After a beautiful drive through the Foothills today, we checked out a new restaurant here in Boulder: Oregano's Pizza Bistro. This place is fun. The decor is quirky. The staff friendly and efficient. And the food is outstanding. We went specifically to try the Stuffed Pizza and we were not disappointed. So tasty and deceptively filling. Oregano's is a welcome addition to the restaurants and businesses in the 28th and Baseline area - we will definitely be going back. Well...they are still working out the kinks of any new restaurant, but the potential is there. The calamari & broccoli appetizers we ordered were ho hum. And the pizza was dropped coming out of the oven...so they made us a new one and then another by their mistake. So both were free per the manager. Our pasta dishes were HUGE portions and easily shareable. I had the shrimp scampi with 6 huge shrimp perfectly cooked. Hubby had the meat lovers penne which was also quite good. Each came with a large slice of garlic bread. We had generous leftovers for our next night meal. This place is a good value for what you get... we'll try them again after they get their liquor license. Dreams do come true!! Living in arizona for 10+ years, this place was in our weekly lineup. So extremely happy to see the boulder location right down the street from our house. This is the spot to come to have an ultimate grub session. If you are hungry, love garlicky foods, and are ready to leave the calorie counter at the door, oreganos will take goooood care of you. The place was not busy so I was surprised how long it took and that the entire order was ready about 20 min before the pizza. Everything was in the warmer so the fries got sweaty & soggy, the wings were dried out & the meatballs looked ok. A plus is the cashier offered to remake the fries, at that point who wants to wait for fries when the pizza just came out?? Then I get home & the thin crust pizza is burned & has soooooo much cheese that you can't taste the toppings. We tried eating from the middle bc the outside was so burned it had that bitter taste but with so much cheese the middle was super soggy and they did not put the spinach that I ordered. In Phoenix I never had a soggy pizza. I was so disappointed and all of this cost over $50!! I know they haven't been open very long and may need to work out how to get the food out minutes apart & how to cook thin crust without burning it! A plus is that everyone was friendly. Finally!!! We love this place!! It has been our go to in Scottsdale for years!! It's so nice to have it here is Boulder! Great pizza! Nice to have a non- stuffy, fun place in Boulder! Wonderful for kids and families! It will be our go to place from now on!! The food is amazing, everything is delicious as well as the environment. I would give it five stars, but the service is a little much. I have been there twice already and all four of the people I was with agreed that the service is way too much. The servers are sweet, but they are constantly checking in (7 times a meal) which is too much and makes it less enjoyable. Also, they shove the idea of ordering a pazookie down your throat like 4 times in between checking in several times. The service is the only reason why they do not get five stars. A MUST TRY restaurant! Even though it hadn't been open for a week, they certainly had the right wait staff, cooks and hostesses in place! So friendly and attentive! And THE FOOD! Top notch pizza and pasta. The spicy Cajun shrimp past lives up to its name - it is spicy! Five star service. Five star food! We will be back next time we are in town!! Cocktails are a bit too sweet for my taste but the portions are massive and everything I tried is delicious. Shrimp a Diablo or something like that was my favorite. We went for pizza a couple of days after their opening. The pizza was excellent. I believe I have high standards when it comes to pizza and they were well met. I had a deep dish which was so much pizza that I could only manage two slices in the restaurant. I froze most of it and fed on it for several days, making it a great value too. The thick crust was cooked to perfection; the bottom of the crust was uniformly light brown and the middle was tasty and tender. I really liked how the toppings went right up to the rim of the crust, which is turned upward at the edge of the deep pan. All of the ingredients tasted fresh. There were a few first-week mistakes with service, but everyone was friendly and helpful and I am sure they are better prepared by now. It takes about 40 minutes for a deep dish to cook, which is an indication that quality is more important than speed to Oregano's. We expect to be returning again and again. When we arrived, we were greeted by about 4-5 staff members. Talk about feeling like a VIP! The staff was delightful and so accommodating. We tried the Numero One thin crust pizza. I ordered a thin crust pizza, meatballs, golden wings with fries (they charge a bit more to sub fries for potato chips). The place was not busy so I was surprised how long it took and that the entire order was ready about 20 min before the pizza. Everything was in the warmer so the fries got sweaty & soggy, the wings were dried out & the meatballs looked ok. A plus is the cashier offered to remake the fries, at that point who wants to wait for fries when the pizza just came out?? Then I get home & the thin crust pizza is burned & has soooooo much cheese that you can't taste the toppings. We tried eating from the middle bc the outside was so burned it had that bitter taste but with so much cheese the middle was super soggy and they did not put the spinach that I ordered. In Phoenix