Kemp was best friends
with Daniel D ooley, the son
of legendar y Bulldog foot-
ball coach Vince Dooley.
(The Dooleys are not relat-
ed to Debbie Dooley.) In a
July inter view with The
Associated Press, Kemp
remembered how he and
his friend stormed the field
after the game when Walk-
Trump-owned New Jersey
Generals of the United
States Football League and
vacationed with Trump and
his children.
“President Trump has
been a great friend of mine
for years. He’s a great man,
got a great family, I’m going
to stand behind him, but he
don’t run Georgia, I run
Georgia,” Wa lker told
Newsmax on Feb. 7.
Wa lker has ties to Kemp,
’Look, I’m not taking a for-
mal position in the primar y
for governor, but what I am
doing is I’m here with my
friend Donald Trump, the
former president, and I’m
proud he’s suppor ting me,’”
Lake said. “They can thread
that needle.”
Helping Wa lker dodge
any Trump demands is a
relationship that predates
their entries into politics.
Wa lker played for the
Wa rnock and Stacey
Abrams, the all-but-cer tain
nominee for governor. The
two are longtime political
allies. Abrams’ strong back-
ing was a major factor in
propelling Wa rnock to the
Senate in 2021, and they are
likely to run closely-linked
campaigns emphasizing
many of the same issues,
including Medicaid expan-
sion and protecting voting
rights.
A Tr ump spokesperson
did not immediately
respond to a request for
comment for this stor y. B ut
his political team has not
talked to Wa lker about
endorsing in the gover nor’s
race, according to a person
familiar with conversations
between the two camps
who requested anonymity
to discuss inter nal opera-
tions.
Kemp never asked for
Wa lker’s blessing, said
spokesperson Cody Hall.
Perdue’s campaign didn’t
respond to questions about
whether Perdue has sought
Wa lker’s suppor t.
Wa lker has his own prob-
lems, including scr utiny on
his past threats of violence,
his business dealings a nd
his policy positions in the
Senate race. But he’s seen
as a strong front-r unner in
the primar y in par t because
of the celebrity he ear ned
after leading the University
of Georgia to a national
championship following the
1980 season and winning
the Heisman Trophy in
1982.
With Wa lker cur rently
suppor ted by many Perdue
and Kemp voters, there is
little incentive for him to
make either side mad, said
Randy Evans, an Atlanta
lawyer and Trump’s former
ambassador to Luxem-
bourg who is backing Wa lk-
er.
Evans said Walker has
emerged as the “900-pound
gorilla” of the primary. “The
tr uth of the matter is Her-
schel is bigger than either
of them put together,”
Evans said.
Other Trump loyalists
still believe Wa lker will
come around to suppor ting
Perdue, though.
“I think you’re going to
have a unified Trump tick-
et,” said Debbie Dooley, a
national tea par ty leader
and early backer of
Trump’s 2016 candidacy
who lives in suburban
Atlanta.
Wa lker has pledged to
back the primar y winner.
Spokesperson Mallor y
Blount said Wa lker is
“laser-focused on unifying
the par ty so we can defeat
Sen. War nock.”
One likely outcome, sug-
gests Georgia Republican
political consultant Chip
Lake, is that Wa lker could
“finesse” the situation by
appearing with Trump and
Perdue at a rally without
of fering an explicit
endorsement.

