The U.S. plans to admit
thousands of Afghan refu-
gees over the next year but
they will arrive in smaller
groups and will be housed
in a facility at a location yet
to be determined, the
Depar tment of Homeland
Security said.

agency said. The base held
the largest number of
Afghans, reaching a peak of

Afghans under went immi-
gration processing and
health screening while they
waited at the bases, often
for months, until the
strained refugee organiza-
tions could place them in
communities. The gover n-
ment set up schools for the
children who made up
about 40 percent of the refu-
gees at the New Jersey
base.
Resettlement organiza-
tions and Homeland Securi-
ty, the lead federal agency
in the ef for t, had set a goal
of having ever yone of f the
bases by Feb. 15. It was a

ing, cutbacks to refugee

refugees who awaited reset-
tlement at eight U.S. mili-
tar y installations depar ted
Saturday from a base in
New Jersey, completing a
jour ney that star ted with
the chaotic evacuation from
Kabul in August.
With assistance from ref-
ugee resettlement organiza-
tions, Afghans evacuated
after their country f ell to the
Taliban have b een gradually
leaving t he militar y bases in
recent months and star ting
new lives in communities
throughout the United
States.
The U.S. admitted 76,000
Afghans as par t of Opera-
tion Allies We lcome, the
largest resettlement of refu-
gees in the countr y in
decades.
“It’s a really impor tant
milestone in Operation
Allies We lcome but I want
to stress that this mission
isn’t over,” said Krish
O’Mara Vignarajah, presi-
dent and CEO of Lutheran
Immigration and Refugee
Ser vice, one of nine nation-
al resettlement organiza-
tions that were par t of the
ef for t.

on Friday released a
screening tool to help iden-
tify disadvantaged commu-
nities long plagued by envi-
ronmental hazards, but it
won’t include race as a fac-
tor in deciding where to
devote resources.
Administration of ficials
told repor ters that exclud-
ing race will make projects
less likely to draw legal
challenges and will be easi-
er to defend, even as they
acknowledged that race
has been a major factor in
terms of who experiences
environmental injustice.
The decision was harshly
challenged by members of
the environmental justice
community.
“It’s a major disappoint-
ment and it’s a major flaw
in tr ying to identify those
communities that have
been hit hardest by pollu-
tion,” said Rober t Bullard,
a professor of urban plan-
ning and environmental
policy at Texas Southern
University in Houston and
a member of the White
House Environmental Jus-
tice Advisor y Council.

HELENA — Martha Wil-
liams, the former director
of Montana’s wildlife agen-
cy, has been confirmed to
lead the U.S. Fish and
Wildlife Ser vice.
The U.S. Senate con-
firmed her nomination
Thursday night with a
voice vote.
The U.S. Fish and Wild-
life Ser vice, which is par t
of the Depar tment of Interi-
or, is responsible for pro-
tecting species listed under
the Endangered Species
Act. The service also over-
sees national conser vation
ef for ts — including fisher-
ies, hatcheries, migrator y
birds, ecological ser vices
and federal wildlife refug-
es.
Williams has essentially
ser ved as acting director of
the wildlife agency since
Jan. 20, 2021, when she
was named principal depu-
ty director.
Williams worked as an
attorney for Montana Fish,
Wildlife and Parks from
1998 to 2011 and was
involved with the state’s
ef for t to take over manage-
ment of wolves from feder-
al authorities.
She spent two years as a
solicitor at the Department
of Interior before retur ning
to teach at the University of
Montana law school.

Application for a New License or a Change in Class
1) The Chair will call the meeting item to order, and the Licensing Clerk then reads the matter into

This is a public hearing before the Beverage Licensing Authority of the City of Boulder to determine
whether or not the application of Applicant [Business Name]: ___________________________, d/b/a

license shall be granted or denied. This hearing is conducted pursuant to the laws of the State of
Colorado and the Rules of the Beverage Licensing Authority of the City of Boulder.
The purpose of this hearing is to receive information, data, and testimony by interested parties in order

hearing, the neighborhood under consideration is the neighborhood previously defined by the
Authority. The Authority shall make a final determination of the affected neighborhood prior to
determining whether the license shall be issued. Any interested party may speak to the question of
neighborhood designation, as well as other information relevant to the granting or denial of the
application.
A record is being made of these proceedings. Those who desire to be heard shall identify themselves by
stating their name, spelling their last name, and stating their pertinent address. They shall also be sworn
in by the Board Secretary.
3) The Chair, then asks the Authority members if anyone has a conflict of interest for this item or if
they have and ex-parte contacts regarding this item that they wish to disclose. If there is a
conflict of interest or ex-parte contact for an Authority member disclosed, the City Attorney may
inquire as to the details of the disclosure.
4) The Chair, then inquires whether there are:
i) interested parties present or persons who will act as witnesses for interested parties
(they have standing because they reside in or own or manage a business in the
designated neighborhood to provide testimony, submit evidence, or cross examine
witnesses), or
ii) members of the general public who wish to supply comment (they do not have standing
as interested parties because they are not located in the designated neighborhood)
5) The Chair asks the Applicant whether they are ready to proceed. If the Applicant answers in the
affirmative, then the Chair inquires whether the Interested Parties are ready to proceed and, if
they are not, asks for reasons why the application hearing shall not now proceed.
6) If the Applicant and Interested Parties state that they are ready to proceed, then public
comment is taken. Public comment is supplied in 3 minutes per person timed increments.
7) The Applicant then presents their evidence. The Applicant and the applicant’s witnesses may be
cross-examined by members of the Authority, by Interested Parties, by the City Attorney and by
representatives of the Boulder Police Department.
8) The Interested Parties may then present their evidence in support of or in opposition to the
application. The Interested Party and the interested parties’ witnesses may be cross-examined
by members of the Authority, by Interested Parties, by the City Attorney and by representatives
of the Boulder Police Department.
9) At the Authority’s discretion, the Applicant may present rebuttal evidence.
10) The Chair then closes the matter for Authority deliberations. After this time, no further evidence
or testimony may be taken.
11) A member of the Authority then moves, and a member must then second, to approve or
disapprove the application or, for good cause, to continue the matter. Authority discussion on
the basis for their upcoming vote to the motion should be undertaken by all members. After
discussion, a vote is then taken with all members voting to approve or deny the motion.