I never had a soggy pizza. I was so disappointed and all of this cost over $50!! I know they haven't been open very long and may need to work out how to get the food out minutes apart & how to cook thin crust without burning it! A plus is that everyone was friendly. I have been there twice already and all four of the people I was with agreed that the service is way too much. The servers are sweet, but they are constantly checking in (7 times a meal) which is too much and makes it less enjoyable. Also, they shove the idea of ordering a pazookie down your throat like 4 times in between checking in several times. The service is the only reason why they do not get five stars. Was this review …? Even though it hadn't been open for a week, they certainly had the right wait staff, cooks and hostesses in place! So friendly and attentive! And THE FOOD! Top notch pizza and pasta. The pizza was excellent. I believe I have high standards when it comes to pizza and they were well met. I had a deep dish which was so much pizza that I could only manage two slices in the restaurant. I froze most of it and fed on it for several days, making it a great value too. The thick crust was cooked to perfection; the bottom of the crust was uniformly light brown and the middle was tasty and tender. I really liked how the toppings went right up to the rim of the crust, which is turned upward at the edge of the deep pan. All of the ingredients tasted fresh. There were a few first-week mistakes with service, but everyone was friendly and helpful and I am sure they are better prepared by now. It takes about 40 minutes for a deep dish to cook, which is an indication that quality is more important than speed to Oregano's. We expect to be returning again and again. Was this review …? For men, this usually involves five drinks or more, and for women, this is typically four drinks or more, in a two-hour time span. The Substance Abuse and Mental Health Services Administration (SAMHSA) defines heavy alcohol use, which potentially leads to alcohol use disorder, as binge drinking five or more days in one month. People who binge drink don’t drink every day, but they still face problems when they consume alcohol because they typically drink too much during those occasions. Binge drinking can be extremely dangerous. Consuming several servings of alcohol during one occasion can lead to acute physical harm, including alcohol poisoning. Drinking too much too often can lead to physical tolerance, alcohol dependence, addiction, and internal damage, especially to the liver. The younger a person is when they start consuming alcohol, the more likely they are to struggle with alcohol abuse or addiction later in life. Students who begin drinking while underage, including during social events in college, put themselves at risk of a lifetime of harm. Who Binge Drinks the Most? One estimate investigating the dramatic rise in heavy alcohol consumption in the United States suggested that 90 percent of people who drink too much, both adolescents and adults, do so through binge drinking. The Centers for Disease Control and Prevention (CDC) reported that, out of all the problematic drinking patterns, binge drinking is the deadliest. One in six US adults binge drinks four times per month, consuming an average of eight drinks per binge – far more than the line leading to 0.08 percent BAC. About 88,000 people die every year due to excessive alcohol consumption. Men are twice as likely to binge drink as women, but that gap is closing. Among those who drink too much too often, people between the ages of 18 and 34 are the most likely to binge drink. Overall, people who are under the legal drinking age, 21 years old, are most likely to binge drink. An older publication of the Youth Risk Behavior Surveillance System (YRBSS) found that adolescents and underage young adults who binge drink are 11 times more likely, compared to other underage individuals who consume alcohol, to engage in other risky behaviors, such as smoking tobacco, other substance abuse, unsafe sexual practices, and physical violence. Why is Binge Drinking in College Dangerous? Thousands of college students every year begin consuming alcohol as part of their school- based social life, and too many of them drink to excess, develop problematic patterns of alcohol consumption, and put themselves at risk for long-term harm. One national survey found that 60 percent of college students between the ages of 18 and 22 consumed alcohol in the month prior; close to two out of three of that survey’s respondents binge drank on the occasions when they consumed alcohol. Young adults between the ages of 18 and 24 who are in college are more likely, compared to their non-college peers, to drink to excess. This may be due to the wide availability of alcohol around college campuses, increased social pressure to drink , less structured time, inconsistent enforcement of underage drinking on and off campus, and stress related to academics. Students involved in specific social organizations, especially fraternities or sororities, are more likely to drink alcohol and binge drink compared to their peers . College students are negatively impacted by binge drinking and the problems associated with binge drinking. • Of the 88,000 people who die due to excessive alcohol consumption every year, 1,825 of those deaths are young adults between the ages of 18 and 24. • Annually, 696,000 college students are assaulted by another student who has been drinking. • About 97,000 of those college-age students report experiencing sexual assault or date rape. • One in four students reports academic problems associated