Wa lker has a message for
the Republicans going after
each other for their par ty’s
nomination for gover nor in
Georgia: Don’t count on
help from me.
A football legend in a
spor ts-crazed state whose
Senate campaign is backed
by former President Don-
ald Trump, Wa lker is run-
ning far ahead in Georgia’s
May primar y. That makes
his suppor t attractive for
incumbent Gov. Brian
Kemp and challenger David
Perdue, who are in a br uis-
ing primar y campaign.
For now, Wa lker is refus-
ing to get involved and is
increasingly expressing
exasperation with the nega-
tive tone of the gover nor’s
race. He is voicing the con-
cer ns of many Republicans
that a nasty campaign
between Kemp and Perdue
could leave the GOP divid-
ed heading into the Novem-
ber election and potentially
cost the par ty the governor-
ship in a state they have
dominated for two decades.
“I don’t suppor t either
one of them. I’m mad at
both of them,” Wa lker told a
University of Nor th Geor-
gia audience last month,
according to audio obtained
by T he Atlanta Journal-Con-
stitution. He later told
nationally syndicated con-
ser vative radio hosts Clay
Travis and Buck Sexton
that “intersquad fighting”
was distracting from ef for ts
to unify the par ty.
“I told people I’m upset
because we got some
strong candidates run-
ning,” he said. “We cannot
continue to go out there
and fight among each other
when we got this countr y
that is hur ting.”
That anxiety is especially
pronounced in Georgia,
where Republicans have
attributed the loss of two
Senate seats in 2021 to par-
ty infighting after the 2020
presidential election. Those
defeats handed Democrats
the Senate majority.
Trump, who nar rowly
lost Georgia in 2020 and
has made the state a center-
piece of his lie that the e lec-
tion was stolen, isn’t doing
anything to soothe ten-
sions. He appears to be
micromanaging ef for ts to
defeat Kemp, whom he
blames for not tr ying to
over tur n Biden’s victory in
Georgia — something the
governor had no power to
do.
The former president
retaliated by publicly
recr uiting Perdue, one of
the senators defeated in
2021, to run for gover nor.
Tr ying to clear the way for
Perdue, Trump persuaded
another loyalist running for
governor, Ve rnon Jones, to
exit the field and instead
run for a congressional seat
with his explicit backing.
The GOP dynamic con-
trasts with the straightfor-
ward alignment on the
Democratic side between
incumbent Sen. Raphael
Wa lker taking n o sides in GOP c ontest for governor

Chair Alyssa Lundgren departed the hearing after agenda item 1 was completed.
iii. Approval of Beverage Licensing Authority (BLA) minutes from January 19, 2022,
hearing;
Chair Lundgren moved, Member Wallace seconded, to approve the minutes from
January 19, 2022 hearing. Minutes approved 3:0 (Lundgren, Friesen, and Wallace)
with Members Califano and Absalom recused due to their absence at the January
hearing.
iv. Hearing agenda issues from Licensing Clerk;
Licensing Manager Cook brought to the Board’s attention the following issues:

Under Agenda Item 6, The NICHE Event Space, this hearing item would not be
convened because the applicant has stated that they will not be ready to proceed until
April.
Ms. Cook requested that Chair Lundgren appoint an acting chair in the instance where
the chair and vice chair were both absent from a BLA hearing. Member Friesen
clarified that he was no longer vice chair, but instead that the BLA had decided that
Mike Absalom would be Vice Chair. Chair Lundgren then noted that she would appoint
Matthew Califano as acting chair. Chair Lundgren then departed the hearing, noting
that she would be resigning from the board the day after this hearing. All city staff and
Authority members thanked Chair Alyssa Lundgren for her excellent service on the
BLA.
2. Matters from the Boulder Police Department (BPD).
Officer Rich Denig noted that the 4th quarter summary for 2021 was included in the
hearing packet, noting for the Authority that Bluff Street is of concern. Officer Denig stated
that he was currently covering both the alcohol enforcement officer and the cannabis
enforcement officer positions for BPD, and that June would be the soonest that a new
officer who would take on the cannabis enforcement officer duties would start. Vice Chair
Absalom asked when compliance checks would begin again, and Officer Denig replied that
there may be some explorer program participants who can act as undercover operatives.
3. Matters from the Responsible Association of Retailers (RAR).
Nathan Dewey provided the following updates to the Authority: RAR agenda for their last
meeting was in the hearing packet, that the RAR again received a Boulder County grant to
reduce the cost of Boulder memberships, that he is working with Officer Denig to attend
the next RAR meeting, that he will ask Licensing to attend the April RAR meeting, that he
has added RAR server trainings because he has other trainers now available and he will
remind attendees of the city training condition of 60 days at upcoming trainings, and that
Kevin Mahoney is included in the current RAR newsletter.
4. General Public Comments for Future Beverage Licensing Authority Hearings.
No public comments received.
5. Public hearing and consideration of an application filed on November 4, 2021 from
Century Theatres, Inc. d/b/a Century 16, 1700 29th Street, Boulder, CO 80301; Century
Theatres, Inc. [CTI] as Applicant with Cinemark USA, Inc. [CUI] as 1st underlying sole
owner, and with Cinemark Holdings, Inc. [CHI]-a publicly traded company, as 2nd
underlying sole owner; and with Mark Zoradi as CEO and Director of CTI and CUI;
Michael Cavalier, Vice President and Secretary of CTI and CUI; and with Sean Gamble,