GREETINGS:
Pursuant to C.R.S. 44-3-312(1) and the below referenced State laws and the city of
Boulder Beverages Licensing Authority (BLA) Rules of Procedure, you are hereby advised
that with regard to the application for a New Hotel-Restaurant type liquor license,
an investigation has been made and based on the results thereof the following has
been determined:
1.APPLICATION PACKET
Responsive to C.R.S. §44-3-311(1) and BLA Rules of Procedure Section 4-3, the
applicant, as stated above, submitted an application packet, which was
substantially complete, to the City Clerk's Office on December 20, 2021.
2.PREVIOUS DENIALS AT THE SAME LOCATION
Responsive to C.R.S. §44-3-313 (1)a et seq. and BLA Rules of Procedure, Subsection
5-1-1 (A), as this is an application for a malt, vinous, or spirituous liquor license, that
within two (2) years, preceding the date of the application, the state or the
Authority have not denied an application for the same class of license at the same
location or within 500 feet of the same location, for the reason that the reasonable
requirements of the neighborhood and the desires of the inhabitants
were satisfied by the existing outlets. This requirement is not applicable to
applications for Bed and Breakfast Permits.
3.POSSESSION OF PREMISES
Responsive to C.R.S. §44-3-313 (1)b and BLA Rules of Procedure, Subsection
5-1-1 (B), it appears from the evidence submitted that the applicant is entitled
to possession of the premises where the license is proposed to be exercised
until May, 2026.
4.ZONING AND HEALTH DEPARTMENT REGULATIONS COMPLIANCE
Responsive to C.R.S. §44-3-313 (1)c and BLA Rules of Procedure, Subsection 5-1- 1
(C), selling alcohol in the manner proposed in the application is not in violation of
any zoning laws of the City of Boulder and the use is consistent with the location’s
permissible planning conditions and zoning district. The applicant must meet all
applicable laws, rules and regulations of the City’s Planning Department as to
construction and building safety requirements at the premise, and if applicable,
the Boulder County Health Department and the State Board of Health for food
preparation and service.
5.PROXIMITY TO SCHOOLS
Responsive to C.R.S. §44-3-313 (1)d et seq. and BLA Rules of Procedure,
Subsection 5-1-1 (D), the building in which the liquor is to be sold has a local
distance waiver enacted or is not located within five hundred (500) feet of any
public or parochial school or the principal campus of any college, university or
seminary. This requirement is not applicable to applications for Bed and Breakfast
Permits.
6. EXISTING OUTLETS IN DESIGNATED NEIGHBORHOOD

Boulder, LLC (Member), Eat at Home, LLC (Managing Member), Board and Betty, LLC
(Member), Mighty Little Markets, LLC (Managing Member), and Ashkara II, LLC
(Managing Member).
Eat at Home, LLC d/b/a River and Woods was cited for a modified premise violation on
11/24/2020 for an issue regarding service from June, 2020 through September 2020. A
10-day suspension was served. This license was also served a 2-day suspension for
service to a minor in June, 2018.
Jeff Suskin has previously held interest in the following Colorado liquor licenses: H
Burger Boulder, LLC; H Burger Denver, LLC; and Taco Denver, LLC.
Mr. Suskin currently holds interest in the following Colorado liquor licenses: Taco
Boulder, LLC; Ashkara II, LLC; and Might Littler Markets, LLC
Amanda Perkins has not held interest in any liquor licensed premise, but has over 15
years of manager experience in multiple liquor licensed premises'.
8. APPLICANT FINANCIAL INTEREST
Responsive to C.R.S. §44-3-308 and BLA Rules of Procedure Subsection 5-1-1 (G),
the applicant’s financial interest and associated parties disclosures are to be found
in the submitted city of Boulder BLA Financial Statement with attachments, the
submitted Colorado Liquor Retail License Application or Colorado Fermented Malt
Beverage License Application with attachments, and the submitted Individual
History Record with attachments. A copy of each of these mentioned documents
should have been retained by the applicant at the time of application and a copy
of these mentioned documents will be provided to the BLA for the purposes of
local licensing authority deliberations.
9. NEEDS AND DESIRES EVIDENCE
Responsive to C.R.S. §44-3-312 (2)(a) and (b) and BLA Rules of Procedure Section
4-1 through Section 4-4, the applicant is reminded that they have the burden of
proof to provide to the Authority for consideration sufficient evidence confirming
that the adult residents and business owners and managers within the prior
established boundaries of Authority designated Neighborhood both need and
desire the proposed new liquor license in type, manner and location.

1. Describe the nature of the proposed establishment and the target market (i.e., restaurant, tavern,
sports bar, families, college students, etc.). Please attach a menu for BLA.
Driftwind will be a restaurant, bar, and event facility at the Boulder Reservoir. It is a public/private partnership
with the City of Boulder, designed to offer access to all park visitors during the "season" (Memorial Day to
Labor Day), and to create new engagement to the site in the evenings and "off-season" via creation of a
destination restaurant and event facility.

bar with reservoir views. Happy hour and evening menu will include items like lobster rolls, crab cakes, a
variety of salads and grilled items. A sample menu is attached.
2. What are the proposed hours and days of operation for this establishment?
Subject to the limitations of the operations/management plan written in conjunction with and approved by the
city, hours from up to 7am-12am, daily. Current operations plan is attached to this application.
Expected regular hours of operation will vary seasonally and dependent on public activity at the reservoir, but
-9pm weekdays and 10pm weekends. (Per operation agreement,
any hours later than 9/10pm are for private event only and must be approved prior to event.