with drinking too much, leading to lower grades overall. • Students who binge drank three times per week or more were six times more likely to perform poorly on class projects or tests as a result of their drinking when compared with students who reported drinking but not bingeing. • Students who binge drank three or more times weekly were also five times more likely to miss class. • Binge drinking at a young age, including in college, is linked to an increased risk of developing an alcohol use disorder (AUD), sometimes colloquially called alcoholism; about 20 percent of college students meet the definition of AUD. • College students who binge drink are at a greater risk of other problems, including attempting suicide, suffering injuries or other health problems, participating in unsafe sex practices, getting arrested due to breaking laws like vandalism, and driving while drunk. Although some problematic adolescent and young adult behaviors are getting better with prevention efforts, rates of binge drinking on college campuses have been at about 40 percent for two decades, and it appears to be getting worse, not better. Does Binge Drinking Lead to Alcohol Use Disorder? College social life is more likely to involve alcohol, which may lead participants to associate positive outcomes, like making new friends and feeling less anxious or stressed, with consuming alcohol. This, combined with the reward-reinforcing intoxication, may lead these individuals to develop problem drinking and AUD. Young adults, including college students, report consuming alcohol due to: • Struggles with family relationships or academics • Loneliness or low self-esteem • Mental health concerns, including anxiety and depression • Dealing with everyday pressures in social situations • Wishing to change their image when in a new living situation or town • A desire to lose inhibitions and gain confidence • Their parents drinking, or allowing them to drink, so they started consuming alcohol in middle or high school Although colleges are aware that binge drinking is dangerous, and nearly half of their students participate in the activity, enforcement of underage alcohol abuse laws is irregular. In addition, presidents, faculty, and alumni of colleges often intentionally look the other way. The assumption, for many, is that alcohol is part of life on campus; they experienced that kind of socially reinforced underage drinking, so why shouldn’t their students or children? The combination of new stresses, potential underlying mental health or relationship issues, and a more permissive environment may lead students not just to binge drink, but to consistently drink too much, which can lead to alcohol dependence and addiction. The student may soon feel like they cannot participate in social events normally, or feel normal during the day, without consuming some alcohol; then, the student may quickly lose control over how much alcohol they consume because they are used to binge drinking. Addressing the Alcohol Problem and Getting Help Unfortunately, in 2012, funding cuts led to the dismantling of the federal program that helped colleges with alcohol and drug abuse prevention. NIAAA started a website, CollegeDrinkingPrevention.gov, to raise awareness, but without the support of administrators, faculty, and boards at colleges and universities, government and nonprofit prevention programs and support won’t go far. Working with students earlier – as early as elementary or middle school – to discuss the dangers of substance abuse, including binge drinking, is a very important form of prevention. Students who are immersed in these kinds of educational programs are less likely to abuse substances later in life. Offering mental, behavioral, and even physical health programs on campus, without stigma, is another way for students to get treatment they need if they struggle with alcohol abuse. Some rehabilitation programs are geared specifically toward adolescents and young adults. There are sober frats and sororities that support ongoing recovery. Ultimately, getting treatment for alcohol abuse as early as possible is the best way to maintain long-term health. What Is Alcohol Poisoning? Home Written by:Editorial Staff Last updated on September 13, 2018 Alcohol poisoning results from excessive intake of alcohol. Those suffering from alcohol abuse are prone to poisoning episodes, as large quantities of alcohol can impair many essential bodily functions. A normal human liver can detoxify only a single ounce of pure alcohol every 90 minutes, or one hour per drink according to the Mayo Clinic; alcohol intake beyond this level begins to cause harmful effects on the body. Large quantities of alcohol can be very dangerous when ingested over a short period of time. When the body attempts to manage intake of quantities of alcohol beyond what the liver can process, alcohol poisoning is likely to result. If you suspect a friend or family member's alcohol abuse is leading to alcohol poisoning, call 911. Seek medical assistance immediately if obvious poisoning symptoms occur, as these may be life-threatening. Prevalence Binge drinking is the most common cause of alcohol poisoning. This can occur in social settings or when a drinker consumes five or more alcoholic beverages alone. Alcohol is readily available in the United States for anyone over the age of 21, and drinking at social events is very common. Alcohol poisoning can occur whenever a person consumes more alcohol than his body can handle, though the actual amounts required vary greatly between individuals. Poisoning is far more common in situations where large quantities of alcohol are available