DECLARATION OF USE
We, David W. Brunel & Stacey E. Steers, the owners of the above described property, based upon
our representation before the City of Boulder, covenant and agree that:
1) On September 13, 2001, the Board of Zoning Adjushnent and Building Appeals approved a
setback variance (Docket number 2001-11) for the above described property. The Board
imposed the following conditions of approval on the property: 1) the front yazd setback
shall be 28 feet for the subject property; 2) the rear yard setback shall remain 25 feet; and 3)
the variance applies only to the stnxcture as built at the time of the variance application.
2) The intent oF this agreement is for the owners of the property to acknowledge the conditions
of approval and further acknowledge that the conditions place specific development
restrictions on the property. As such, the owners agree that it is important to notify any
potential or future owners of the property of these development restrictions.

Therefore, the owners agree that this document shall be recorded and serve to notify any
future owners of the property of the existence of development restrictions described herein
and as imposed by the Boa~ of Zoning Adjushnent and Building Appeals.
