Work in the floodplain will be limited to the installation of the artwork and realignment of the fences. The proposed artwork will be located on three island that sit above the 100-year water surface elevation within the conveyance and high hazard zones. The applicant has demonstrated compliance with the City’s floodplain regulations, including Conveyance Zone and High Hazard Zone restrictions. The project will not adversely impact nearby properties. A copy of the floodplain development permit and application materials is attached. This floodplain development permit was approved by Planning and Development Services staff on January 21, 2020, and the decision may be called up before Planning Board on or before February 6, 2020. Background and Design Summary Located along Boulder Creek the Boulder Civic Area (BCA) is a centralized location in downtown Boulder, Colorado that provides outdoor meeting and recreation opportunities for the community. The City of Boulder targeted the portion of the BCA from the Boulder Public Library downstream to upstream of Broadway as an area of open-air improvements along Boulder Creek. In the fall and winter of 2015, Tom Leader Studio (TLS) and JVA with the help of Anderson Consulting Engineers (ACE), developed an enhancement plan for the BCA. The enhancement effort for the BCA consisted of: (a) improving access to Boulder Creek; (b) adding picnic, play and open areas to improve public appeal; and (c) increasing the overall aesthetics of the area. To achieve these goals TLS’ design consisted of: (a) adding a nature play area along the right (south) bank east of the library; (b) regrading the left (north) bank area between Boulder Creek and the parking lot south of Canyon Blvd.; (c) removing the pedestrian bridge located downstream of the 11th Street Alignment; and (d) adding a new pedestrian bridge that is more closely aligned with 11th Street. Construction of the BCA enhancements were completed in March 2018. Following the completion of the enhancements within the BCA ACE was contacted by the artist Adam Kuby to provide hydraulic engineering support for a number of proposed sculptures throughout the BCA. Artist renderings of these proposed sculptures are attached to this letter. Data Collection The proposed sculptures will be located within various flood hazards associate with Boulder Creek, therefore; a City of Boulder (COB) floodplain development permit (FDP) is required prior to construction. ATTACHMENT A Agenda Item 4A Page 2 of 31 Ms. Christin Shepherd Page 2 of 5 January 20, 2020 BCA Sculptures FDP App_Jan 2020.docx The HEC-RAS Version 4.0, Boulder Civic Area LOMR hydraulic model used as the basis for this study was completed by ACE in March 2019. This model has been reviewed and approved by FEMA in October 2019 and represents the effective information with respect to flood hazards along the creek through the BCA, an approval letter for this Letter of Map Revision is attached to the end of this letter. Consequently, results from the ACE model were utilized to analyze potential impacts of the proposed improvements. The subject property is located within the 100-year floodplain, conveyance zone (CZ) and high hazard zone (HHZ) associated with Boulder Creek. It is noted that the total Boulder Creek 100-year discharge of 12,100 cfs through the project area, as identified in both the ACE and previously effective studies, results in a widespread 100-year floodplain for this reach of the creek. The BCA LOMR study geometry data is based on the King Surveyors Inc. January 2018 field survey. Hydraulic Analysis The proposed sculptures will be located within the Boulder Creek Flood Hazards (100-year Floodplain, CZ and HHZ); however, the proposed sculptures will be placed in areas as to not affect flood hazards. Placement of the proposed sculptures will occur in areas that are dry during a 100-flood event; therefore, these proposed sculptures will not adversely affect flood hazards. Additionally, the existing ground elevation will not be altered due to the placement of the proposed sculptures, i.e. following installation of the sculptures the area surrounding the sculptures will be returned to pre-project conditions. Figure 1 attached to this letter shows the proposed location of the sculptures and effective flood hazards. It should be noted, as part of this study, a more detailed 100-year floodplain, based on the 2019 LOMR model, was delineated. This floodplain includes three dry islands within the BCA where the proposed structures will be placed. These dry islands were not mapped as part of the BCA LOMR due to the FEMA recommended level of detail for floodplain hazard mapping. Table 1 provides a comparison of the ground elevations at the proposed sculptures to the 100-year water surface elevations. .100-year water surface elevations were determined from the BCA LOMR flood profile, an annotated flood profile showing the location and 100-year water surface elevation is attached. All three proposed sculptures will be placed in dry areas within the BCA therefore none of the structures will affect the Boulder Creek Flood Hazards. Required as part of the floodplain development permit application, to ensure that the BCA Sculptures meet the intent of the City of Boulder’s floodplain regulations, the fifteen (15) factors listed in the Boulder Revised Code 9-3-6 (d) have been met and addressed. Listed is the Boulder Revised Code 9- 3-6-(d) along with responses to the factors that were considered. Boulder Revised Code Section 9-3-6 (d) When reviewing an application for a permit, the city manager shall determine which portions of the floodplain are affected by the particular development request and shall then apply the provisions of Sections 9-3-2, "Floodplains," 9-3-3, "Regulations Governing the One Hundred-Year Floodplain," 9-3-4, "Regulations Governing the Conveyance Zone," and 9-3-5, "Regulations Governing the High Hazard Zone," B.R.C. 1981, as applicable. The manager also shall determine whether the application meets the intent of this chapter prescribed by Subsection 9-3-2(a), B.R.C. 1981, after considering the following factors: 1. The effects upon the efficiency or capacity of the conveyance zone and high hazard zone; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone. The proposed sculptures will be located within areas that are dry during a 100-year event as to not affect flood hazards. 2. The effects upon lands upstream, downstream, and in the immediate vicinity; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone. The proposed sculptures will be located within areas that are dry during a 100-year event as to not affect flood hazards. 3. The effects upon the one hundred-year flood profile; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone. Therefore, the 100-year flood profile will not be adversely affected by the proposed BCA sculptures. 4. The effects upon any tributaries to the main stream, drainage ditches, and any other drainage facilities or systems; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone. Whether additional public expenditures for flood protection or prevention will be required; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone; therefore, no additional public expenditures will be required for flood protection or prevention 6. Whether the proposed use is for human occupancy; • No new inhabitable structures are proposed in the BCA. 7. The potential danger to persons upstream, downstream, and in the immediate vicinity; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone. Therefore, potential dangers to persons upstream, downstream and within the project area will not be adversely affected by the proposed sculptures. 8. Whether any proposed changes in a watercourse will have an adverse environmental effect on the watercourse, including, without limitation, stream banks and streamside trees and vegetation; • The proposed sculptures will not adversely impact the watercourse of the Boulder Creek. 9. Whether any proposed water supply and sanitation systems and other utility systems can prevent disease, contamination, and unsanitary or hazardous conditions during a flood; • No new water supply or sanitation systems are proposed in the BCA. 10. Whether any proposed facility and its contents will be susceptible to flood damage and the effect of such damage; • No new facilities are proposed in the BCA. 11. The relationship of the proposed development to the Boulder Valley Comprehensive Plan and any applicable floodplain management programs; • The proposed sculptures will not adversely affect the Boulder Creek 100-year floodplain, conveyance zone, and high hazard zone. Additionally, the proposed sculptures will improve the BCA’s aesthetics without affecting the natural Boulder Creek habitat. 12.