or drinking is a major part of social activities, such as sports events or parties. Signs and Symptoms Obvious signs of alcohol poisoning include vomiting, seizures, slow breathing, and cold or clammy skin. Vomiting occurs as the body attempts to purge the alcohol from the system. Alcohol irritates the lining of the stomach, and the body tries to reject the substance when large quantities are present. Seizures can take many forms, some of which are deadly as they prevent normal breathing and bodily functions. Slow breathing, a rate of eight breaths per minute or less, can drastically impair respiratory functions and lead to severe damage due to lack of oxygen. The skin may take on a bluish hue similar to that of a drowning victim due to the same lack of oxygen in the blood flow. Call 911 for immediate medical assistance if you witness any of these signs, as they indicate a life-threatening situation. Long-Term Risks Excessive alcohol use impairs the body's systems and begins to damage the liver over time. Regular alcohol poisoning events may increase the damage to the liver and ultimately result in the failure of this vital organ. A lack of oxygen in the body, due to slow breathing or other respiratory conditions linked to alcohol poisoning, can cause brain damage and hamper normal bodily functions. This may cause damage to other internal organs or systems that may remain long after the poisoning incident and detoxification. Severe dehydration related to poisoning or vomiting can cause brain damage and other dangerous effects. The victim may also begin to experience hypoglycemia due to blood sugar variances, resulting in reoccurring seizures. Alcohol Poisoning Treatment Alcohol poisoning treatment typically requires hospitalization or emergency medical team responses. Treatments include the delivery of oxygen through a breathing device or nasal tube, attempting to limit vomiting events that may interfere with normal breathing and the use of medical chemicals to restore imbalances. These chemicals include sugar and saline solutions designed to combat hypoglycemia, thiamine to prevent permanent damage, and electrolytes that may have been lost to vomiting. In extreme cases, hemodialysis may be administered by doctors or emergency medical professionals. Hemodialysis is the use of external measures to cleanse alcohol from the blood and normally occurs only in carefully supervised hospital settings. BLA Rules of Procedure- proposed change: Section 3-6 Training Requirements All employees involved in the service of alcohol, including, without limitation, managers, clerks, bartenders and waitpersons, shall attend a seller server training class approved by the Director of the Liquor Enforcement Division of the Department of Revenue within threetwo (23) months from the approval of the license. Re-certification must take place on or before expiration of certification. New employees shall take a course within threetwo (23) months of their hire date. The training shall be a continuous condition of the license, and all subsequent renewals, if the Authority approves the application. Online training is not accepted to fulfill training requirements. As to Tastings held at retail liquor stores or liquor licensed drugstores, all servers must complete a server and seller training program endorsed by the Director of the Liquor Enforcement Division of the Department of Revenue and recognized under the Responsible Alcohol Beverage Vendor Act. The hearing shall be set for the next regular meeting of the Authority, occurring not less than thirty (30) days from the date of the application. The Licensing Clerk shall: (i) timely provide applicant with a poster properly conforming with state and city posting requirements; (ii) have applicant confirm under oath completion of such mandatory postings; and, (iii) publish public notice of the hearing not less than ten (10) days before such a hearing. Public notice shall be given by posting a sign in a conspicuous place on the premises that are the subject of the application, and by publication in the Boulder paper of record. Notice given by posting and publication shall conform to requirements set forth in Section 44-3-311, C.R.S. Subsection 4-3-1 Special Notice and Hearing Requirements The notice requirements of Section 4-3 do not apply upon receipt of applications for License Renewal, License Transfers (if required), Licensing Clerk Interior Premises Approvals, Special Events, Bed & Breakfast Permits, or at the request of the Authority for Special Hearings or continuation of hearings. Tastings. 1. A tasting shall be conducted only by a person who has completed seller-server training that meets the standards established by the Division, and is: a. A retail liquor store or liquor-licensed drugstore licensee or employee; or b. A representative, employee, or agent of one of the following suppliers licensed by the state licensing authority: i. Wholesaler,; ii. Brew pub,; iii. Distillery pub,; iv. Manufacturer,; v. Limited winery,; vi. Importer,; or vii. Vintner’s restaurant. B. Following a tasting, the licensee shall promptly remove all open and unconsumed alcohol beverage samples from the licensed premises, destroy the samples immediately following the completion of the tasting, or store any open containers of unconsumed alcohol beverages in a secure area outside the sales area of the licensed premises for use only at a tasting conducted at a later time or date. A secure area means: 1. A designated area, including, but not limited to, a closet, cabinet, or safe; 2. That is upon the licensed premises and not accessible to consumers; and 3. Is secured by a locking