What is your suggested change in the way that Marijuana Businesses are licensed or how Marijuana
Regulations are enforced in the City of Boulder that you would like the Marijuana Advisory Panel to
review?
Which person, group or constituency on the Marijuana Advisory Panel should make your suggested
change?
What staff, resources, or tools would they need to fully implement it?
If your suggested change was enacted, what benefit would there be to undertaking the change and
what person, group, or constituency would benefit?
I suggest that city council and staff address the MAP's recommendations which were
approved by city council in 2016, teed up for the Jan 2017 work plan retreat, pushed off, teed up
for the Jan 2018 work plan retreat, pushed off and have been lingering now for years. These
recommendations came from MAP after hundreds of hours of collaboration and consensus
building, approved by council and need to be enacted into Boulder's Revised Code. This is
disconcerting given that MAP has an uncertain support from staff and an uncertain future.
The recommendations include 1) modifying sqaure footage restrictions on grows and MIPs,
2) density restrictions, 3) and a business' ability to transfer or sell it's license(s).
Since almost 2 years have passed, it is time for city council to fast track these approved
recommendations into code in the same way they've fast tracked changes to Title 9 in the past,
by simply saying so and having it completed. Trying to add it to the staff work plan isn't
working out and we've seen Title 9 changes come through instantly in city council meetings at
direction of council.
City council to direct city attorney to make the necessary changes in Title 9 and Marijuana code.
These recommendations were accepted unianimously by council and simply need to be directed
to be changed in Title 9 and marijuana code.
1) The size limitations on MIPs and grows leaves Boulder business owners at a disadvantage not
being able to scale their operation in their home town.
2) Getting rid of density restrictions will allow the marijuana business community more flexibility in
structuring and growing their businesses. It would also be in line with other municipalities regs.
3) Regarding transferability and sale of a license: once you are Boulder marijuana business
owner it is nearly impossible to transfer the license so you are locked in forever unless you want
to and CAN sell all shares in your business, rather than selling the assets (license, lease,
equipment, etc) as is a best practice in buying/selling a business.