3. What is the seating capacity of the establishment?

Yes.
6. How many individuals will be employed at this proposed establishment and how many will be full-time
versus part-time?
In season, approx. 10 full time, 20 part time; Off season, appox 5 full time, 10 part time.
7. Describe your past training and experience in the sale/service of alcohol beverages, include any special
or certified training received.
We own several restaurants/bars in Colorado, and one in Idaho. We are members of RAR and ensure that all
staff is TIPS trained. We have operated several special and private events of sizes ranging from 25-5000+
guests at this specific location during the 2021 season.
8. Describe your proposed Registered Manager of past training and experience in
the sale/service of alcohol beverages, include any special or certified training received.
Our registered manager has 15+ years of experience running large restaurants and bars in New York and
Colorado and has served as a leader and Operations Director with our group at our stores in Boulder and Golden
for the past year. She is TIPS certified, has trained multiple bar staffs, and is well-versed in all aspects of
alcohol sale and service.
9. Besides the state-certified Responsible Vendor classes, what other types of training are proposed for
employees at this establishment in the safe and legal sale/service of alcohol beverages?
All staff dealing in the sale or service of alcohol will receive a handbook particular to alcohol service at the
reservoir and will be tested on knowledge of the handbook. Additionally, we will perform regular spot-checks
for ID checking, employ a third-party verification service, provide regular alcohol education seminars and
special training with Nathan Dewey of RAR. We have and will continue to meet with city and county police to
document and update best practices specific to the unique location and operations and ensure that these are
listed in the handbook as well.
We train staff to be able to be able to spot visual and verbal cues (slurred speech, unnatural volume, impaired
movement), to ask questions, and to immediately cut off or refuse service to anyone who appears overly
intoxicated. We follow all guidelines of the training organizations. Particular to the proposed controlled
premises in this application is the adjacency to the public park which allows for open container consumption.
We will take additional precaution by training staff to identify guests who may not have yet been served by our
bar but may have been consuming elsewhere in the park.
11. What policies & procedures do you have in place to refuse service to a patron?
See above. Staff is trained to politely refuse to serve a visibly intoxicated patron, and in the case of this
particular location, to ensure a safe ride home, either via ride-share, taxi, or a designated driver. Non-alcoholic,
non-caffeinated beverage and/or food alternatives will be offered. Please see alcohol policy for additional policy
description.
12. Describe any other types of training or operating procedures that employees will be following in the
day-to-day operation of this proposed establishment?
Because of the large outdoor area, we will train staff to monitor the boundaries of the liquor licensed area,
ensuring that no alcohol leaves the area, and that no outside alcohol enters. During busy times and events we
will utilize a braceleting system to more easily identify those who have shown proper ID. We will close off the
of the outdoor premise to the north of the patio when it is not in use and monitor to ensure that
no one enters the clearly fenced boundaries of the area. We will work in concert with the reservoir staff, and
work to ensure safe travel for guests leaving the premises. We will partner with a ride-share and/or taxi
company (for insantce, utilizing the Z-Trip ride credit program through RAR), and actively promote designated
driver incentives.
13. What methods will be used in checking identification for proper age of patrons (at the door, at the
bar, etc.) and how will underage patrons be identified so as not to be served alcohol beverages (stamp,
mark on the hand, etc.)
Our servers and bartenders are trained to card everyone, regardless of age. We do not accept vertical IDs
without manager verification. We will only serve one drink per visible ID. During events or other any other
times with large capacity, we will utilize wristbands for those over 21. A copy of the ID Guide will be available
for out of state IDs. Glassware will be identifiable to protect from outside beverage coming into the controlled
premises.
14. What types of entertainment will be offered, if any, at this proposed establishment (i.e., music, pool,
darts, etc.)?
We will offer live music and a variety of outdoor games (such as cornhole, bocci, etc). An automatic sound
monitoring system has been set up to ensure all noise ordinances are followed. The system sends real time alerts
to staff and records instances when sound limits are exceeded. Entertainment is also governed by the operations
plan attached to this application.
15. Do you plan to have any exterior amplified sound?
Yes.
16. What types of security, if any, will be provided at this proposed establishment?
We will have security monitoring the premises, particularly the outdoor premises, during public events and
times of high traffic. We will engage a third party security company and/or hire off-duty Boulder police as
necessary based on volume and need. We will work in tandem, during the season, with the Parks & Rec staff to
ensure the quiet enjoyment and safety of all guests. Any large events on premise (over 250) must be pre-
approved by Reservoir staff per the operations plan, so any large event will need its own vetted management
plan.
17. What time will your kitchen close each night? Describe your food service plans after your kitchen
closes.
Food from the kitchen will always be available while the bar is open, with proposed hours as outlined in
question #2.
18. What is the estimated ratio of food to alcohol beverage sales at this establishment?

19. If you have an outside patio, what additional means of control will you employ?
The patio itself is clearly delineated from the adjacent areas. A rope and string lights will further enclose the
patio area. The patio flows to additional , which
is a large, controlled outdoor space. The boundaries of the
snow fence, and will be closed off entirely when not in use (and monitored by line of sight to ensure no access.
Clear signage will be placed at all ingress/egress, and we will utilize security staff as needed. We will have line
of sight on all controlled areas at all times. The entire park is enclosed by fence and gates after hours.

best practices and keep them, along with the city staff, informed of events as early as they are planned.

