HomeMy WebLinkAbout1251 - A RESOLUTION TO DETERMINE THAT THE PETITION FOR ANNEXTION ELECTION TO ANNEX APPROXIMATELY 28.674 ACRES OF LAND GENERALLY INCLUDING THE KNOLLWOOD SUBDIVISIONS AND THE PROPERTIES LOCATED AT 150 GREEN ROCK DRIVE AND 2285 KNOLLWOOD DRIVE IS IN SUBSTAN RESOLUTION 1251 A RESOLUTION TO DETERMINE THAT THE PETITION FOR ANNEXATION ELECTION TO ANNEX APPROXIMATELY 28.674 ACRES OF LAND GENERALLY INCLUDING THE KNOLLWOOD SUBDIVISIONS AND THE PROPERTIES LOCATED AT 150 GREEN ROCK DRIVE AND 2285 KNOLLWOOD DRIVE IS IN SUBSTANTIAL COMPLIANCE WITH SECTION 31-12-107(2), C.R.S. AND TO SET A DATE, TIME, AND PLACE FOR A HEARING TO DETERMINE WHETHER THE PROPOSED ANNEXATION COMPLIES WITH STATUTORY ANNEXATION REQUIREMENTS; AND SETTING FORTH RELATED DETAILS. A. A Petition for Annexation Election (the "Petition") for annexation to the City of Boulder of the unincorporated territory in Boulder County generally including the Knollwood Subdivision, Knollwood Subdivision First Addition, Knollwood Subdivision Second Addition, and the properties generally known as 150 Green Rock Drive and 2285 Knollwood Drive has been filed with the City Clerk, and the City Clerk has referred said petition to the City Council as a communication. B. The City Council of the City of Boulder, Colorado, hereby finds that the Petition for the territory more particularly described in Exhibit A, attached hereto and incorporated herein by reference, is in substantial compliance with Section 31-12-107(2), C.R.S., as amended; C. The City Council of the City of Boulder, Colorado, finds that the following requirements have been met: 1. At least seventy-five registered electors or ten percent of said electors, whichever is less, have signed the Petition, meeting the requirements of Sections 31-12-104 and 31-12-105, C.R.S., as amended, seeking annexation to the City of Boulder of such territory; 2. The Petition has been filed with the City Clerk; 3. The Petition alleges it is desirable and necessary that such area be annexed to the City of Boulder; 4. The Petition alleges that the requirements of Sections 31-12-104 and 31-12-105, C.R.S., as amended, exist or have been met; 5. The Petition contains a request that the City of Boulder approve the annexation of the area proposed to be annexed; 6. The Petition alleges that signers of the Petition are qualified electors resident in and landowners of the area proposed to be annexed; 7. The Petition contains signatures of such landowners; 8. The Petition contains the mailing address of each signer; 9. The Petition contains the legal description of the land owned by each signer; 10. The Petition contains the date of signing of each signature; and 11. The Petition contains the affidavit of each circulator of such Petition, that each signature therein is the signature of the person whose name it purports to be. D. Four copies of an annexation map accompanied the Petition and contained the following information: i. A written legal description of the boundaries of the area proposed to be annexed; ii. A map showing the boundary of the area proposed to be annexed; iii. Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks; and iv. A drawing of the contiguous boundary of the City of Boulder next to the boundary of the area proposed to be annexed and the contiguous boundary of any other municipality abutting the area proposed to be annexed. E. All signatures on the Petition have been dated no more than one hundred eighty days prior to the date of filing the Petition with the City Clerk; F. The Petition requests that the City of Boulder commence proceedings for the holding of an annexation election in accordance with section 30(1)(a) of article II of the state constitution. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO,THAT: A hearing will be held to determine: 1. whether or not the proposed annexation complies with the applicable provisions of section 30 of article II of the state constitution and Sections 31-12-104 and 31-12-105, C.R.S., as amended, and the area proposed to be annexed is eligible for annexation; 2. whether or not an election is required under section 30 of article II of the state constitution or Section 31-12-107(2); and 3. whether or not additional terms and conditions are to be imposed. The hearing will be held at 6 p.m. on March 19, 2019, at 1777 Broadway, Boulder, Colorado.
