Emergency Order 2020-20 Self-Quarantine Emergency Order 2020-20 CITY OF BOULDER ORDER RELATED TO DECLARATION OF LOCAL DISASTER EMERGENCY A disaster emergency was declared by the city manager on March 14, 2020. At the March 16, 2020 special council meeting, city council confirmed and extended the emergency declaration until further notice. Pursuant to Section 2-2.5-7 “Powers,” B.R.C. 1981, the city manager finds a need to issue this Order in order to protect the health, safety and welfare of persons or property within the city or to otherwise preserve the public peace or abate, clean up or mitigate the effects of any disaster emergency. 1. All individuals residing in the Subject Property, as defined in Section 2 below are ordered to self-quarantine. Residents in self-quarantine should remain at their place of residence for the next two weeks other than to attend in-person instruction, labs, research activities, and intercollegiate athletic training. They may also leave their homes to work (including taking children to childcare to allow for work or study) or to obtain food (delivery or curbside pickup), medicine, medical care, or supplies that are needed to sustain or protect life when such cannot be obtained by delivery. In addition, residents may participate in personal recreation, by themselves, provided that social distancing and face coverings are worn at all times. If a resident in self-quarantine leaves the place of residence, the resident shall wear a face covering at all times. Properties with more than 10 unrelated persons living together shall separate from each other to avoid outbreaks among residents; if residents of the same building must come into contact, residents shall maintain six feet of distancing and wear a face covering. 2. Subject Property. The following properties are Subject Properties: a. 1125 10th Street, Boulder, Colorado. 3. This Order shall be become effective at 11:59 p.m. on September 16, 2020 and will continue until 11:59 p.m. on September 29, 2020, or until it is extended, rescinded, superseded, or amended in writing by the city manager. 4. All residents of the Subject Property shall submit a statement of residence, including the resident’s name and address via email to Residents@bouldercolorado.gov by 11:59 p.m. on September 17, 2020. No person shall be present at the Subject Properties who has not submitted a statement of residence for that property. No person shall report residence at a subject property who does not reside at the subject property. 4. If any provision of this Order, or its application to any person or circumstance, is held to be invalid, then the remainder of this Order, including the application of such part or provision to other persons or circumstances, shall not be affected and shall continue in full force and effect. To this end, the provisions of this Order are severable. This Order is necessary to prevent the assembly of large groups of people which will present a risk of infection during the disaster emergency. Once issued, this Order may be changed from time to time during the period of a declared disaster emergency based upon the discretion of the city manager. Enforcement: Pursuant to Section 2-2.5-8 “Adherence to Emergency Orders,” B.R.C. 1981, Police, code enforcement and such other law enforcement and peace officers as may be authorized by the city manager shall be authorized to enforce the orders, rules and regulations made or issued pursuant a declared disaster emergency. Notice: All members of the public shall be deemed to have been given notice of the restrictions contained within a declaration upon its dissemination to the news media or publication on city websites or by use of other means of publicity. Violation of Order: During the period of a declared disaster emergency, a person shall not: (1) Violate any of the orders duly issued by the city manager or designee pursuant to such declaration; or (2) Willfully obstruct, hinder or delay any duly authorized city officer, employee or volunteer in the enforcement or exercise of the provisions of this chapter, or of the undertaking of any activity pursuant to this chapter.
