Item 5A - Library District PresentationAPRIL 5, 2022 Boulder City Council & Board of County Commissioners for Boulder County Joint Public Hearing & Consideration of City & County Resolutions to form a Public Library District Agenda Presentation •Library district discussion to date •Purpose of a library district •Powers, rights, obligations & responsibilities of governmental entities •Proposed library district boundary & recommended Mill levy •Cost of library services •Overview of resolutions to establish a library district •Next steps if city & county resolutions are adopted to establish a library district Public Hearing City Council Actions •Consideration of a motion to adopt Resolution 1305 forming the Boulder Public Library District; AND; if Resolution 1305 is adopted •Consideration of a motion to establish a council committee & appoint two council members to the committee to act with appointees of the Board of County Commissioners for Boulder County for purposes of appointing an initial Library District Board of Trustees. 2018 •Council accepted Boulder Public Library Master Plan. •Implementation included sustainable funding options for the library. •Council directed staff to have financial analysis conducted. 2019 •Library Champions proposed a district by petition, then withdrew after discussions with the City Manager. •Council directed staff to have a telephone poll conducted. 2020 •Council presented with information about the two processes to form a library district & decision in an IGA. 2021 •Council presented with background on municipal & district governance & funding options. •Council held a public hearing. •Council directed staff to continue to explore the district by resolution process & to form a committee to discuss IGA terms. Oct. -Jan. 2022 •LDAC met & developed recommendations for the terms of the IGA. Feb. 2022 •LDAC recommendations on the IGA were presented to council. March 2022 •Council deliberated on three key issues in the draft IGA –transfer of buildings & land, options for board of trustee appointment, deadline & process for dissolution. 3 City of Boulder Library District Discussion to Date The Boulder Public Library District shall be a “public library” & have the powers & responsibilities set forth in the Colorado Library Law. Its purpose is to obtain financial support from its electors & other sources to independently provide facilities, materials, media, computers, programs, public meeting spaces, community services & other facilities & services provided by library districts in the State of Colorado without continued financial support from the City of Boulder or Boulder County. 4 Purpose of a Library District Intergovernmental Agreement (IGA) Within 90 days of resolution, establishing entities & library district enter an IGA. Terms provide for rights, obligations & responsibilities,financial & otherwise, describing a mutually beneficial relationship & the logistics of separation: •Interim funding •Appointment of the initial & future library district board of trustees •Conveyance of real or personal property for library services •Transition of library employees from the city to the library district •Terms of contract •Process if 2022 TABOR measure fails •Reference & cede all responsibility for the operation & delivery of all library services to the City & the District 5 1. Keep the boundary easy for the voters to understand by creating a rational boundary that is simple to explain. 2. Make the boundaries manageable for the election officials by conforming to Boulder County voting precinct boundaries to the extent feasible. 3. Maximize the impact of the revenue generated by the library district by capturing the largest number of households with BPL cardholders in accordance with the other criteria. 4. Include all areas within the Boulder Valley Comprehensive Plan service area. 5. Avoid conflict & rework for city and county staff by excluding areas where another municipality or townsite intends to offer annexation &/or the provision of library services. 6. The resolutions: •Establish the name Boulder Public Library District. •Define the purpose of the District. •Acknowledge the terms of financial support of the District. •Establish the Mill Levy. •Define the process for appointing the initial Library District Board of Trustees. •Acknowledge that an Intergovernmental Agreement will be created. •Define the deadline for the District to obtain property tax funding or the District dissolves. •The City Council resolution is contingent upon adoption by the Board of County Commissioners for Boulder County of a similar resolution establishing the District. 14 Resolutions to Form a Library District Timeline if a Library District is formed by Resolution 15 May through July 2022 Library District Board of Trustees meets with establishing entities to negotiate IGA July 2022 Library District Board of Trustees drafts TABOR ballot measure and meet election deadlines August 2022 City Council Meeting -Approve final IGA August 2022 BOCC Meeting -Approve final IGA October 2022 City Council Meeting Approval of 2023 budget with library Tuesday, November 8, 2022 TABOR election for library district funding Week of Monday, April 11, 2022 Council/County Commissioner Subcommittee meets to appoint Library District Board of Trustees Tuesday, May 3, 2022 City Council Meeting -Ratification of Library District Board Thursday, May 5, 2022 BOCC Meeting -Ratification of Library District Board Week of May 23, 2022 Library District Board of Trustee deadline for notice to Boulder County of the library district service area boundary map and notice to the County Assessor of the intent to begin collecting property tax in 2022 Thank You.
