of their wishes. 13. Any incident involving an act of violence, or other illegal activity will be reported to the Police department immediately. 14. Any purchased items by the customers after it is picked up from the counter, will not be refunded by out store. 15. No customer is allowed to use, eat, drink or take away any items of the store, inside or outside before purchasing an item. 16. No customer/person is allowed to be outside of the store premises and consume alcohol. 4 Visibly Intoxicated Individuals 17. No licensee shall sell to an intoxicated person or any one simulating intoxication any liquor wine or beer. When a wait staff discovers a visibly intoxicated individual in the premise, they will notify the manager/security staff/person in charge immediately & attempt to explain to the patron that they can no longer allow the individual to possess or consume alcohol. 18. If a visibly intoxicated person becomes argumentative, assaultive, disorderly, or in any way threatens the safety or wellbeing of the patrons, staff or the community, the manager will immediately call the police. 19. All incidents involving intoxicated patrons will be written down in a premise log, noting the date, time, names of employees involved and brief statement of facts regarding the incident. It will be the responsibility of the manager or supervising security/wait staff to log these incidents. 20. No over service! When a guest shows signs of visible intoxication service will be stopped in an appropriate, polite and discreet manner 21. Anyone who arrives visibly intoxicated will not be served! 5 Unlawful Removal of Alcohol From the Establishment • It is unlawful for a person who is licensed to sell alcohol beverages for consumption on the licensed premises to knowingly permit the removal of an alcohol beverage from the licensed premises. • The licensee shall not be charged with permitting the removal of an alcohol beverage from the licensed premises when the licensee has posted a sign at least ten inches wide and six inches high by each exit used by the public that contains the following notice in type that is at least one-half inch in height. 6 Warning DO NOT LEAVE THE PREMISES OF THIS ESTABLISHMENT WITH AN ALCOHOL BEVERAGE. IT IS ILLEGAL TO CONSUME AN ALCOHOL BEVERAGE IN A PUBLIC PLACE. A FINE OF UP TO $250 MAY BE IMPOSED BY THE COURTS FOR A VIOLATION OF THIS PROVISION. Colorado liquor code statute 12-47-901 sec.(9) 7 No Outside Liquor Permitted • Customers are NOT allowed to bring in their own liquor, beer, or wine. Colorado liquor code statutes 12-47 409 -417 Any outside liquor will be confiscated and disposed of. You may be asked to leave the property 8 Liquor Code for Take-Out and Delivery CO Liquor Code 44-3-911. Takeout and delivery of alcohol beverages - permit - on-premises consumption licenses - requirements and limitations - rules - definition - repeal. (1) (a) Notwithstanding any other provision of this article 3 or article 4 of this title 44 and subject to subsections (2) and (3) of this section: (I) Between the hours of 7 a.m. and 12 midnight, a licensee may sell and deliver an alcohol beverage to a customer for consumption off the licensed premises: and (II) If an alcohol beverage is part of a takeout order for consumption off the licensed premises: (A) A customer may remove the alcohol beverage from the licensed premises if the alcohol beverage is in a sealed container that complies with the rules of the state licensing authority; and (B) The licensee may allow a customer to remove the alcohol beverage from the licensed premises. (b) Subject to subsections (2) and (3) of this section, a licensee may sell or deliver alcohol beverages under this section by the drink. (2) To sell and deliver an alcohol beverage or to allow a customer to remove an alcohol beverage from the licensed premises as either is authorized under subsection (1) of this section, the licensee must: (a) Have any applicable permits issued under this section to sell alcohol beverages for takeout or delivery; except that this subsection (2)(a) does not apply if the governor has declared a disaster emergency under part 7 of article 33.5 of title 24; (b) Sell or deliver: (I) The alcohol beverage only to a customer who is twenty-one years of age or older; (II) The alcohol beverage in a sealed container that complies with the rules of the state licensing authority; and COLORADO LIQUOR CODE Page 104 of 107 (III) No more than the following amounts of alcohol beverages per delivery or takeout order unless the governor has declared a disaster emergency under part 7 of article 33.5 of title 24: (A) One thousand five hundred milliliters, approximately 50.8 fluid ounces, of vinous liquors; (B) One hundred forty-four fluid ounces, approximately four thousand two hundred fifty-nine milliliters, of malt liquors, fermented malt beverages, and hard cider; and (C) One liter, approximately 33.8 fluid ounces, of spirituous liquors. (c) Derive no more than fifty percent of its gross annual revenues from total sales of food and alcohol beverages from the sale of alcohol beverages through takeout orders and that the licensee delivers; except that: 9 (I) This subsection (2)(c) does not apply if the governor has declared a disaster emergency under part 7 of article 33.5 of title 24; or (II) This subsection (2)(c) does not apply to a sales room at a premises licensed under section 44-3-402 or 44-3-407; and (d) If an alcohol beverage is being delivered, use a delivery person who complies with subsection (3) of this