mechanism at all times while any open containers of unconsumed alcohol beverages are stored for use at a future tasting. C. TO ENSURE ALCOHOL SAMPLES ARE PROVIDED TO A PATRON FREE OF CHARGE, AS REQUIRED BY SECTION 44-301(10)(C)(X), C.R.S., THE LICENSEE SHALL NOT CHARGE OR ACCEPT ANY MONEY FOR A TASTING, DIRECTLY OR INDIRECTLY, INCLUDING FOR ANY EDUCATION PROVIDED IN CONNECTION WITH A TASTING, OR TO RESERVE A SPOT AT A TASTING EVENT, REGARDLESS OF WHETHER THE MONEY CHARGED IS DONATED TO A CHARITY OR IS REFUNDABLE. D. TO COMPLY WITH THE OBLIGATION NOT TO SERVE MORE THAN FOUR INDIVIDUAL SAMPLES TO A PATRON DURING A TASTING, AS REQUIRED BY SECTION 44-3-301(10)(C)(IX), C.R.S., THE LICENSEE SHALL IMPLEMENT A MEANS OF TRACKING HOW MANY SAMPLES EACH CUSTOMER IS PROVIDED, WHICH MAY INCLUDE THE USE OF A WRISTBAND, OR OTHER MEANS OF ACCURATELY TRACKING INDIVIDUAL PATRON CONSUMPTION. Regulation 47-314. Limited Liability Company. Basis and Purpose. The statutory authority for this regulation is located at subsections INCLUDES, BUT IS NOT LIMITED TO, SUBSECTIONS 44-3-103, 44-3-202(1)(b), 44-3-202(2)(a)(I)(A), 44-3-202(2)(a)(I)(R), and 44-3- 202(2)(a)(I)(J), 44-3-301(7), and 44-3-307(1), C.R.S. The purpose of this regulation is to establish reporting and disclosure requirements for the identification of a limited liability company’s managers, and applicable members and their relevant financial interests in order to promote transparency and avoid violations of statutorily prohibited overlapping financial interests. A. A Limited Liability Company may conduct any business that a partnership with limited partners may lawfully conduct and may not conduct any business that is prohibited by law to such LRWG DRAFT 7.17.19 CODE OF COLORADO REGULATIONS Liquor Enforcement Division 1 CCR 203-2 partnership. Such limited liability company shall be in full conformity with 7-80-101, C.R.S. B. Each Limited Liability Company licensed pursuant to this Article or Article 4, of Title 44, shall report changes of any of its managers, OR MEMBERS HAVING A 10% OR MORE INTEREST IN THE LICENSE, EXCEPT THAT ANY TRANSFER OF A CONTROLLING INTEREST SHALL BE REPORTED REGARDLESS OF ITS SIZE, within THIRTY 30 days from the date of the change, and shall submit said information to the respective local or state licensing authorities on forms approved by the Division. A report shall also be required for changes of any member having a 10% or more interest in the licensee. Regulation 47-315. Lodging and Entertainment License. Basis and Purpose. The statutory authority for this regulation is located at subsections INCLUDES, BUT IS NOT LIMITED TO, SUBSECTIONS 44-3-103, 44-3-202(1)(b), 44-3-202(2)(a)(I)(A), 44-3-202(2)(a)(I)(C), 44-3- 202(2)(a)(I)(L), and 44-3-202(2)(a)(I)(R), C.R.S. The purpose of this regulation is to describe those sports and entertainment activities which qualify an establishment as an entertainment facility. Additionally, the purpose of this regulation is to describe how to determine the primary business of a lodging and entertainment facility. A. In addition to other statutory requirements, a lodging and entertainment license may be issued to a qualifying lodging and entertainment facility. A “lodging and entertainment facility” is an establishment that is either: 1. A “lodging facility,” the primary business of which is to provide the public with sleeping rooms and meeting facilities; or 2. An “entertainment facility,” the primary purpose of which is to provide the public with sports or entertainment activities within its licensed premises. B. To qualify as an entertainment facility, the applicant or lodging and entertainment licensee must demonstrate that its primary business is to provide qualifying sports or entertainment activities within its licensed premises. 1. To qualify as a sports activity, the activity must provide the public with an opportunity to participate in, or to observe others who participate in, an activity such as a game, recreation, team or individual sport, or an activity of a similar nature. Examples of qualifying sports activities include, but are not limited to, the following: a. Arcade games; b. Billiards; c. Bowling; d. Golf; or e. Laser tag. 2. To qualify as an entertainment activity, the activity must provide the public with an opportunity to participate in or observe others who participate in an activity that is primarily artistic, cultural, educational, or entertaining, or an activity of a similar nature. Examples of qualifying entertainment activities include, but are not limited to, the following: a. Artistic exhibitions, films, or performances; b. Arts and crafts classes; c. Cooking classes; d. Amusement rides; or LRWG DRAFT 7.17.19 CODE OF COLORADO REGULATIONS Liquor Enforcement Division 1 CCR 203-2 e. Spa experiences. i. For purposes of this regulation, to qualify as a “spa experience” the facility must offer at least three (3) of the following treatments and experiences: A. Facials; B. Massage therapy; C. Skin treatment; D. Body wraps; or E. Body waxing. 3. The following activities shall not qualify as entertainment activities for purposes of an entertainment facility: a. Any activity not described in subparagraphs (B)(1) or (B)(2) of this regulation; and b. Shopping for or receiving goods or personal services, including but not limited to hair care or nail care services. C. An activity that would otherwise qualify under subparagraphs (B)(1) and (B)(2) of this regulation, shall not qualify if the activity involves the use of a deadly weapon as defined by subsection 18-1- 901(3)(e), C.R.S., or creates a substantial health and safety risk to any person. D. Determining the primary business of a lodging and entertainment facility. 