AGENDA ITEM 2 - Approval of the April 3, 2017 Meeting Minutes (See Action Item
Below): Deans moved approval of the April 3rd meeting minutes. Niemeyer seconded the
motion. The motion passed 4 – 0 with Feldman absent.
AGENDA ITEM 3 – Public Participation: None
AGENDA ITEM 4 – Police Update: Josh DeBough and Ryan Austin - Tickets down 32% year
over year but equivalent number of arrests. Overtime positions filled. The core team is 5 plus the
HOT (Homeless Outreach Team) and two-officer bike patrol teams on the Creek Path. Working with
P&R on transient issues. There are fewer transients on the Mall due to Civic Area construction but
more on The Hill.
AGENDA ITEM 5 – Parks Update - Callie Hayden: Civic Area construction going well;
tulips coming out and summer plantings going in; 29-day pilot of Port-o-lets along the Creek
starting April 28th – in the future, possibly better units – there is an RFP for the Denver
approach; Civic Area phase I is anticipated to be completed by end of summer. In response to
question, food trucks are not anticipated to be part of the Civic Area activities given proximity to
other dining establishments.
AGENDA ITEM 6 – DBP Update – Sean Maher: Two major events completed in April;
Band on the Bricks resumes on June 7th for its 20th anniversary year; one graffiti vandal
wreaking havoc downtown lately; Bolder Boulder banners going up; yearly touch up (bike racks,
etc.) happening; DBP is warmly endorsing the Planning staff recommendation regarding the
pending ordinance banning financial institutions on Pearl Street.
AGENDA ITEM 7 Matters from the Commissioners: Shapins mentioned that the CU
Environmental Design students did great work thinking about Alpine-Balsam.

AGENDA ITEM 8 – Matters from the Staff:
Connelly introduced E.J. Klock-McCook of Rocky Mountain Institute, who presented the
final report on the d2d Door to Downtown pilot
Winter updated the commission on PARCS, reporting that the hardware phase has been
completed
Connelly reported that the Planning Board had made a recommendation differing from
what Council had approved on first reading back in February – rather than prohibition, to
require use review for financial institutions on the ground floor of Pearl Street and
expanding to encompass the DT-2, 4 and 5 zoning districts, and that staff had proposed a
compromise: use review but geographically limited to Pearl Street between 9th and 19th
Streets. Commission discussion ensued. Knoff moved that DMC support the Planning
staff recommendation, with provision of clear criteria for the use review and in
conjunction with a retail study. Deans seconded, and the motion passed 4 – 0.
Jobert noted the 2016 revenue and expense report included in the meeting packet and
noted that the CAGID bond rating had been bumped up.
MOTION: Deans moved approval of the April 3rd meeting minutes. Niemeyer seconded
the motion. The motion passed 4 – 0 with Feldman absent.
MOTION: Knoff moved that DMC support the Planning staff recommendation, with
provision of clear criteria for the use review and in conjunction with a retail
study. Deans seconded, and the motion passed 4 – 0.

Sales & Use Tax Revenue Report

This report provides information and analysis related to 2017 Year-to-Date (YTD) unaudited sales and use
tax collections. Results are for actual sales activity through the month of February, the tax on which is
received by the city in March 2017. Historically, January and February have been erratic months for
receipt of these revenue compared to other months of the year. Therefore, comparing January or February
revenues with prior year receipts will indicate very little about trends for taxable sales activity later in
2017. These amounts may change due any audit adjustments that may occur in 2017. For clarification of

REVENUE COMPARISONS TO COMPARABLE PERIOD IN PRIOR YEAR
As reflected in Table 1, Sales and Use Tax has decreased from the comparable 2016 base by 12.25%.
Please note Boulder Junction’s Construction Use Tax revenue is included in the table below.

Any time a new commodity (such as recreational marijuana) becomes taxable, it generates additional
revenue and increases the prior year revenue "base," but the percentage increase in revenue may distort
perception of the strength of the underlying economy. For that reason, Table 2 is presented to illustrate
sales and use tax revenue excluding the incremental revenue of 3.5% from the sale of recreational
marijuana.

COMMUNITY, CULTURE AND SAFETY FACILITIES TAX
For 2017 YTD, the Community, Culture and Safety Tax (an additional 0.30%, effective for 3 years
beginning January 1, 2015) generated $1,311,678. This tax is dedicated to fund a variety of projects in the
Civic area along the Boulder Creek Path and on University Hill as well as improvements for several
culturally oriented projects.
DETAILED ANALYSIS OF MAJOR CATEGORIES
The following monthly information is provided to identify trends in the various retail categories. While
this information is useful, it is important to remember that relatively small aberrations (like the timing of
remittances by certain vendors) can make relatively large monthly variances.
Retail Sales Tax – 2017 YTD retail sales tax revenue is down 0.50% from that received in 2016.

Food Stores – 2017 YTD retail sales tax revenue for food stores is down by 2.64% from that received in
2016. The increase can be contributed to receipts being captured for several tax remitters occurring later in
2016. This timing difference will wash out in March 2017 and be a better comparison. Also, a new grocery
store opened in January 2017.

Sales at Eating Places are both an important revenue source (Eating Places comprise approximately
13.07% of sales/use tax) and are often an indicator of the health of the economy in the city. This
discretionary category is often correlated with disposable income and consumer confidence. Total 2017
YTD retail tax at Eating Places is down by 5.20%.