Brian Proffitt, Esq. appeared as the licensee’s attorney. Matt Dunne and Brad Janowiak
were present for this item, both were sworn in, and Mr. Dunne confirmed the 10-day
posting.
Hearing procedures were waived by Mr. Proffitt on behalf of his client. No Authority
members disclosed ex-parte contacts or conflicts of interest. No public comments or
interested party comments were received for this matter.
Ms. Cook noted that this renewal hearing was convened due to late filing and that all other
items, including server training had been corrected. The Authority discussed this renewal
with Mr. Proffitt and his witnesses.
Member Friesen moved, Califano seconded, to approve the renewal of this lodging and
entertainment liquor license. Motion approved 4:0.
6. As needed, public hearing and continued consideration of an application filed on
October 13, 2021 from Niche Workspaces, LLC. d/b/a The NICHE Event Space., 4571
Broadway, Boulder, CO 80304; Jesse Day, Owner and Proposed Registered Manager,
with a premise business mailing address for a New Tavern type liquor license.
Ms. Cook noted under agenda item 1 that this application hearing would not be convened.
7. Public hearing and consideration of an application filed on November 23, 2021 from
Frasca Food and Wine Inc. d/b/a Frasca Food and Wine/Pizzeria Locale, 1738 Pearl
Street, Unit 104, Boulder, CO 80302; Peter Hoglund, Robert Stuckey and John
MacKinnon-Patterson, Owners; with a premise mailing address, for a Permanent
Modification of a Hotel-Restaurant type liquor license.
Mike Laszlo, Esq. appeared as the licensee’s attorney. Alicia Harmon and Peter Hoglund,
were present for this item, both were sworn in, and Ms. Harmon confirmed the 10-day
posting. Hearing procedures were waived by Mr. Laszlo on behalf of his client. No
Authority members disclosed ex-parte contacts or conflicts of interest. No public
comments or interested party comments were received for this matter.
Mr. Hoglund stated that this modification is to update and refurbish the kitchen, removing
a wall from the locked wine room and then reconstructing the wall, but that it does not
change the concept. Ms. Harmon noted that she completed the neighborhood petitioning
herself over 3 days, approaching both residents and businesses inside of the
neighborhood boundary.
The Authority discussed this modification with Mr. Laszlo and his witnesses.