1. To satisfy the requirement that the primary business of a lodging facility is to provide the public with sleeping rooms and meeting facilities, and that serving and selling alcohol beverages is incidental thereto, the lodging facility’s annual gross revenues from the sale of sleeping rooms and meeting facilities must exceed fifty (50) percent of the lodging facility’s total annual gross sales revenues. 2. To satisfy the requirement that the primary business of an entertainment facility is to provide the public with sports or entertainment activities, and that serving and selling alcohol beverages is incidental thereto, the entertainment facility’s annual gross revenues from the sale of sports or entertainment activities must exceed fifty (50) percent of the entertainment facility’s total annual gross sales revenues. Regulation 47-316. Advertising Practices Basis and Purpose. The statutory authority for this regulation is located at subsections INCLUDES, BUT IS NOT LIMITED TO, SUBSECTIONS 44-3-103, 44-3-202(1)(b), 44-3-202(2)(a)(I)(A), 44-3-202(2)(a)(I)(R), and 44-3- 202(2)(a)(I)(G), 44-3-202(2)(a)(I)(O), AND 44-3-308, C.R.S. The purpose of this regulation is to establish certain permitted and prohibited advertising practices between suppliers and retailers. A. Consumer Advertising Specialties 1. “Consumer advertising specialties” shall mean those items PRIMARILY designed to advertise or promote a specific alcohol beverage brand or supplier, THAT HAVE A UTILITARIAN FUNCTION TO THE CONSUMER IN ADDITION TO PRODUCT PROMOTION, ARE DESIGNED TO BE CARRIED AWAY BY THE CONSUMER, AND THAT HAVE NEGLIGIBLE VALUE. CONSUMER ADVERTISING SPECIALTIES ARE PRESUMED TO BE OF NEGLIGIBLE VALUE IF THE SUPPLIERS’ COST TO PURCHASE THE CONSUMER ADVERTISING SPECIALTIES IS LESS THAN TEN (10) DOLLARS PER ITEM. that have a utilitarian function to the consumer in addition to product promotion and that are intended and designed to be carried away by the consumer. Consumer advertising specialties shall include: t-shirts, caps, visors, LRWG DRAFT 7.17.19 CODE OF COLORADO REGULATIONS Liquor Enforcement Division 1 CCR 203-2 bottle or can openers, cork screws, printed recipes, pencils, pens, pins, buttons, matches, computer flash and jump drives (not to exceed 8 GB), computer mouse pads, shopping bags, key chains, paper or plastic cups and plates, and similar items of negligible value, as approved by the Division. For purposes of this regulation, glassware and plates do not qualify as consumer advertising specialties. 2. Suppliers may provide consumer advertising specialties OF NEGLIGIBLE VALUE free of charge to a licensed retailer, so long as they THE CONSUMER ADVERTISING SPECIALTIES contain an advertising message that promotes the supplier or their products, and do not contain any information, markings, or logos that are specific to a retailer. NO SUPPLIER MAY PROVIDE CONSUMER ADVERTISING SPECIALTIES TO ANY RETAILER IN AN AMOUNT THAT EXCEEDS ONE- THOUSAND (1000) DOLLARS PER YEAR, PER RETAIL LOCATION, AS MEASURED BY THE SUPPLIER’S PURCHASING COST FOR THE CONSUMER ADVERTISING SPECIALTIES. 3. Consumer advertising specialties that contain any information, markings, or logos specific to a licensed retailer may not be provided free of charge, but must be purchased by a retailer at a minimum of the supplier’s cost. 4. Licensees must have available for inspection those customary business records that verify these transactions, in accordance WITH SECTION 44-3-701, C.R.S., and for the time frame specified in Regulation 47-700. B. Point-of-Sale Advertising 1. “Point-of-sale advertising” shall mean alcohol beverage brand-specific or supplier-specific promotional materials, within a retailer’s licensed premises. Such items may also include a retailer’s name and address. 2. Suppliers may provide the following point-of-sale advertising materials OF NEGLIGIBLE VALUE to licensed retailers free of charge for use within retail premises. POINT-OF-SALE ADVERTISING MATERIALS ARE CONSIDERED TO BE OF NEGLIGIBLE VALUE IF THE SUPPLIER’S COST TO PURCHASE THE POINT-OF-SALE ADVERTISING MATERIALS IS LESS THAN TEN (10) DOLLARS PER ITEM. NO SUPPLIER MAY PROVIDE CONSUMER ADVERTISING SPECIALTIES TO ANY RETAILER IN AN AMOUNT THAT EXCEEDS ONE-THOUSAND (1000) DOLLARS PER YEAR, PER RETAIL LOCATION, AS MEASURED BY THE SUPPLIER’S PURCHASING COST FOR THE POINT-OF-SALE ADVERTISING MATERIALS. display decorations of negligible value, table tents, table tent holders, sports schedules and brackets, case cards, serving trays, condiment trays, bar utensil caddies, stir rods, strainers, presses, check and credit card holders, shakers, pitchers, table mats, bar mats, alcohol beverage lists or menus, menu cards, menu holders, calendars, napkins, napkin holders, coasters, stir sticks, and similar items of negligible value, as approved by the Division. 3. A supplier may advertise, within retail premises, alcohol beverage products, consumer mail- in rebate offers, consumer giveaways, sweepstakes, contests, and cross promotions with non-alcohol beverage products. Suppliers may also provide contest and sweepstakes information and consumer entry forms. 