section. (3) To deliver an alcohol beverage under this section, the delivery person must: (a) Deliver the alcohol beverage to a place that is not licensed under this article 3 or article 4 of this title 44; (b) Be an employee of the licensee who is twenty-one years of age or older; (c) Deliver an alcohol beverage only to a person who is twenty-one years of age or older; and (d) Have satisfactorily completed the server and seller training program established under section 44-3-1002. (4) (a) The state licensing authority shall promulgate rules: (I) Specifying the types of containers that may be used for takeout or delivery of an alcohol beverage under this section; (II) Creating a permit for takeout and delivery of alcohol beverages; (III) Setting fees for the processing and approval of a takeout or delivery permit application; and (IV) Concerning any other matter necessary for the safe and effective implementation of this section. (b) The state licensing authority shall issue a permit to a licensee to sell alcohol beverages for takeout and delivery if the licensee demonstrates the ability to comply with this section. A permit issued under this subsection (4)(b) is subject to the suspension and revocation provisions set forth in section 44-3- 601. (c) (I) The local licensing authority may create a permit for takeout and delivery of alcohol beverages to implement this section. If a local licensing authority does not create a permit under this subsection (4)(c), a licensee need not obtain a local permit to sell and deliver an alcohol beverage or to allow a customer to remove an alcohol beverage from the licensed premises. (II) A local licensing authority may establish fees for the processing and approval of a takeout or delivery permit application, but the amount of the fee must not exceed the amount of the fee set by the state licensing authority under subsection (4)(a)(III) of this section. (III) If a local licensing authority creates a takeout or delivery permit: COLORADO LIQUOR CODE Page 105 of 107 (A) The licensee must obtain the permit to sell and deliver an alcohol beverage or to allow a customer to remove an alcohol beverage from the licensed premises as either is authorized under subsection (1) of this section; and 10 (B) The local licensing authority shall issue a permit to a licensee to sell alcohol beverages for takeout and delivery if the licensee demonstrates the ability to comply with this section. (IV) A permit issued under this subsection (4)(c) is subject to the suspension and revocation provisions set forth in section 44-3-601. (V) A manufacturer licensed under section 44-3-402 that operates a sales room or a wholesaler licensed under section 44-3-407 that operates a sales room need not obtain a permit from the local licensing authority to sell and deliver an alcohol beverage or to allow a customer to remove an alcohol beverage from the licensed premises. (d) The licensee shall submit an application for a permit issued under this section to the state licensing authority and the local licensing authority, if applicable, simultaneously. Approval by either the state licensing authority or a local licensing authority does not guarantee approval by the other licensing authority. (5) For the purposes of this article 3 and article 4 of this title 44, an alcohol beverage that is sold and delivered to a customer's home for consumption off the licensed premises under this section is sold at the licensed premises. (6) (a) (I) This section authorizes a license holder that is issued a license under one of the following sections to sell an alcohol beverage to a customer for consumption off of the licensed premises: Section 44-3-402 that operates a sales room or section 44-3-407 that operates a sales room or section 44-3-411, 44-3-413, 44-3-414, 44-3-417, 44-3-418, 44-3-422, 44-3-426, 44-3- 428, 44-4-104 (1)(c)(I)(A), or 44-4-104 (1)(c)(III). (II) This section authorizes a license holder that is issued a license under one of the following sections to deliver an alcohol beverage to a customer for consumption off of the licensed premises: Section 44-3- 411, 44-3-412, 44-3-413, 44-3-414, 44-3-415, 44-3-416, 44-3- 417, 44-3-418, 44-3-419, 44-3-420, 44-3- 421, 44-3-422, 44-3-426, or 44-3-428. (III) This section authorizes a license holder that is issued a license under section 44-3- 402 and that operates a sales room or section 44-3-407 and that operates a sales room to deliver an alcohol beverage to a customer for consumption off of the licensed premises. This subsection (6)(a)(III) is repealed, effective January 2, 2022. (b) (I) This section does not apply to a person issued a license or permit that is not listed in subsection (6)(a) of this section or to a caterer who is licensed to sell alcohol beverages. (II) Subsection (2)(b)(III) of this section does not apply to: (A) A manufacturer licensed under section 44-3-402 that operates a sales room or a wholesaler licensed under section 44-3-407 that operates a sales room; and (B) The sale of an alcohol beverage manufactured by the licensee and sold by a brew pub licensed under section 44-3-417, a vintner's restaurant licensed under section 44-3-422, or a distillery pub licensed under section 44-3-426. (7) This section is repealed, effective July 1, 2025. 