8. Public hearing and consideration of an application filed on December 14, 2021 from
DeRossi Boulder, LLC. d/b/a Avant Garden Bistro, 1002 Walnut Steet, Suite 102,
Boulder, CO 80302; Ravi Lalchandani, Owner and Registered Manager; with a business
mailing address of 445 E. 6th Street. New York, NY 10009 for a new Hotel-Restaurant
type liquor license.
Mike Laszlo, Esq. appeared as the licensee’s attorney. Ravi Lalchandani, Owner, and Eva
Garrettson with Liquor Pros Petitioning, were present for this item, both were sworn in,
and Mr. Lalchandani confirmed the 10-day posting. Hearing procedures were waived by
Mr. Laszlo on behalf of his client. No Authority members disclosed ex-parte contacts or
conflicts of interest. No public comments or interested party comments were received for
this matter.
Mr. Lalchandani stated that he was going to relocate to Boulder to be locally working to
open this new vegan restaurant and that once the operations were running smoothly he
would add a new registered manager, then return to New York.
Ms. Garrettson testified about the petition results completed by her company.
Both Members Wallace and Califano noted that late night dinner service would likely be a
younger age demographic, and that Mr. Lalchandani has verbally described his extensive
training, so they recommended that more complete alcohol service policies should be
drafted and that membership in the RAR was recommended.
Member Friesen moved, Absalom seconded, to approve the new application for this
hotel-restaurant liquor license. Motion approved 4:0.
9. Public hearing and consideration of an application filed on December 15, 2021, from
LM Boulder CO, LLC. d/b/a Lucky’s Bakehouse Cafe, 3980 Broadway, Suite 106-107,
Boulder, CO 80304; LM Acquisition CO, LLC as Applicant with Jason Bohanan Sharon
as 100% owner of the parent company, and with Jennifer Johnson as proposed
Registered Manager, with a business mailing address of 3970 Broadway Street, Suite
105, Boulder, CO 80304 for a new Hotel-Restaurant type Liquor License.
Drew Gottlieb, Esq. appeared as the licensee’s attorney. Jason Bo Sharon, Owner,
Shannon Scott, Operations Director, Jennifer Johnson, Proposed Registered Manager, and
Austin Gemmell from Oedipus Petitioning appeared for this matter, all were sworn in and
Ms. Johnson confirmed the 10-day posting. Hearing procedures were waived by Mr.

Mr. Sharon, Ms. Scott, and then Ms. Johnson testified about their restaurant concept and
experience. Ms. Johnson testified about her submitted background worksheet.
Mr. Gemmell testified about the neighborhood petition results from his company.
The Authority members, the applicant, and Ms. Cook discussed the following corrections
to their plans for this new restaurant: that a scan of alcohol receipts must be available on-
site at the restaurant if the originals were elsewhere, that physical barriers and signage
would be required for containment on the outdoor patio, and that a retail warehouse
storage permit would be required if alcohol would be stored in the office which is located
in another adjacent building.
Member Wallace moved, Califano seconded, to approve the new application for this
hotel-restaurant liquor license. Motion approved 4:0.

Assistant City Attorney Laurel Witt was present for this hearing and she did not have
matters to address.

Further, she asked that the Authority members and other persons present to
remind potential board applicants that the deadline to submit 2022 application
was February 21, 2022.
12. Matters from the Chair and Members of the Authority
Member Friesen asked why Frasca Food and Wine had been scheduled for a permanent
modification hearing with neighborhood petitioning referencing state modification
rules, and Ms. Cook replied with her reasoning and reference to BLA Rules of Procedures
and her procedures.

Member Friesen moved, Member Wallace seconded, that this hearing should be adjourned,