Apparel Stores – 2017 YTD retail sales are down by 9.81%. This decrease is due to receipts being
captured for several tax remitters occurring later in 2016. Staff will be monitoring this category going
forward.

Public Utilities (primarily retail sales tax on natural gas and electricity) is up by 5.04% YTD 2017. Tax
on Public Utilities comprises over 4% of total sales and use tax revenue. Even if rates increase, the
direction for this category may be uncertain if conservation strategies are successful and businesses
significantly cut their energy use.

TOTAL MARIJUANA REVENUE
The latest new revenue categories for the City of Boulder are the sale of both medical and recreational
marijuana. These sources represented 0.59% and 2.71% of the total sales/use tax collected respectively in
2016.
The sale of medical marijuana generates:
3.86% sales tax on product sales paid by the purchaser.
3.86% use tax on costs of any construction materials, furniture, fixtures, or equipment
paid by the business.
The sale of recreational marijuana generates:
7.36% sales tax on product sales paid by the purchaser (3.86% base and 3.50%
additional).
7.36% use tax on the cost of any construction materials, furniture, fixtures, or equipment
paid by the business (3.86% base and 3.50% additional).
A 5.00% excise tax paid by the grow facility when shipping product to dispensaries and/or
marijuana infused product facilities.
A "share-back" of certain State of Colorado revenues. The State collects a 10.00% tax on
recreational marijuana sales and "shares back" 15.00% of that 10.00% to each city where
such revenue is generated.

The taxes generated by the base 3.86% for both medical and recreational marijuana are distributed to city
funds based upon various past voter decisions. The new incremental revenues generated by recreational
marijuana are all deposited in the general fund and are dedicated to cover incremental costs related to the
sale and use of marijuana in the City of Boulder no matter which fund incurs the cost. Year-to-date
collections for these dedicated revenue sources follow:

in 2016. The increase can be contributed to receipts being captured for several tax remitters occurring later
in 2016 and the 55th & Arapahoe annexation. The timing issues will wash out in the March 2017 Revenue
Report.

Total 2017 YTD retail sales tax revenue collected in this category is up by 20.10% from the same period in
2016. Part of this increase can be attributed to the additional recreational marijuana facilities located in the
newly annexed area of 55th & Arapahoe.

BUSINESS USE TAX
2017 year to date Business Use Tax is down by 51.23%. This decrease is due to audit assessments we
received in February 2016. By taking out the audit assessments, the Business Use Tax would be down
20.30% over the same period 2016. This tax category can be very volatile as it is associated primarily with
the amount and timing of purchase of capital assets by businesses in the city and the amount and timing of
audit revenue. A significant portion of this amount is one time in nature and is not expected to reoccur in
future months. Therefore, it is expected that the year-to-date decrease will come back to expectations in
future months.
MOTOR VEHICLE USE TAX
2017 year to date Motor Vehicle Use Tax is up by 22.79% or $136k over the same period in 2016. This
tax category applies to the purchase of vehicles registered in the city. As individuals and businesses
became more confident about jobs and the economy, they have replaced their vehicles and thus reduced
the average age of their fleet. It is expected that the year-to-date increase will come back to expectations in
future months.
CONSTRUCTION USE TAX
Construction Use Tax is down by 39.47% year to date which includes Boulder Junction revenues. By
reducing the Boulder Junction revenue from the total Construction Use Tax, Construction Use Tax is
lower than 2016 receipts by 47.03%. Construction Use Tax is very volatile tax category as it depends upon
the number and timing of construction projects in any given period. Revenue in this category assumes
"base" number of projects will continue indefinitely, plus revenue from large projects in the "pipeline"
(based upon a review of information from the City Planning Department and the CU Capital Improvement
Plan). Even when we know projects are pending, the timing of payment of Construction Use Tax is
unknown. It can occur in the prior or subsequent year to the planned construction date. While there have
been several large construction projects in the City it is known this level of activity cannot continue
forever. Therefore, it is important that we not commit to ongoing operating expenses from this revenue
source, as it will eventually decline. There were 601 building permits (valuation of $97m) paid in 2017 as
compared to 664 building permits (valuation of $117m) for the same period in 2016.
ACCOMMODATION TAX
2017 year to date Accommodation Tax revenue is down by 12.23% from the same period in 2016. The
decrease can be contributed to receipts being captured for several tax remitters occurring later in 2016.
This timing difference will wash out in March 2017 and be a better comparison.
ADMISSIONS TAX
2017 year to date Admission Tax revenue is down by 4.18% or $4,000 from the same period in 2016.
Admissions Tax collections are dependent on the number of taxable productions and events held in the
City and the level of attendance at such events.
TRASH TAX
2017 year to date Trash Tax receipts are up by 295.72% or $16k. On-going Trash Tax remittances are due
on a quarterly basis. The increase can be attributed to receipts being captured for several tax remitters
occurring later in 2016. This timing difference will wash out in March 2017 and comparisons will be more
realistic.
SHORT-TERM RENTAL (ACCOMMODATIONS) TAX
2017 year to date Short Term Rental Tax receipts are up by 3,876% or $140k. This increase is due to more
rentals being registered and remitting tax. As of February 2016, we had 141 rentals licensed and as of
February 2017 we have 463 rentals licensed. Once the middle of 2017 is reached comparisons will be
more realistic.