11 Liquor Code for Tastings COLORADO LIQUOR CODE Page 19 of 107 (10) (a) The provisions of this subsection (10) shall only apply within a county, city and county, or municipality if the governing body of the county, city and county, or municipality adopts an ordinance or resolution authorizing tastings pursuant to this subsection (10). The ordinance or resolution may provide for stricter limits than this subsection (10) on the number of tastings per year per licensee, the days on which tastings may occur, or the number of hours each tasting may last. (b) A retail liquor store or liquor-licensed drugstore licensee who wishes to conduct tastings may submit an application or application renewal to the local licensing authority. The local licensing authority may reject the application if the applicant fails to establish that he or she is able to conduct tastings without violating the provisions of this section or creating a public safety risk to the neighborhood. A local licensing authority may establish its own application procedure and may charge a reasonable application fee. (c) Tastings are subject to the following limitations: (I) Tastings shall be conducted only: (A) By a person who: Has completed a server training program that meets the standards established by the liquor enforcement division in the department and is a retail liquor store or liquor-licensed drugstore licensee, an employee of a retail liquor store or liquor-licensed drugstore licensee, or a representative, employee, or agent of the licensed wholesaler, brew pub, distillery pub, manufacturer, limited winery, importer, or vintner's restaurant promoting the alcohol beverages for the tasting; and (B) On a licensee's licensed premises. (II) The alcohol beverage used in tastings must be purchased through a licensed wholesaler, licensed brew pub, licensed distillery pub, or winery licensed pursuant to section 44- 3-403 at a cost that is not less than the laid-in cost of the alcohol beverage. (III) The size of an individual alcohol sample shall not exceed one ounce of malt or vinous liquor or one- half of one ounce of spirituous liquor. (IV) Tastings shall not exceed a total of five hours in duration per day, which need not be consecutive. (V) The licensee may conduct tastings only during the operating hours in which the licensee on whose premises the tastings occur is permitted to sell alcohol beverages, and in no case earlier than 11 a.m. or later than 9 p.m. (VI) The licensee shall prohibit patrons from leaving the licensed premises with an unconsumed sample. (VII) The licensee shall promptly remove all open and unconsumed alcohol beverage samples from the licensed premises, destroy the samples immediately following the completion of the tasting, or store any open containers of unconsumed alcohol beverages in a secure area outside the sales area of the licensed premises for use at a tasting conducted at a later time or date. 12 (VIII) The licensee shall not serve a person who is under twenty-one years of age or who is visibly intoxicated. (IX) The licensee shall not serve more than four individual samples to a patron during a tasting. (X) Alcohol samples shall be in open containers and shall be provided to a patron free of charge. (XI) The licensee may conduct tastings on no more than one hundred fifty-six days per year. COLORADO LIQUOR CODE Page 20 of 107 (XII) No manufacturer of spirituous or vinous liquors shall induce a licensee through free goods or financial or in-kind assistance to favor the manufacturer's products being sampled at a tasting. The retail liquor store or liquor-licensed drugstore licensee bears the financial and all other responsibility for a tasting conducted on its licensed premises. (d) A violation of a limitation specified in this subsection (10) by a retail liquor store or liquor-licensed drugstore licensee, whether by the licensee's employees, agents, or otherwise or by a representative, employee, or agent of the licensed wholesaler, brew pub, distillery pub, manufacturer, limited winery, importer, or vintner's restaurant that promoted the alcohol beverages for the tasting, is the responsibility of, and section 44-3-801 applies to, the retail liquor store or liquor-licensed drugstore licensee that conducted the tasting. (e) A retail liquor store or liquor-licensed drugstore licensee conducting a tasting shall be subject to the same revocation, suspension, and enforcement provisions as otherwise apply to the licensee. (f) Nothing in this subsection (10) shall affect the ability of a Colorado winery licensed pursuant to section 44-3-402 or 44-3-403 to conduct a tasting pursuant to the authority of section 44-3-402 (2) or 44-3-403 (2)(e). 14 Affirmative Defense • It shall be an affirmative defense to any administrative action brought against a licensee for alleged sale to a minor: • If the minor presented fraudulent identification of the type accepted in the State of Colorado • The licensee possessed an identification book issued within the past three years, which contained a sample of the specific kind of identification presented for compliance purposes. • As an affirmative defense, the burden of proof is on the licensee to establish by a preponderance of the evidence that the minor presented fraudulent identification. 15 16 Need Help? Providing a safe place includes ensuring people under the age of 21 do not purchase alcohol. All employees at BOULDER GS, LLC will be seller-server certified according to the Responsible Alcohol Beverage Vendor Act set by the Liquor Enforcement Division (LED) by an approved company listed on the LED website. All BOULDER GS, LLC employees must be currently certified in order to serve alcohol. All new employees must be TIPS certified within 30 days of hiring or before selling or handling alcohol.