City of Boulder Beverage Licensing Authority
Application for License Renewal
1) The Chair will call the meeting item to order, and the Licensing Clerk then reads the matter into
record
2) The Chair, after calling the meeting item to order, then makes the following opening comments:
This is a public hearing before the Beverage Licensing Authority of the City of Boulder to determine
whether or not the application of Applicant [Business Name]: ___________________________, d/b/a
[Trade Name]: _________________________, for a renewal of a [Type of License]: _________________
license shall be granted or denied. This hearing is conducted pursuant to the laws of the State of
Colorado and the Rules of the Beverage Licensing Authority of the City of Boulder.
The purpose of this hearing is to receive information, data, and testimony by interested parties in order
to enable this Authority to make the findings and to reach the conclusions required to be made by state
law as to whether or not the license shall be renewed. Interested parties are the Applicant, residents of
the neighborhood affected by the license as previously determined by the Authority, and the owners
and managers of a business located within the neighborhood. This hearing shall be limited to the
question of whether there is good cause not to renew the license, as set form in the notice of hearing,
dated: _______________.
A record is being made of these proceedings. Those who desire to be heard shall identify themselves by
stating their name, spelling their last name, and stating their pertinent address. They shall also be sworn
in by the Board Secretary.
3) The Chair, then asks the Authority members if anyone has a conflict of interest for this item or if
they have and ex-parte contacts regarding this item that they wish to disclose. If there is a
conflict of interest or ex-parte contact for an Authority member disclosed, the City Attorney may
inquire as to the details of the disclosure.
4) The Chair, then inquires whether there are:
i) interested parties present or persons who will act as witnesses for interested parties
(they have standing because they reside in or own or manage a business in the
designated neighborhood to provide testimony, submit evidence, or cross examine
witnesses), or
ii) members of the general public who wish to supply comment (they do not have standing
as interested parties because they are not located in the designated neighborhood)
5) The Chair asks the Applicant whether they are ready to proceed. If the Applicant answers in the
affirmative, then the Chair inquires whether the Interested Parties are ready to proceed and, if
they are not, asks for reasons why the application hearing shall not now proceed.
6) If the Applicant and Interested Parties state that they are ready to proceed, then public
comment is taken. Public comment is supplied in 3 minutes per person timed increments.
7) The City Attorney or other representative of the Boulder Police Department, will present
evidence gathered by the police department, the Licensing Clerk, or other city agencies relevant
to the issues framed in the notice. Witnesses may be cross-examined by members of the
Authority, representatives of the Boulder Police Department, Interested Parties, and the
Applicant.
8) The Applicant then presents their evidence. The Applicant and the applicant’s witnesses may be
cross-examined by members of the Authority, by Interested Parties, by the City Attorney and by
representatives of the Boulder Police Department.
9) The Interested Parties may then present their evidence in support of or in opposition to the
application. The Interested Party and the interested parties’ witnesses may be cross-examined
by members of the Authority, by Interested Parties, by the City Attorney and by representatives
of the Boulder Police Department.
10) At the Authority’s discretion, the Applicant may present rebuttal evidence.
11) The Chair then closes the matter for Authority deliberations. After this time, no further evidence
or testimony may be taken.
12) A member of the Authority then moves, and a member must then second, to approve or
disapprove the application or, for good cause, to continue the matter. Authority discussion on
the basis for their upcoming vote to the motion should be undertaken by all members. After
discussion, a vote is then taken with all members voting to approve or deny the motion.

ANNUAL RENEWAL FOR LIQUOR LICENSES
Both State & City renewal forms, fees(State Fee is Online Payment Confirmation) must be submitted to the City
for processing.
Do not send your state renewal to the state office - the City will process it after your city renewal is approved.
CHECKLIST OF REQUIRED DOCUMENTS
D State Renewal Application- Licensee will receive this 1 page form about 120 days prior to the license expiration
date. If they do not receive this form, a 2 page replacement form can be found on the city website included in
Liquor License renewal documents (pages 5 and 6). The fill in the blank form (page 6 of renewal packet) may be
used.
D City renewal form-Licensee will receive this form about 90 days before their license expiration date. Answer all
questions on the city form and sign/title/date the 2nd page. Attach explanations of any criminal activity for the
owners/managers in the past year. Explanations of any suspensions occurring in the last year should also be
attached.
D Employee Training Form and associated Certificates or Cards-This information corresponds to a question on the
city renewal form. It is a local condition of holding a liquor license that Licensees train all of their employees
who serve and sell alcohol within 2 months of the location opening or within 2 months of the employee's hiring,
and that the servers are re-trained to stay currently certified. Only in-person classes are state approved
(Not Etraining).
D Certificate of Good Standing- This Certificate can be obtained from the Colorado Secretary of State's website, by
searching in the Business Organizations area.

The proper amount of the renewal fees depends on the class or type of liquor license being renewed and for
details the Licensee should consult the annual fee schedule on the City's applications page.