Driftwind Operations Overview
Boulder Parks and Recreation (BPR) manages all areas of the Boulder Reservoir with a balance
of preservation and recreation as outlined in the vision from the Boulder Parks and Recreation
Master Plan. This operation overview outlines 2021 operation agreements between BPR and
Driftwind Restaurant. Per clause 3.B of the lease, this document must be complied with by both
parties.
These agreements apply to 2021. Data and feedback will be collected throughout the season
and considered in the After-Action Review (AAR) conducted each fall. The AAR is how the city
applies an adaptive management approach to resource protection and enhancement as
outlined in the Boulder Reservoir Master Plan. An adaptive management approach involves the
ongoing monitoring of resource conditions, assessment of the effecti veness of management
actions, revisions of management actions based on new information from research and learning
from experience.
HOURS OF OPERATIONS
Driftwind’s regular hours of operation for 2021 are 9:00 a.m.- 9:00 p.m. Monday - Thursday and
9:00 a.m. - 10:00 p.m. Friday - Sunday. There may be fluctuations based upon the season or
private events. Incoming gates will close by 9:00 p.m. every day (except for taxi and/or
rideshare).
EVENTS
Private Events - Private events facilitated by Driftwind are allowed through the Lease, with
requirements to ensure they are a value-add for the community and minimize impacts on the
site or neighbors. These events are governed by City of Boulder regulations, Boulder Parks and
Recreation policies, the Lease and this Operations Overview. Private events must end by
midnight per the Lease. Private events that are allowed with no additional permission from the
city include:
• Do not require any noise variance for additional amplified sound;
• Do not require support from City staff (e.g. any activity past 9:00p.m.); or
• Do not exceed 200 attendees.
Special Events - Special events are governed by all requirements of the City of Boulder Special
Events Guide. Reservoir specific requirements are outlined in Appendix A.
All Medium and Large Special Events (those with over 200 participants) are posted on the City
of Boulder website by May 15. This list is updated regularly to reflect any changes. This listing

includes impacts to the site based on the type and use requests of the host organization
through the Special Event application process.
SOUND
All sound will adhere to the City of Boulder noise ordinances. In addition, and more restrictive
than the city ordinance, o utdoor speakers will be turned off at 9:00 p.m. Monday-Thursday and
10:00 p.m. Friday-Sunday.
Staff will monitor and record sound levels throughout the year at various times, at multiple
locations throughout the site and during a variety of uses. Data collected will include:
• Location of measurements
• Decibel Level
• Time and Date of Measurements
• Activity/Use (special event, private event, general restaurant operations)
This data will be considered as part of the AAR.
LIGHTING
All lighting at the facility will continue to be compliant with the City of Boulder’s lighting
ordinance.
SAFETY
All Driftwind staff will be trained in Boulder Reservoir Emergency Action Plans. A city of Boulder
employee will be onsite anytime members of the public are at the Reservoir.
Alcohol – Alcohol is allowed at the Boulder Reservoir under the Boulder Revised Code, which
excludes the South Shore from the city’s ban on open containers of alcohol in public. In
addition, Special Events may include alcohol with approval through the city’s Special Events
process.
No alcohol is allowed in swim area at any time. This is enforced by Parks and Recreation staff on
the swim beach during the hours that the swim beach is open.
Driving under the influence of alcohol is illegal. Both Driftwind and Parks and Rec reation are
committed to supporting safe consumption, including working with the Sheriff’s Office,
incentivizing ride share/taxi, and promoting designated drivers.

