12.09.21 POP Meeting NotesBoulder Police Oversight Panel Meeting Notes December 9, 2021 I. Completion of panel by-laws The panel continued their discussion and review of edits to the panel’s draft by-laws. II. 2022 meeting dates The panel discussed preferred meeting dates for 2022 and decided to continue meeting on the second Thursday of each month. Adjusting the meeting time to 7-9pm was proposed. The panel set a Dec. 17 deadline for panel members to provide feedback. III. Panel retreat – date, location, tasks The panel discussed date options and locations for their upcoming panel retreat. Panel members expressed concern about the ongoing pandemic and when it would allow them to meet in person. Ms. Amaru volunteered to coordinate a Doodle poll to identify a date for the retreat and to gauge the panel’s comfort level with meeting in person. IV. Monitor’s report a. Upcoming panel meetings i. Chief of Police – doodle poll sent ii. City Manager – awaiting dates b. NACOLE conference c. MOU on notification to monitor of critical incidents d. Report on outcome of case reviews – two cases were resolved since the last meeting i. One was a Rule 6 Use of Force allegation involving a juvenile. The panel’s initial review of the case resulted in the panel recommending further investigation and raising two additional concerns regarding the subject officer’s verbal interaction with the complainant and a bystander. PSU conducted additional investigation and the panel reviewed the case file again. The panel ultimately recommended sustaining the Rule 1 allegation along with two counts of Rule 8 Conduct. The panel recommended retraining through supervisory counseling and a one-year letter of reprimand in the officer’s file. The panel also recommended that BPD develop enhanced training for officers on interacting with youth who may have behavioral or developmental challenges. The Chief of Police reviewed the recommendations from the panel, PSU, and BPD command staff and came to a determination of exonerated on the allegations. However, a supervisory conveyed to the subject officer that the verbal interactions should be handled more professionally in the future. The department has also transmitted the panel’s training recommendation to the BPD training team for further consideration. The monitor and the panel will follow up with the department on the training recommendation and publicly report any enhancements made to BPD training on interacting with youth. ii. The second case involved a Rule 1 allegation against an officer for making an inappropriate comment over the police radio. The panel recommended that the allegation be sustained and that the officer receive retraining through supervisory counseling. The Chief sustained the allegation and imposed discipline. e. Monthly case statistics i. Six complaints were filed in November (and two community inquiries) • Two were reviewed by the panel at last month’s meeting, and three will be reviewed tonight. The sixth was just entered into IAPro and will be available for the panel to review next month. ii. So far in December, no complaints have been filed iii. There are currently 11 active investigations that are in progress (up from 10 last month) iv. So far in 2021, 53 complaints have been filed and 10 allegations have been sustained against officers V.