secretary of state's website, and the above listed training information should be all be received by the City of
Boulder at least before the 45 days prior to expiration date (this deadline is listed on the city renewal) or
licensee will face either a temporary suspension or Beverage Licensing Authority (BLA) hearing.
D In addition to the above requirements, if Liquor License is held by a sole proprietor, then City Licensing Office
also needs a completed Affidavit of Lawful Presence form and a copy of the Owner's Driver's License or state
issued Picture ID for the renewal.
Please Note:
If both the state renewal form and city renewal form and City renewal fees and the State payment confirmation
are not received together by the city, then the entire renewal will be returned to the Licensee by the City
of Boulder. Email the Licensing Office at licensingonline@bouldercolorado.gov if you do not receive the
state or city forms because duplicate city renewal forms and alternate state forms can be obtained.
State renewal forms require City of Boulder approval. If a Licensee has mistakenly mailed a state renewal form and
state fee to the State Liquor Enforcement Division, the check will be deposited by the state, but the state renewal
form will be returned to the Licensee. Complete renewals received after the expiration date may result in non
renewal, thus requiring a new liquor license application, but will result in a $500 late filing fee payable to the City of
Boulder and a BLA renewal hearing.

HEARING PROCEDURES OUTLINE
City of Boulder Beverage Licensing Authority
Application for License Renewal
1) The Chair will call the meeting item to order, and the Licensing Clerk then reads the matter into
record
2) The Chair, after calling the meeting item to order, then makes the following opening comments:
This is a public hearing before the Beverage Licensing Authority of the City of Boulder to determine
whether or not the application of Applicant [Business Name]: ___________________________, d/b/a
[Trade Name]: _________________________, for a renewal of a [Type of License]: _________________
license shall be granted or denied. This hearing is conducted pursuant to the laws of the State of
Colorado and the Rules of the Beverage Licensing Authority of the City of Boulder.
The purpose of this hearing is to receive information, data, and testimony by interested parties in order
to enable this Authority to make the findings and to reach the conclusions required to be made by state
law as to whether or not the license shall be renewed. Interested parties are the Applicant, residents of
the neighborhood affected by the license as previously determined by the Authority, and the owners
and managers of a business located within the neighborhood. This hearing shall be limited to the
question of whether there is good cause not to renew the license, as set form in the notice of hearing,
dated: _______________.
A record is being made of these proceedings. Those who desire to be heard shall identify themselves by
stating their name, spelling their last name, and stating their pertinent address. They shall also be sworn
in by the Board Secretary.
3) The Chair, then asks the Authority members if anyone has a conflict of interest for this item or if
they have and ex-parte contacts regarding this item that they wish to disclose. If there is a
conflict of interest or ex-parte contact for an Authority member disclosed, the City Attorney may
inquire as to the details of the disclosure.
4) The Chair, then inquires whether there are:
i) interested parties present or persons who will act as witnesses for interested parties
(they have standing because they reside in or own or manage a business in the
designated neighborhood to provide testimony, submit evidence, or cross examine
witnesses), or
ii) members of the general public who wish to supply comment (they do not have standing
as interested parties because they are not located in the designated neighborhood)
5) The Chair asks the Applicant whether they are ready to proceed. If the Applicant answers in the
affirmative, then the Chair inquires whether the Interested Parties are ready to proceed and, if
they are not, asks for reasons why the application hearing shall not now proceed.
6) If the Applicant and Interested Parties state that they are ready to proceed, then public
comment is taken. Public comment is supplied in 3 minutes per person timed increments.
7) The City Attorney or other representative of the Boulder Police Department, will present
evidence gathered by the police department, the Licensing Clerk, or other city agencies relevant
to the issues framed in the notice. Witnesses may be cross-examined by members of the
Authority, representatives of the Boulder Police Department, Interested Parties, and the
Applicant.
8) The Applicant then presents their evidence. The Applicant and the applicant’s witnesses may be
cross-examined by members of the Authority, by Interested Parties, by the City Attorney and by
representatives of the Boulder Police Department.
9) The Interested Parties may then present their evidence in support of or in opposition to the
application. The Interested Party and the interested parties’ witnesses may be cross-examined
by members of the Authority, by Interested Parties, by the City Attorney and by representatives
of the Boulder Police Department.
10) At the Authority’s discretion, the Applicant may present rebuttal evidence.
11) The Chair then closes the matter for Authority deliberations. After this time, no further evidence
or testimony may be taken.
12) A member of the Authority then moves, and a member must then second, to approve or
disapprove the application or, for good cause, to continue the matter. Authority discussion on
the basis for their upcoming vote to the motion should be undertaken by all members. After
discussion, a vote is then taken with all members voting to approve or deny the motion.