Any employee involved in the service of alcohol is required to be TIPs certified and to present a current proof of
certification to management. It is the Company's policy and state law that no minor or intoxicated person shall be
served alcoholic beverages. Employees who willfully violate this policy will be terminated immediately. Any employee
who negligently serves a minor or an intoxicated person will be counseled on proper service technique, may be
terminated based on the particular situation and will be terminated regardless of the situation on any subsequent
violation of this policy.
Employees must card anyone ordering an alcoholic beverage regardless of age. If a guest is visibly over the age of 40
and does not have proper ID, ONLY a manager may allow the service of alcohol. Any guest who appears under the
age of 40 shall not be served without proper ID. Any vertical IDs must be approved by a manager before service of
alcohol. Any questions on out of state or alternative IDs should be referred to a manager before the service of
alcohol. Only managers are permitted to make judgement calls on service to any guest where this is a question of age
or level of intoxication. If a manager is not available for any reason, always err on the side of a refusal of service. The
business, and you personally, can be held legally and criminally liable in the case of an error.
When attempting to illegally purchase alcohol, minors usually exhibit behavior that should be easily identifiable by
the astute server or seller. As with anyone who is attempting a dishonest act, minors may appear anxious or nervous;
stutter, stammer or confuse their words; avoid eye contact with the seller; appear overly or inappropria tely friendly,
confident, boisterous or outgoing.
When serving alcohol to our customers, you should take reasonable precautions. Taking steps to prevent alcohol
abuse in our establishment can help protect the public from harm, and keep you from being name d in a liquor
liability suit.
As an alcohol server, you should know the laws and regulations concerning the serving and consumption of alcohol
within licensed premises. Serving under-aged and intoxicated persons is unlawful and can have criminal penalties.
Furthermore if an intoxicated person, after leaving our establishment, should be involved in an accident the injured
parties may file a lawsuit against you.
Follow some simple guidelines when serving alcohol and prevent this from happening to you. Serve one drink at a
time; never bring two or three drinks at once to a single person. . If someone arrives or begins to show any sign of
over consumption of alcohol, it is your job to make sure you do not over serve the individual. In situations when
wristbands are being utilized, be sure to confirm the wristband is in place and only serve one drink per wristband.
The following are some suggestions of ways to slow down consumption if you suspect there is a possibility of over
serving an individual or group:
Offer or suggest the sale of protein food or appetizers. Do not offer coffee or other caffeinated drink; this may cover
the true extent of the patron's intoxication. Suggest non-alcoholic content or filling drinks such as ice cream drinks.
Serve water or fruit juices with all straight drinks. Despite all your best efforts, a customer may become intoxicated
and should not be served additional alcohol. If this occurs, every effort should be made to stop alcohol service. Here
are some suggestions to use when “cutting off” a customer.
• Avoid a confrontation.
• Do not attempt any physical confrontation.
• Make the manager and all personnel aware of the problem.
• Bring menus to the guest or casually suggest an appetizer.
• Suggest an alternative form of transportation. If the patron insists on driving report this to a
manager at once.
It is essential that a manager be aware of any potential situation where you believe there is a chance of over serving
a guest. Remember, if a guest is over served and leaves the restaurant and hurts someone, the authorities will hold
YOU responsible along with the management of the restaurant. It is not inconceivable that YOU could be called to
court and even serve jail time. Always remember-there is no reason over service should occur. Use your own
“common sense” as well as what you have learned in your TIPS Server Certification course and the above helpful
hints, and there should never be a problem.
Outdoor alcohol control and service measures at the Boulder Reservoir are of particular concern because of the
unique nature and unusual size of the space, the adjacency to the open container policy throughout the rest of the
park, as well as the added dangers associated with recreating around water.
IT IS OUR MORAL AND LEGAL RESPONSIBILITY TO KEEP GUESTS OF THE PARK AND OUR ESTABLISHMENT SAFE!
In addition to our rigorous standard of care, all staff must fully understand the boundaries of our liquor license, which
will be clearly marked via visible natural boundaries, fences, and other barriers, as well as clear signage.
• Absolutely no open alcohol obtained from our establishment, may leave these boundaries, and absolutely no
outside alcohol is permitted inside the boundaries.
• All guests will be served beverages in specific (non-glass) cups, so any beverages being consumed from any
other receptacle should be immediately confiscated.
• Staff will monitor the perimeter and entirety of our controlled premises and alert management of any issues
as a first priority.
• Staff will work with Parks & Rec staff to establish and execute a control plan and establish times when
additional staffing and/or security is required to maintain public safety and control consumption within the
boundaries of the licensed area.

Written Statement
Overview Landloch, LLC, DBA DriftWind, has executed a lease with the City of Boulder to operate a full service restaurant, bar, event space and concession at the Boulder Reservoir. Landloch will operate both “in-season” (Memorial Day to Labor Day) and “off-season” (Labor Day to Memorial Day), at all times with respect to the rural nature of the park, the quiet enjoyment of neighbors, and an enhancement to the experience of park visitors. With a mission and directive of “access to all,” the leased premise will be available to the public, who will use the space as a public park amenity. The premises may also be utilized for private events such as weddings, bar mitzvahs, and corporate events. Utilizing the precedence set at the Flatirons Golf Course with the public/private partnership between Spice of Life and the City, Landloch, LLC will provide this amenity to boaters, swimmers, and any other visitors. Landloch, LLC is leasing a portion of the building, as outlined in the Premises Diagram, which includes a full commercial kitchen, restaurant, bar and patio. The balance of the building will house Boulder Parks & Recreation admin offices and staff meeting areas. Landloch, LLC is also being granted a license to possess and control additional outdoor area, as depicted in Exhibit A (attached to this application), for the purpose of selling and servicing alcohol.
“In-Season” Daytime: From Memorial Day-Labor Day, while the Reservoir is formally open to the public, Landloch may offer morning coffee service, source food trucks from 11am-5pm (in compliance with applicable liquor ordinance and health codes), and augment these offerings with concession food from the kitchen for those visiting the park. Acoustic music, outdoor games, and other activations appropriate to the setting will promote responsible consumption and provide new reason to visit the newly renovated area. A focus on sustainability in sourcing and zero-waste will always be front and center to the mission. Evening: Beginning at 4pm, the space will shift into a full-service restaurant and bar, featuring a rotating menu of “elevated summer fare” from acclaimed chef Daniel Asher (River and Woods, Ash’Kara). Special events will be promoted from time to time in coordination with Boulder Parks & Rec, and the space will be available for private events.

The premises will likely be closed during the day in the off-season except for special and private events. Dinner service and tap room hours will shift to evening only. The same seasonally-inspired continental and seafood menu will be served. Outdoor Area: The proposed liquor license boundary is outlined in Exhibit A of the Boulder Reservoir property and leased premises, attached to this review request. The area includes both the outdoor patio (as drawn in the Premises Diagram attached) and a portion of the adjacent “yard” to the north of the property. Prior ADR approval included the swim beach, playground, and a larger parcel of the yard, but those areas have been removed from this version in an effort to eliminate confusion of premises on the public beach and allow for permanent fence boundary as opposed to relying on natural boundaries such as the water line to delineate the controlled premises. The enclosed outdoor area will be controlled via obvious permanent 4’ wooden snow fence as well as staff, outside security (when necessary), clear signage, and other barricades, designed to be both obvious to visitors and natural to the rural nature of the area. Prior to the proposed liquor license, this entire area was open to common consumption. All restaurant/café staff will be carefully trained and monitored with regard to the safe service of alcohol, ensuring compliance at all times with all applicable laws, and with a focus on the safety of guests. The redlined area is designed to be fully in line-of-sight from the patio and outdoor bar area of the facility. Sustainability and Community: In partnership with the city, a zero waste program will be implemented. All of our restaurants focus on sustainable and local sourcing as well as community involvement, and the lease at the Boulder Reservoir will allow us to amplify this mission. We will, as always, focus on being good neighbors, continuing to work with and listen to neighborhood concerns. As we do with all of our establishments, we will look to partner with local non profits and community organizations with a focus on making the Reservoir a hub of Boulder engagement and gathering. Sound is monitored in real time with enhanced sound monitoring equipment which was installed in 2020 to ensure compliance with all applicable ordinances. Parking: The City of Boulder provides on-site parking adequate to the proposed use for the entire park. There are a number of parking areas at the South Shore of the reservoir with a total capacity of approximately 3,000 vehicles. A majority of these parking areas are unpaved surfaces with a gravel or grass surface and used for overflow with larger special events (e.g. IronMan). The paved lots are primarily for autos and are located near the Visitor Services Center and the Boat House building. Hours of Operation Summary: The hours of operation are governed by a city-designed operating plan, which includes regular in-season hours of 9am-9pm Mon-Thurs and 9am-10pm Fri-Sun. Hours may be extended for private events up until midnight with prior approval of the landlord, as long