4. Supplier Rebates for Consumers and Supplier Coupons Supplier rebates and coupons, as contemplated in this regulation, are a permitted method of alcohol beverage product promotion if they are intended to reach the consumer through permitted advertising practices, and to provide the consumer with a direct financial benefit through the redemption process. Rebates and coupons may not be used as a means of financial assistance to licensed retailers or as a means to influence or control a retailer’s product selection. a. A supplier’s “consumer rebate” provides a consumer with cash back after the consumer has purchased a supplier’s product and has provided proof of product purchase upon redemption. i. A supplier may provide consumer rebate certificates to consumers through LRWG DRAFT 7.17.19 CODE OF COLORADO REGULATIONS Liquor Enforcement Division 1 CCR 203-2 point-of-sale advertising (such as tear pads, shelf talkers, case cards, or other point-of-sales materials), package inserts, or other printed or electronic media. ii. A supplier’s consumer rebate certificate may not be redeemed through a licensed retailer. b. A supplier’s “instant redeemable coupon” provides a consumer with a discount off of the retailer’s selling price of an alcohol beverage product, at the time it is redeemed through a licensed retailer. i. Licensed retailers may redeem suppliers’ instant redeemable coupons only after they have been made available to consumers through general print or electronic media directed at the consumer; package inserts; or, a supplier’s representative or agent, who is not the retailer or their agent, who is providing coupons to consumers at the retail premises for the purpose of product promotion. ii. Licensed retailers are prohibited from accepting and redeeming any supplier-issued instant redeemable coupons unless redemption included presentation of the coupon by a consumer with the purchase of the product advertised therein, or in accordance with other applicable redemption rules specified by the supplier or their marketing agents. iii. Suppliers are prohibited from providing their instant redeemable coupons directly to licensed retailers, except when said coupons are packaged with, or attached to, each individual product package before such products are delivered to a licensed retailer. iv. Suppliers may never reimburse licensed retailers for suppliers’ instant redeemable coupons. Redemption must be through a third party that is independent from the supplier and the retailer. v. Retailers must have available for inspection, applicable business and banking records that verify these transactions, in accordance with 44-3- 701, C.R.S., and for the time frame specified in Regulation 47-700. Verification may include the retailer’s reconciliation of coupons redeemed to related products sold to consumers. 5. Supplier Give-A-Ways and Displays A supplier may advertise, within retail premises, alcohol beverage products, via consumer mail-in rebate offers, consumer give-a-ways, sweepstakes, contests, and cross promotions with non-alcohol beverage products. Suppliers may also provide contest and sweepstakes information and consumer entry forms. Further, suppliers may provide items, subject to the regulations below, to be given away in a consumer give-a-way, sweepstake or contest. For consumer give-a-ways, sweepstake or contests, (collectively “Consumer Contest”) the following regulations shall apply: a. No item provided as part of a Consumer Contest may be awarded to, received by or otherwise kept by the licensee or any of the licensee’s employees or an employee’s immediate or extended family members. b. No item provided as part of a Consumer Contest may be awarded to, received by or otherwise kept by a supplier licensee that is providing alcohol beverage products to the retail licensee or any of the supplier licensee’s employees or any supplier licensee’s employee’s immediate or extended family members. c. Any item(s) to be given away in a Consumer Contest must be awarded and given to the winning consumer within the time afforded by this regulation. Otherwise the LRWG DRAFT 7.17.19 CODE OF COLORADO REGULATIONS Liquor Enforcement Division 1 CCR 203-2 item(s) must be returned to the supplier who will be responsible for awarding the item(s) to the winner. d. The actual item(s) that is(are) part or the Consumer Contest shall be delivered to the retail license premises together with an invoice made out to the retail licensee for not less than the actual cost of the item(s). The retail licensee shall be responsible for and required to pay the invoice cost for the item unless the retail licensee can establish to the satisfaction of the Division that the item(s) was (were) in fact presented to the winning consumer in accordance with the rules of the Consumer Contest. Both the retail licensee and the supplier of the item shall each maintain in their respective records proof establishing that the item(s) was(were) delivered to the winning consumer. Such records shall include but not be limited to a signed acknowledgement of receipt of the item(s) by the winning consumer which acknowledgment shall include a valid form of identification proving the identity of the consumer, the consumer’s name, address, phone number, e-mail address (if available) and the date on which the item was presented to the consumer. In addition, the records shall include the name and position of the person or persons presenting the item to the consumer sufficient so that the Division can verify that the item was presented to the Consumer Contest winner. e. The Consumer Contest, including the drawing period, shall not last longer than 60 days. f. In the event that the supplier does not have the signed acknowledgement of receipt from the consumer within 30 days of the end of the Consumer Contest, it is the responsibility of both the retail licensee and the supplier, that payment in f ull of the invoice by the retail licensee is made to the supplier for the item(s). Absent payment within 24 hours of the expiration of the 30 day period, no supplier representing the brand advertised in the Consumer Contest