MEETING GUIDELINES
CALL TO ORDER
The board must have a quorum (three members present) before the meeting can be called to order.
AGENDA
The board may rearrange the order of the agenda or delete items for good cause. The board may not add items requiring
public notice.
ACTION ITEMS
An action item requires a motion and a vote. The general format for hearing of an action item is as follows:
1. Presentations
• Staff presentation.*
• Applicant presentation.*Any exhibits introduced into the record at this time must be provided in quantities of
seven to the Board Secretary for distribution to the board and admission into the record.
• Board questioning of staff or applicant for information only.
2. Public Hearing
Each speaker will be allowed an oral presentation.*
• Speakers should introduce themselves, giving name and address. If officially representing a group, homeowners'
association, etc., please state that for the record as well.
• Speakers are requested not to repeat items addressed by previous speakers other than to express points of
agreement or disagreement. Refrain from reading long documents, and summarize comments wherever possible.
Long documents may be submitted and will become a part of the official record. When possible, these documents
should be submitted in advance so staff and the board can review them before the meeting.
• Speakers should address the Land Use Regulation criteria and, if possible, reference the rules that the board uses
to decide a case.
• Any exhibits introduced into the record at the hearing must be provided in quantities of seven to the Board

3. Board Action
• Board motion. Motions may take any number of forms. With regard to a specific development proposal, the
motion generally is to either approve the project (with or without conditions), to deny it, or to continue the matter
to a date certain (generally in order to obtain additional information).
• Board discussion. This is undertaken entirely by members of the board. The applicant, members of the public or
city staff participate only if called upon by the Chairperson.
• Board action (the vote). An affirmative vote of at least three members of the board is required to pass a motion
approving any action. If the vote taken results in a tie, a vote of two to two, two to one, or one to two, the
applicant shall be automatically allowed a rehearing. A tie vote on any subsequent motion to approve or deny
shall result in defeat of the motion and denial of the application.

Subject:
Accessory Dwelling Unit Application -516 Mapleton Ave –AUR2019-00008 –request to be
exempt from sprinkler system requirements per “The specifications of the 2012 International Fire
Code in particular 502.1; 503.1; 503.2; 903.2.8; the local amendments, etc.”:
Two whom it may concern,
We seek to be exempt from the sprinkler system requirement reg. the ADU application no.
AUR2019-00008 for the following reasons:
1.The alley is 20’ wide and is serviced by city utility /garbage trucks. The ADU is easily
accessible by Fire Apparatuses form 5th street through the 20’ wide alley.
2.The ADU is within 75’ of an emergency vehicle access streets / 5th Street–see Exhibit H.
3.The specifications of the 2012 International Fire Code in particular 502.1; 503.1; 503.2;
903.2.8; the local amendments, etc.:
a.The alley on the South side of the lots 10 & 11 of Mapleton Zoning RL-1 is
serviced by city utility trucks like garbage trucks and others.It can be easily
accessed by Fire Apparatuses as well.We access the garage from the alley to
park SUVs in the garage, etc.A fire sprinkler systems should not be required.
b.The comment by Fire Chief David Lowrey –see Exhibit D: The Fire and Rescue
Dept. has ..”no control over parked cars, trash trucks and other items in the alley
the same as a maintained city street. ..”–
Boulder City Ordinance No. 8101 (2016):
•7-6-13.-Stopping or Parking Prohibited in Specified Places.
(a)
No vehicle may be stopped or parked:
….
On a roadway in such a manner or under such conditions as to leave available
fewer than ten feet of width of the roadway of an alley or seven feet from the
centerline of a street with no double center line for the free movement of vehicular
traffic or on a roadway that has a marked double yellow centerline, unless ten feet
of clearance between the parked vehicle and the centerline exists;

Above City of Boulder Ordinance No. 8101 (2016): 7-6-13.-Stopping or Parking
Prohibited in Specified Places applies the same way for alleys as it does for

streets /emergency vehicle access street. So there should no vehicles being
parked in alley as there shouldn’t in streets blocking traffic, etc.
4.The ADU can be easily accessed by Fire Apparatuses. The fire sprinkler system
requirement of the local amendments to 903.2.8 inflicts undue burden and cost to home
owners. They also undermines the affordable housing objective of the latest ADU City of
Boulder ordinance.
a.See Exhibit G current studio interior finish and F floor plan: A majority of the
interior finishes, drywall, etc. would have to be demolished in order to install
sprinkler heads and pipes. The current studio / ADU has tile floor and mostly
non-flammable finishes.
5.Local amendments the fire code are provided below.(33)
Section 903.2.8 is amended by the addition of the following:
(a)
Exception 1: Detached and two-unit attached dwelling units are not required to have an automatic fire
sprinkler system if they are not used as residential board and care occupancies, and the distance,
unobstructed by any structure above grade, landscaping, or topographical obstruction, from the curb
face of the emergency vehicle access street on which the structure is addressed, to a face of the unit
containing an entrance, is not greater than one hundred feet.
(b)
Exception 2: A detached dwelling unit is not required to have an automatic fire sprinkler system if it is
not used as a residential board and care occupancy, and is located on a lot larger than 14,500 square
feet, in which the driveway meets the requirements of a fire department accessible private drive, and
extends without interruption from the nearest emergency vehicle access street on which the structure
is addressed, to the side of the building which contains the main entrance.
(c)
If more than one principal building is constructed on a lot pursuant to the exceptions listed in Section
9-7-12, "Two Detached Dwelling Units on a Single Lot," B.R.C. 1981, then each building other than
the building closest to an emergency vehicle access street on which the structure is addressed, shall
be protected by an approved and supervised automatic sprinkler system in accordance with Section
903.3.
Exception:If a lot has frontage on two streets and each street is an
emergency vehicle access street, then two buildings, each closest to their
respective streets, shall not be required to be so protected by this
subsection.

Section 903.2.8 is amended by the addition of the following” would exempt these form
the sprinkler requirements since both lots have frontage two streets and both streets are
emergency vehicle access streets. However Fire Apparatuses would access both ADUs
through the alley for a potential fire & rescue mission. Both ADUs are with a 100’ radius
form the nearest emergency vehicle access streets accessible through the alley as is the
ADU at 516 Mapleton Ave.

Looking at this address the applicant meets what we consider a house behind house and if the structure
is changing use (into a dwelling unit) than it would be required to have a fire sprinkler installed the same
as if it were built new.We (Boulder Fire Rescue) do not consider an alley as acceptabl e fire access, we
never have.There is no reliability if we would be able to access it when needed.We can and we would
if possible drive an apparatus into the alley however, we have no control over parked cars, trash trucks
and other items in the alley the same as a maintained city street.I understand what he is stating but we
have never counted an alley as fire access.
The applicant has every right to take this to the Appeals Board, which is the same board of appeals as
you all use in the building department (I think the board is actually the Board of Zoning
Adjustments?).In our amendments it’s section 108 and in the amendments to the IBC its section 113.I
thought you all had a pamphlet that you can or do hand out to people.They will need to file and pay
the fee and get on the schedule.
This maybe something we want done so a precedence can be set.
