2 A RESOLUTION INITIATING THE ANNEXATION OF AN
AREA APPROXIMATELY 56,309 SQUARE FEET OF LAND
3 GENERALLY LOCATED AT 2140 - 2150 TAMARACK
AVENUE TO THE CITY OF BOULDER; FINDING SAID
4 AREA TO BE AN ENCLAVE; CALLING FOR SAID LAND
TO BE ANNEXED TO THE CITY ON DECEMBER 18, 2018;
5 DIRECTING AND FINDING THAT NOTICE OF THE
6 ANNEXATION BE PUBLISHED IN COMPLIANCE WITH
§31-12-106 C.R.S., AND SETTING FORTH RELATED
7 DETAILS.
8 THE CITY COUNCIL OF THE CITY OF BOULDER, COLORADO, HEREBY FINDS
AND RECITES THAT:

A. The area, described in Exhibit A attached and incorporated herein by this
10 reference (the "Property,") has been entirely surrounded and contained within the outer
boundaries of the City of Boulder and has been so surrounded for a period of not less than three
11 years.
12 B. Said unincorporated area is an enclave as that term is defined in subsection 31-12-
13 103(4), C.R.S.
14 C. The owner of the Property has filed a petition for annexation and has requested
that the property be annexed by the City pursuant to the unilateral annexation proceedings of
15 Section 31-12-106, C.R.S. of the Municipal Annexation Act of 1965.
16 D. The Property owner has voluntarily entered into a memorandum of agreement
with the City of Boulder. Therefore, there is no need for an election under the Municipal
17 Annexation Act to impose any additional terms or conditions.
18 E. It is desirable to annex the Property to the City of Boulder and such annexation
will be in the interests of the public health, safety, and welfare.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
20 BOULDER, COLORADO, THAT:
21 Section 1. The City Council will consider taking final action on the annexation of the
Property at its regular business meeting on December 18, 2108 in the City Council Chambers
22 located at 1777 Broadway, Boulder Colorado, to determine whether the unincorporated area that
includes the Property is an enclave which should be annexed to the City of Boulder by
23 ordinance.
24 Section 2. The City Council orders the city manager to publish this Resolution in
compliance with the requirements of Section 31-12-106, C.R.S., and finds that:

1 A. The notice shall be published once a week for four successive weeks in a newspaper
of general circulation in the area proposed to be annexed; and
2
B. The first publication of the notice shall be at least 30 days prior to the date of final
3 action on the annexation ordinance which is scheduled for December 18, 2018.
4 INTRODUCED, READ, PASSED, AND ADOPTED this 8th day of November, 2018.
