The approved project includes the following modifications from the applicable zoning standards on the lot: -A rear yard setback of 12.5 teet where 25 feet is the standard. -A street side yard setback of 10.5 feet where 12.5 is the standard. -A building height of 32 feet, where a substandard lots of this size (roughly 3,710 square feet) are limited to approximately 27 feet in height. Appeal to Planning Board expires: 3 14- ~' Address: 2240 BLUFF ST iN ORDER FOR A BUILDING PERMIT APPLICATION TO BE PROCESSED FOR THIS PROJECT, A SIGNED DEVELOPMENT AGREEMENT AND SIGNED MYLAR PLANS MUST BE SUBMITTED TO THE PLANNING DEPARTMENT WITH DISPOSITION CONDITIONS AS APPROVED SHOWN ON THE MYLAR PLANS, IF THE DEVELOPMENT AGREEMENT IS NOT SIGNED WITHIN SIXTY (60) DAYS OF THE FINAL DECISION DATE, THE PLANNING DEPARTMENT APPROVAL AUTOMATICALLY EXPIRES. Pursuant to Section 9-2-12 of the Land Use Regulations (Boulder Revised Code, 1981), the applicant must begin and substantially complete the approved development within three years from the date of final approval. Failure to "substantially complete" (as defined in Seciion 9-2-12) the development within three years shall cause this development approval to expire. CONDITIONS OF APPROVAL 1. The Applicant shall be responsible for ensuring that the development shall be in compliance with all final approved plans dated February 13, 2007 and on fife in the City of Boulder Planning Department. 2. The Applicant shall comply wfth the approval for Planned Unit Development P-83-86, except as may have been modified by this approval. 3. At time of building permit, the Applicant shall submit detailed floor plans demonstrating that the floor area ratio calculations for the new residence shall not exceed 0.8 FAR in compliance with the final approved plans dated February 13, 2007. 4. At the time of building permit, the Applicant shall submit a site plan and elevations depicting the lowest elevation point versus the highest elevation point on the roof ridge and demonstrating that the height of the new residence shall not exceed 32 feet, as measured according to the definition of building height in the Boulder Revised Code, in compliance with the final approved plans dated February 13, 2007. 5. The Applicant shall ensure that existing trees depicted on the final approved plans dated February 13, 2007 shall not be removed and shall be protected pursuant to Chapter 3 of the City of Boulder Design and Construction Standards during the time of construction of the new residence. 6. Approval of this application is contigent upon approval of the existing home's demolition by the design review committee (LDRC) of the Landmarks Board.