To Whom It May Concern
Multiple neighbors surrounding the Boulder Reservoir asked that I pen a letter to the Beverage Licensing Authority to address
Josh Dinar’s ‘character’ in anticipation of him obtaining another liquor license. Based on my personal experience living behind
Dinar’s restaurant known as River & Woods, and my personal interactions with him, I hold the opinion that Dinar lacks the
good moral character necessar y to obtain a liquor license at the Boulder Reser voir.
Under Regulation 47-310(e)(1), the BLA is tasked with deter mining whether Josh Dinar:
[K]knowingly submitted false applications, made willful misrepresentations and/or
knowingly committed fraudulent acts.
The following instances demonstrate that Josh Dinar flunks this standard:
●FALSE APPLICATION – River & Woods Minor Modification
○Dinar represented to the Planning Board, and by extension the BLA, that he would not “create
a concert venue of any kind” at River & Woods.
○Diner knew this was false at the time he made this representation to the BLA in writing.
○In August of 2016, six months after his Use Review, Dinar submitted a minor modification to
build a “children’s play deck.”
○This was not actually a children’s play deck but instead, a concert stage.
○Dinar admits as much when inter viewed with the Boulder Daily Camera– “We’ve wanted to use
our cool little stage… ever since we built it four years ag o…” (emphasis added) (Josh Dinar quoted
by Kalene McCort for the Boulder Daily Camera, Published June, 11, 2020.)
○In short, Dinar told the BLA in writing that he did not intend to create a concert venue but
then told the Daily Camera years later that this was his intention all along.
●FALSE APPLICATION – River & Woods Beverage Application
○River & Woods submitted an application to the BLA claiming that the restaurant will not
“promote ourselves as a live music destination.”
○Diner knew this was false at the time he made this representation to the BLA– He intended to
create a concert venue when he submitted that application.
○Dinar told the Boulder Daily Camera that he “wanted to use our cool little stage…ever since we
built it four years ago…” and he “teamed up with entertainment booker Mike Ligon to ensure a
rotating selection of acts take the stage this summer.” (emphasis added) (Josh Dinar quoted by
K alene McCort for the Boulder Daily Camera, Published June, 11, 2020.)
○In short, Dinar told the BLA in writing that he did not intend to promote River & Woods as a
live music destination but he knew this was untr ue at the time he made that representation. He
later admitted his intention from the ver y beginning was to use the concert stage that he built
under the guise of a “children’s play deck.”
●FALSE APPLICATION – City Questionnaire (Liquor License at River & Woods)
○To receive a liquor license at River & Woods, Dinar was required to submit a City Questionnaire. The
Questionnaire asked: “What types of entertainment will be offered, if any, at this proposed establishment (i.e.,
music, pool, darts, etc.)?” (Hearing Packet, pg 436, question 14). The restaurant answered, “There may be
some live acoustic music, though it will not be offered nightly.”(Hearing Packet, pg 338, answer 14, emphasis
added).
○This turned out to be false on three fronts:
■First, Dinar’s restaurant was open 6 nights per week and Dinar offered music 6 nights per week. This
shows that his representation was false– music was, indeed, offered “nightly.”
■Second, the River & Woods website boasted that the restaurant was hosting a “party ever y night.”
This shows that the restaurant knowingly hosted “nightly” music.
■Third, the music was not acoustic; it was amplified as Dinar readily admitted during his show-cause
hearing before the BLA regarding the same.
●WILLFUL MISREPRESENTATION – River & Woods Beverage Application
○River & Woods was required to submit a Zoning/ Planning Confirmation For m as a
prerequisite to obtaining a beverage license at River & Woods. On said form, Dinar wrote,
“Accessible parking space and loading space not to be used for restaurant or service area.”
(Hearing Packet, pg 450).
○Dinar eventually utilized both the accessible parking space and the loading space as restaurant
and ser vice areas.
○Specifically, Dinar parked an unlicensed bar trailer on top of his designated accessible parking
space and loading zone.
○He was subsequently sanctioned for this conduct by the BLA at a show-cause hearing. The
evidence at that hearing shows that Dinar misrepresented his intentions to the BLA when he
submitted that application.
●WILLFUL MISREPRESENTATION – September 13, 2020 Letter to the BLA
○Dinar wrote a letter to the BLA claiming that only one neighbor complained about River and Woods/ one
neighbor reached out to him directly for not following the Use Agreement and/or violating the Liquor Code.
○Dinar knew this was false when he submitted this letter to the BLA.
○Numerous neighbors including Anna Grafov, Lisa Hilmes, Matt Hayden, and Krystin (unknown last name)
reached out to Mr. Dinar on social media, and made numerous phone calls/ left phone messages with the
restaurant. Dinar did not return any of these phone messages or otherwise respond to the private social
media messages.
○Dinar knew or should have known that numerous people reached out to his restaurant.
○All of these contacts took place before those same people submitted written and verbal testimony to the BLA
and Planning Board.
○In short, Dinar told the BLA in writing that he was only aware of one neighbor that wanted to hold him to
his Use Agreement and the Liquor Code. Dinar knew this was false at the time he put it in writing and
submitted it to the BLA.
Thank you for the opportunity to provide specific and provable instances of how Josh Dinar unequivocally fails to meet
the statutor y criteria of obtaining another liquor license. Please do not hesitate to reach out should you have further

