Meeting Notes
January 13, 2022
I. Completion of panel by-laws
The panel reviewed edits from the City Attorney’s office accepting some
and rejecting others. Stopped at collaboration vs. consultation.
II. POP 2022 calendar
Panel reviewed the scheduling survey and decided 6:30-8:30 PM, 2nd
Thursday of the month would work moving forward. A quarterly
meeting between Chief and chair/co-chair was requested.
III. Panel retreat – date (or informal gathering)
Due to Covid, in-person gathering is pushed out. Panel discussed having
an informal virtual gathering to get to know each other would be good.
Keeping a virtual retreat was also discussed.
IV. Count Me In: tracking volunteer hours
Monitor asks that panelists track their hours to document time and
effort panelist are providing. This data is helpful for future decision
making.
V. NAACP Meeting
Panelists discussed moving forward with a proposal to present to the
NAACP regarding meeting specifics.
VI. Monitor’s report
a. Upcoming panel meetings
i. Chief of Police - the panel will host a public meeting with Chief
Herold on January 25.
ii. City Manager - the panel is in the process of scheduling a
meeting with the City Manager.
b. NACOLE conference materials on SharePoint
The monitor indicated that he created a folder on the panel’s internal
SharePoint site that contains a variety of presentation materials from
the 2021 NACOLE conference.
c. MOU on notification to monitor of critical incidents
The monitor indicated that the MOU has been signed by the Chief
and the monitor and is in the process of being signed by the panel co-
chairs.
d. Report on outcome of case reviews
i. MI2021-043: This case involved an allegation that an officer
failed to complete a report regarding a threat made at a
school, which would be a Rule 1 violation, specifically G.O. 201
Report Writing. The panel reviewers recommended the
allegation be sustained and that the officer receive a one-year
letter of reprimand. The panel reviewers also recommended
that a supervisor provide the officer with a verbal reminder
that the Crisis Intervention Response Team is available to
contact individuals in such situations. The Chief of Police
concurred with the Panel, has sustained the allegation,
implemented discipline, and issued the reminder to the officer
about the availability of CIRT.
ii. MI2021-047: This case involved an allegation that an officer
failed to confirm the service of a protection order and applied
for a warrant that was invalid, which would be a Rule 1
violation, specifically G.O. 313-3(C) Charging. The panel
reviewers recommended the allegation be sustained and that
all officers receive a training reminder about the importance of
confirming service of protection orders before applying for a
warrant. The Chief of Police concurred with the Panel, has
sustained the allegation, and has indicated that the training
reminder will be issued. The original incident occurred in 2018
and the subject officer was no longer a member of BPD when
the complaint was filed in 2021. Thus, no individual discipline
could be implemented.
e. Monthly case statistics
i. Two complaints were filed in December (and two community
inquiries)
ii. So far in January, one complaint has been filed
iii. There are currently 13 open investigations that are in progress
(up from 11 last month)
iv. In 2021, a total 55 complaints were filed, and 11 allegations (9
cases) have been sustained against officers. This represents a
16% sustain rate.
v. In 2021, the panel reviewed five completed complaint
investigations. The panel recommended sustaining the
allegations in all five cases. The Chief of Police concurred with
the panel, sustained the allegations, and implemented
discipline in four of the five cases reviewed by the panel. This
represents an 80% concurrence rate.
VII. Panel selection of cases to review
The panel reviewed the summaries of the complaints filed in November.
The panel voted on whether to conduct a full review of each case. The
panel elected to conduct a full case file review of cases #MI2021-045,
#MI2021-046 and #MI2021-073.
VIII. Public Comment
Member of the public commented on use of force and asked that panel
look at average use of force data compared to individual use of force.
