INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF BOULDER AND THE
COUNTY OF BOULDER FOR WILDFIRE MANAGEMENT ON PUBLIC LANDS
This Intergovernmental Agreement ("Agreement") is made between the City of Boulder, a
Colorado home rule city("City"), the County of Boulder, a body politic and corporate of the
State of Colorado ("Boulder County"), and the Boulder County Sheriffs Office("Sheriff')
(collectively referred to as the"Parties").
WHEREAS, C.R.S. § 29-1-2103 permits governments to enter into cooperative
agreements for the provision of services; and
WHEREAS, C.R.S. § 29.20-105.5 requires the City and the County enter into an
intergovernmental agreement for the purpose of mitigation, suppression,reclamation,or
rehabilitation of forest land or wildland fires affecting the contiguous land areas of the local
government and county; and
WHEREAS, the Sheriff acts as fire warden for all prairie or forest fires within Boulder
County and the Sheriff has primary fire response duties in the first instance for public lands
within the County,pursuant to C,R.S. § 30-10-512; and
WHEREAS,the City owns lands located in unincorporated Boulder County; and
WHERt:AS, both the City and Boulder County have firefighting resources that can be
utilized effectively in cooperation with each other to mitigate and suppress wildland fires, and
reclaim and rehabilitate forest land, on public lands within Boulder County; and
WHEREAS, the Patties recognize that wildland fires are impervious to the territorial
boundaries of political subdivisions, and because of the likely threat that wildland firers may
cross territorial boundaries,cooperative fire mitigation policies protect the public frto tie
dangers of forest land and wildland fires; and

WHEREAS, the interests of the public are best served by Boulder County and it City
entering into a cooperative agreement for wildfire management activities, including supcession,
mitigation, education, training, forest restoration,prescribed fire and other related activities.

NOW, THEREFORE, Boulder County, the Sheriff and the City hereby agree as follows:
A. BOULDER COUNTY RESPONSIBILITIES
1. Boulder County agrees to participate in wildland fire management activities
affecting City of Boulder-owned lands in Boulder County with reasonably
available resources, including the Sheriff's Operations and Communications
Divisions,Emergency Services Unit and Fire Management Program, and the
Boulder County Parks and Open Space Forestry Program. As long as the fire does
not exceed the capability of Boulder County to control or extinguish it, Boulder

County's participation will be"cost free"to the City. The "cost free"provision
does not apply to other resources including aviation resources (helicopters,slurry
bombers,single engine air tankers, etc.) and resources from other fire departments
not subject to this Agreement.
2. The Sheriff will assume primary responsibility for the coordination of response to
wildfires affecting City of Boulder-owned lands outside of the incorporated city
limits which are beyond the capability of the fire authority in its respective
jurisdiction.
3. Boulder County agrees to participate in developing the delegation of authority
with the City for an interagency incident management team.
4. Boulder County agrees to participate with the City in developing the assumption
of control when management of the fire is transitioning to state or federal
authority.
5. Boulder County agrees to participate in a unified incident command system
(Appendix A) when a wildfire involves ten percent or more of City of Boulder-
owned lands in unincorporated Boulder County.
B. CITY OF BOULDER RESPONSIBILITIES
1. The City agrees to participate in wildland fire management activities with the local
fire protection district affecting City of Boulder-owned lands in Boulder County
with reasonably available resources, including the Boulder Fire Rescue Wildland
Division and Open Space and Mountain Parks. If the fire involves City-owned
lands and requires delegation to Boulder County,to control or extinguish,the City
agrees to reimburse Boulder County for 30 percent of unreimbursed wildfire
fighting expenses based upon the number of City-owned acres burned
2. The City agrees to participate in developing the delegation of authority with
Boulder County for an interagency incident management team.
3. The City agrees to participate in developing the assumption of control with
Boulder County when management of the fire is transitioning to state or federal
authority.
4. The City agrees to participate in a unified incident command system (Appendix A)
when a wildfire involves ten percent or more of City of Boulder-owned lands in
unincorporated Boulder County.

5. If the fire becomes a state controlled fire,the City shall provide an Agency
Representative to the incident management team.
C. ENTIRETY OF AGREEMENT
1. The provisions of C.R.S. § 29-5-108 shall not apply to activities conducted under
this Agreement. Nothing in this Agreement shall be construed in any way to be a
waiver by the Parties to this Agreement of the protection to which any Party or its
employees may be entitled under the Colorado Governmental Immunity Act,
C.R.S. § 24-10-101, et seg, as amended.
2. The enforcement of the terms and conditions of this Agreement and all rights of
action relating to such enforcement shall be strictly reserved to the Parties, and
nothing contained in this Agreement shall give or allow any claim or right of
action whatsoever by any other person or third-party entity. It is the express intent
of the Parties to this Agreement that any person or entity receiving services or
benefits under this Agreement shall be deemed an incidental beneficiary only.
3. This Agreement includes all assents for services herein between the Parties. Any
prior agreement(s)between the Parties concerning the same services, including the
Fire Response Mutual Aid Agreement between the City of Boulder and the County
of Boulder Regarding Mutual Aid and Cooperation for the Suppression of Prairie
and Forest Fires effective October 23, 2007, is hereby terminated.
4. Hither Party may terminate its obligations under and participation in this
Agreement, with or without cause, by giving the other party to the Agreement (30)
days prior written notice of its intent to terminate.
5. Nothing herein shall constitute a multiple fiscal year obligation pursuant to
Colorado Constitution Article X, Section 20. Notwithstanding any other provision
of this Agreement,the financial obligations of each Party under this Agreement are
subject to annual appropriation by the governing body of such Party.
6. Nothing in this Agreement shall be deemed to create a partnership,joint venture,
or employment relationship between the Parties.

Incident Command Roles and Responsibilities
A encu Administrator: Chief executive officer (or designee) of the agency or jurisdiction that
has responsibility for the incident. Established the incident priorities and spending limits for the
incident management team.
Agency Representative: An individual assigned to an incident from an assisting or cooperating
agency who has been delegated authority to make decisions on matters affecting that agency's
participation at the incident.
Assumption of Control: A statement of delegated legal responsibility from one jurisdictional
authority to another.
Deputy Incident Commander: Performs the incident command function to perform a specific set
of tasks or in a relief capacity. Represents an assisting agency that shares jurisdiction
Deleeation of Authority: A statement provided to the Incident Commander by the Agency
Executive delegating authority and assigning responsibility. The Delegation of Authority can
include objectives, priorities, expectations, constraints, and other considerations or guidelines as
needed. Many agencies require written Delegation of Authority to be given to Incident
Commanders prior to their assuming command on larger incidents.
Incident Commander: Sets priorities and defines the organization of the incident response teams
and the overall incident action plan