The Parties in Interest listed below ask the Authority to retain the 1 mile
neighborhood boundary set for the same application last year.
The BLA Rules of Procedure provide:
CHAPTER 4 PREHEARING ACTIONS AND DETERMINATIONS
Section 4-1 Neighborhood Boundaries
Upon receipt of a completed application, the Authority shall establish the
neighborhood boundaries for the application at the next available regular
meeting. The boundaries will typically include an area of not less than a one-half
(1/2) mile radius around the proposed establishment. In addition, factors
including, but not limited to, zoning boundaries, land use designations, traffic
flow, access roads, demographics, size of establishment, natural and human-
made barriers, and consideration of other similar licenses in the area proposed
may also be considered by the Authority in determining the neighborhood
boundary. Any reference in these Rules to "Neighborhood" shall refer to the
Neighborhood designated by the Authority pursuant to this Section 4.1
Subsection 4-1-1 Objections to Neighborhood Boundaries
An applicant or other Party in Interest may object to the boundaries as
established by the Authority. Objections to Neighborhood boundaries must be
made at the same Authority meeting during which the boundaries are
established. [emphasis added]
This conforms to the standards set out by the Colorado Supreme Court:

“This is the first time that we have had occasion to judicially define a
neighborhood. It appears to us that its common usage signifies nearness as
opposed to remoteness, viz., in the immediate vicinity. It connotes a congeries of
local interests arising from a problem confined to a limited area . . .” Cloverleaf
Kennel Club v. Board of County Com'rs, 319 P. 2d 487 at 489 Colo Supreme
Court 1957. [emphasis added]
“The geographic extent of the neighborhood will vary from case to case,
depending on the circumstances . . .” Board of County Com'rs of Boulder County
v. Johnson, 460 P. 2d 770 at 771 Colo Supreme Court 1969.
Since January, 2019 this Authority has generally set Hotel and Restaurant
neighborhood boundaries no more than 1 mile from the applicant, and has never gone
as far as 1.2 miles. While the covid emergency rule was in place all boundaries were set
at a default 1 mile radius. The attached table shows the other boundaries set since
January, 2019.
Last year this Applicant (Landloch, LLC) applied for the same license at the same
address. February 17, 2021, this Authority set the neighborhood boundary at the default
radius of 1 mile. One mile was a good boundary last year and remains a wise choice
this year.

Boulder Liquor Authority,
This letter is in reference to the liquor application submitted by Driftwind and Josh Dinar to
host special events and serve alcohol at the Boulder Reservoir restaurant location. I’d like to
voice my full support.
I’ve been a patron of Boulder Reservoir since the mid 90’s, participated in the CU crew team
and have owned and operated Rocky Mountain Paddleboard at Boulder Reservoir for 10 years.
Boulder Reservoir is a very special place and I consider myself incredibly fortunate and honored
to be a part of such an amazing community of people. I’ve worked hard in partnership with the
City of Boulder to build safe, inclusive, low-impact and community driven offerings at the Res.
We strive to create unique experiences for families, friends and co-workers. Our goal is to
facilitate a space that encourages people to safely recreate outdoors with their friends, family
and neighbors, appreciating all the reasons we live where we do.
I have personally known Josh Dinar for over 10 years, he represents the best of the best and is
one of the most conscientious, ethical and driven restaurateurs in Boulder. He shares a vision to
build community through unique and memorable experiences. I couldn’t be happier to have
him at Boulder Reservoir, I have every confidence he’ll create a truly spectacular venue for our
community. I am excited to see his hard work and investment into the Reservoir realized into
what will undoubtedly be an incredible resource and experience for the good people of
Boulder.
We are working hard to create smaller, catered events that allow people to truly enjoy all
Boulder Reservoir has to offer. Facilitating outdoor recreation is so important now, more than
ever; creating ways to unite our community as we enjoy all the beauty around us and break
bread with our neighbors again. We have a lot of excitement and anticipation surrounding our
partnership with Driftwind for our Evening at the Res events. This event comes complete with a
luxurious pontoon tour of the Res, a fun paddle to swim beach and a curated dining experience,

along with signature sheets and a map of the proposed location and other documents
provided by Boulder Licensing Clerk. The circulators used tally sheets to record all
contacts, attempts and reasons for signatures either in favor or refusal. Upon conclusion of
the survey, the circulators signed notarized affidavits of circulation. The original survey