This bulletin is designed to serve as a reminder that pursuant to Regulation 47-328
of the Colorado Liquor Rules (1 CCR 203-2), local licensing authorities need to
report the establishment of, or any changes to, Entertainment Districts located
within their local jurisdictions to the Liquor Enforcement Division (LED) within
fifteen (15) days of that establishment or change.
Having accurate records of locations, hours, premises maps, and relevant
information regarding the operation of an Entertainment District and any common
consumption areas attached thereto helps us work in partnership with you to
ensure public safety and help businesses in our state thrive.
Please submit these relevant records regarding Entertainment Districts located
within your jurisdiction to: dor_liqlicensing@state.co.us as soon as possible to
help us ensure that we have up-to-date and accurate records for our program
administration and required reporting on our end.

This email of thanks is coming from me personally and not on behalf of anyone else.
That was a brutal hearing yesterday (last night and this morning!) and I am so impressed by your
dedication; and I would feel the same no matter the outcome.
We all essentially faced a lose‐lose outcome.
We were forced into fighting this by the City even though I do very much desire a nice place to eat at the
Reservoir ‐ just not with a need or a desire for alcohol on the parameters of this application. This entire
process has been one of the worst experiences of my life, honestly, and that is saying a lot.
And you were forced to use the burden of a legal guideline even though you might have felt otherwise.
I know with what difficulty and reluctancy you made your decision. Noone is ecstatic that it had to
ultimately come to this. We all want a great thing for Boulder and the larger community at the Res.
Personally, I hope that I might have an opportunity to be a helpful part of the solution eventually and
will make all efforts toward this end.

Thanks so much for your public service!
I wanted to write and suggest two things as potential rules changes to the BLA meetings guidelines, just
based on all of our miserable experiences last Wednesday night/Thursday morning.
First, the format clearly favors the applicant's attorney "marathoning" the hearing. We had 60 interested
parties (even though it was during work hours on a work day) towards the beginning of the meeting and
approx 12 at the end. This incentivizes the applicant's attorney to make the meeting last as long as possible,
something I don't think anyone else really wants. Could you do a "raise hands in favor and opposed" type
thing after the general public speaks? If interested parties still want to speak, they could hang on for their
actual time.
Second (and this would have made the reservoir situation much more tidy), how about implementing a
"Good Neighbor Agreement" actually into the provisions of the license? This would provide the gray area
the BLA seemed to be seeking. It was suggested to me by a local liquor attorney; apparently it is much in
use in Denver. I've copied the outline of it here and the emphasis is mine:
The Department of Excise and Licenses encourages regular communication between Registered
Neighborhood Organizations and applicants/licensees to prevent or resolve issues of concern to the
community.
Many neighborhood organizations have negotiated “Good Neighbor Agreements” with applicants and
licensees to facilitate a good working relationship and spell out how they will work together to address
identified or anticipated problems. These agreements generally demonstrate good intentions to problem
solve collaboratively and cooperatively.
The types of issues typically addressed in Good Neighbor Agreements include:
• Music/noise levels • Hours of operation • Outdoor patios
• Trash and recycling issues
• Transfer of the license to a new owner
Good Neighbor Agreements remain on file with the Department, but are not incorporated into or
attached to the license. However, if the licensee consents, up to four provisions of a Good Neighbor
Agreement may be issued as conditions on the license if they are legal and enforceable and can
be displayed on the face of the license. (Policies and Procedures Pertaining to Liquor and 3.2
beer Licenses, June 15, 2013 – Section F.9).
A Good Neighbor Agreement is also a great way to ensure that the terms the neighborhood and the
original applicant agreed upon transfer to new business owners who take over the license

I’d like to hear your rational as to why you denied Driftwind alcohol licensing at the Boulder reservoir?
It appears to me it was just submission to aggressive and intimidating tactics by a handful of neighbors
So that is what it takes now in Boulder to get or be denied a license?