shall be permitted to sell or otherwise provide any product to the retail licensee until the invoice is paid in full. g. Entrance into the Consumer Contest is not contingent on any purchases. h. The actual item(s) that is (are) part of the Consumer Contest may be on display in the licensed premises only during the period of the Consumer Contest. At the end of the contest period, the item(s) may be stored at the retailer location for no more than 30 days following the end of the Consumer Contest period. i. The item(s) must be properly identified in signage as a prize that is part of the Consumer Contest, e.g. “Win this Umbrella.” j. Signage shall display the starting date and ending date of the Consumer Contest, the name of the company providing the item(s), and all other relevant terms and conditions of the Consumer Contest. k. Failure to comply with this Regulation shall be considered a violation of the Regulation. C. Media Advertising 1. Except as provided in Regulations 47-322(B) and 47-322(C), and subsection (C)(3) of this regulation, no supplier shall directly or indirectly furnish or pay for any advertising for or with respect to any one or more retail licensee by means of the internet, device applications (apps), radio or television broadcast, magazines, newspapers, pamphlets, or similar media, or by means of any sign not located on or in the licensed premises of the retailer which is advertised. 2. Except as provided in Regulations 47-322(B) and 47-322(C), suppliers that purchase internet, device applications (apps), radio or television advertising packages from third LRWG DRAFT 7.17.19 CODE OF COLORADO REGULATIONS Liquor Enforcement Division 1 CCR 203-2 party advertising agencies: a. May not authorize the advertising agency to apply any value attributable to the supplier’s advertising package toward the advertising or promotion of any licensed retailer or their location. b. May not authorize the advertising agency to combine supplier-purchased advertising packages with those purchased by licensed retailers, for the purpose and benefit of cooperative advertising. 3. A supplier may directly or indirectly advertise for or with respect to any one (1) or more retailers that sell the supplier’s alcohol beverages, via the supplier’s internet websites (including forums such as a supplier’s Facebook page, blog or device applications (apps)) and electronic advertising messages delivered directly to consumers’ private electronic devices. 4. Closed-circuit television advertising networks, or similar advertising networks, that deliver advertising messages to consumers are permitted in retail licensed premises with the following conditions: a. A supplier may not provide a licensed retailer with any electronic equipment necessary to deliver network advertising. b. A licensed retailer may not receive revenues, directly or indirectly, from licensed suppliers who advertise on the network. Revenue from non-alcohol beverage suppliers who advertise on the same network, which can be clearly distinguished by the network advertiser from supplier revenues, are permitted provided that the retailer can document that the source of the revenue is not a licensed supplier. c. The advertising network and all related advertising receipts and distributions must be controlled by third party entities who are not licensed pursuant to article 3 or 4 of title 44, and who are wholly independent, in both form and substance, of any licensed supplier or retailer. D. Nothing in this regulation shall apply to non-profit, charitable, or other qualifying organizations, when such organization conducts licensed events pursuant to the requirements contained in article 5 of title 44, and related regulations, and such organization does not otherwise hold a retail license pursuant to articles 3 or 4 of title 44. However, nothing herein shall authorize any financial assistance for the purpose of altering or influencing an organization’s product selection for said events. E. Except as otherwise provided for in this regulation, no supplier shall directly or indirectly pay to any retailer, and no retailer shall accept, any value or consideration in connection with or for the right or privilege of posting or maintaining any advertising message, on or in, or relating to a retailer’s licensed premises. Regulation 47-328. Entertainment Districts. Basis and Purpose. The statutory authority for this regulation is located at subsections INCLUDES, BUT IS NOT LIMITED TO, SUBSECTIONS 44-3-103, 44-3-202(1)(b), 44-3-202(2)(a)(I)(R), and 44-3-202(2)(a)(I)(C), C.R.S. The purpose of this regulation is to establish a mechanism for a local licensing authority to notify the state licensing authority when an entertainment district is created or modified within the local licensing authority ’s jurisdiction so that the state licensing authority is aware of the entertainment district and the varying local ordinances governing entertainment districts in accordance with the provisions of subsection 44-3-301(11), C.R.S. Within fifteen (15) days of the creation of an entertainment district pursuant to section 44 -3-301(11), C.R.S., a local licensing authority shall notify the state licensing authority of the entertainment district, and provide (1) a map of the entertainment district and any common consumption areas, (2) a list of licensed premises attached to any common consumption area, and (3) the hours of operation for any common consumption area and attached licensed premises. Changes to an existing entertainment district shall be reported to the state licensing authority by the local licensing authority within fifteen (15) days of such changes.