Dear Liquor License Applicant:
Before approving a liquor license application, the Beverage Licensing Authority (BLA) must consider the
reasonable requirements of the neighborhood and the desires of the adult inhabitants as evidenced by petitions,
remonstrances, supporting witnesses or other evidence submitted by the applicant and by residents and business

door to possible petition signers, Petition Summary to total your results, Neighborhood Map, Existing Licenses
List, and an Affidavit of Circulator. You will need to make copies of all enclosed documents including color copies
of the Neighborhood Map. You will need to make sufficient copies of both the Resident petition form and the
Business petition form to collect the signatures necessary to prove to the BLA that application approval is in order.
The BLA does not specify a certain number or percentage of signatures that must be acquired; they do expect to
see that a good sampling of both residences and businesses in the neighborhood was obtained.
Petitions must be circulated within the neighborhood boundaries established by the BLA and outlined on the
Neighborhood Map. Each door to door petitioner must carry and show at the door a color copy of the
Neighborhood Map and a copy of the Existing Licenses List along with blank signature pages of both the Business
petition and Resident petition forms.
An individual signing a petition must include his or her first and last name. Each signature and accompanying
address must be legible. For resident petitions, all persons signing must be at least 21 years of age and reside in
the defined neighborhood. For business petitions, all persons signing must be at least 21 years of age and own
and/or manage a business in the defined neighborhood.
Each petitioner who has collected petition results door to door must submit a signed and notarized Affidavit of
Circulator. Failure to affix a completed affidavit of circulator, including notarization, may cause petition invalidity
concerns to be raised by the Authority.
Petitions circulated outside the neighborhood boundaries shall not be considered. Please also note that only door
to door petitions will be considered by the BLA.
If the BLA determines that the petitions submitted are insufficient to support a finding that: (1) the reasonable
requirements of the neighborhood establish a need for the issuance of the requested license, and (2) that the
desires of the adult inhabitants dictate the issuance of the license, the BLA may either deny your application or
continue your hearing an additional month or more to allow you time to conduct more petitioning.
As such, full adherence to these procedures, completion of petition documentation, sufficient signatures
collection, and timely submittal of petition results is important for your license application.
At the conclusion of petitioning, please complete the Petition Summary and submit with your petition
materials and affidavits of circulator to the City Licensing office. Your petition materials are due
via email to licensingonline@bouldercolorado.gov by 12:00pm on Tuesday, February 22, 2022.

Written Statement
Overview Landloch, LLC, DBA DriftWind, has executed a lease with the City of Boulder to operate a full service restaurant, bar, event space and concession at the Boulder Reservoir. Landloch will operate both “in-season” (Memorial Day to Labor Day) and “off-season” (Labor Day to Memorial Day), at all times with respect to the rural nature of the park, the quiet enjoyment of neighbors, and an enhancement to the experience of park visitors. With a mission and directive of “access to all,” the leased premise will be available to the public, who will use the space as a public park amenity. The premises may also be utilized for private events such as weddings, bar mitzvahs, and corporate events. Utilizing the precedence set at the Flatirons Golf Course with the public/private partnership between Spice of Life and the City, Landloch, LLC will provide this amenity to boaters, swimmers, and any other visitors. Landloch, LLC is leasing a portion of the building, as outlined in the Premises Diagram, which includes a full commercial kitchen, restaurant, bar and patio. The balance of the building will house Boulder Parks & Recreation admin offices and staff meeting areas. Landloch, LLC is also being granted a license to possess and control additional outdoor area, as depicted in Exhibit A (attached to this application), for the purpose of selling and servicing alcohol.
“In-Season” Daytime: From Memorial Day-Labor Day, while the Reservoir is formally open to the public, Landloch may offer morning coffee service, source food trucks from 11am-5pm (in compliance with applicable liquor ordinance and health codes), and augment these offerings with concession food from the kitchen for those visiting the park. Acoustic music, outdoor games, and other activations appropriate to the setting will promote responsible consumption and provide new reason to visit the newly renovated area. A focus on sustainability in sourcing and zero-waste will always be front and center to the mission. Evening: Beginning at 4pm, the space will shift into a full-service restaurant and bar, featuring a rotating menu of “elevated summer fare” from acclaimed chef Daniel Asher (River and Woods, Ash’Kara). Special events will be promoted from time to time in coordination with Boulder Parks & Rec, and the space will be available for private events.

The premises will likely be closed during the day in the off-season except for special and private events. Dinner service and tap room hours will shift to evening only. The same seasonally-inspired continental and seafood menu will be served. Outdoor Area: The proposed liquor license boundary is outlined in Exhibit A of the Boulder Reservoir property and leased premises, attached to this review request. The area includes both the outdoor patio (as drawn in the Premises Diagram attached) and a portion of the adjacent “yard” to the north of the property. Prior ADR approval included the swim beach, playground, and a larger parcel of the yard, but those areas have been removed from this version in an effort to eliminate confusion of premises on the public beach and allow for permanent fence boundary as opposed to relying on natural boundaries such as the water line to delineate the controlled premises. The enclosed outdoor area will be controlled via obvious permanent 4’ wooden snow fence as well as staff, outside security (when necessary), clear signage, and other barricades, designed to be both obvious to visitors and natural to the rural nature of the area. Prior to the proposed liquor license, this entire area was open to common consumption. All restaurant/café staff will be carefully trained and monitored with regard to the safe service of alcohol, ensuring compliance at all times with all applicable laws, and with a focus on the safety of guests. The redlined area is designed to be fully in line-of-sight from the patio and outdoor bar area of the facility. Sustainability and Community: In partnership with the city, a zero waste program will be implemented. All of our restaurants focus on sustainable and local sourcing as well as community involvement, and the lease at the Boulder Reservoir will allow us to amplify this mission. We will, as always, focus on being good neighbors, continuing to work with and listen to neighborhood concerns. As we do with all of our establishments, we will look to partner with local non profits and community organizations with a focus on making the Reservoir a hub of Boulder engagement and gathering. Sound is monitored in real time with enhanced sound monitoring equipment which was installed in 2020 to ensure compliance with all applicable ordinances.
Parking: The City of Boulder provides on-site parking adequate to the proposed use for the entire park. There are a number of parking areas at the South Shore of the reservoir with a total capacity of approximately 3,000 vehicles. A majority of these parking areas are unpaved surfaces with a gravel or grass surface and used for overflow with larger special events (e.g. IronMan). The paved lots are primarily for autos and are located near the Visitor Services Center and the Boat House building.
