(303-444-1715) Application Date: December 8, 1999 Application Fee Paid: $100.00 Designated Wetland: Wetland #116, Wetland Pond at Humane Society of Boulder Valley Functional Values Provided by the Existing Wetland: Ground water discharge, flood storage, sediment trapping, long-term and short-term nutrient retention, wildlife habitat and within-basin food chain support. PROJECT/ACTIVITY DESCRIPTION: Proposed improvements on the property include the construction of a new Humane Society building to address expanding community needs, including associated parking, site access and animal adoption azeas. Proposed work within the regulated wetlands and 25-foot wetland buffer consists of fill placement, grading and necessary parking and driveway areas. Direct impacts of 2,500 square feet to the regulated wetland and 2,400 square feet to the regulated wetland buffer will occur on the eastern edge of the existing wetland pond. Fill of approximately 750 cubic yards will be placed to accommodate 10 required pazking spaces and associated driveway access. Wetland mitigation in the form of wetland restoration will be completed at a 10:1 ratio to projected impacts, totaling 22,500 square feet of restoration. This wetland restoration will improve the wetland function and value of the existing highly degraded and unvegetated pond due to use by farm animals. Mitigation will also exclude access by fatm WP00-06.PMT WETUrm P~w-m' animals to the existing wetland pond to ensure success of the wetland restoration. BASIS OF APPROVAL: Improvements encroaching into a regulated wetland area and associated buffer and restoration of an existing regulatory wetland may be permitted under Section 9-12-8, "Standards for Wetland Permits," Boulder Revised Code 1981 (B.R.C.), if the applicant has demonstrated: (a) that all adverse impacts on a wetland have been avoided through a reduction in size, scope or density of the project, or through a change in configuration or design, or that it is not feasible to do so; Adverse affects on the wetland have been minimized to the extent possible, given the need for an expanded Humane Society facility and the size of the overall property outside of the existing wetland pond. Direct wetland impacts will occur on the east bank of the existing wetland pond, where no vegetation currently exists. In addition, proposed wetland restoration at a 10:1 ratio to direct impacts will greatly improve the quality and function of the wetland pond and will exclude use of the wetland area by farm animals. (b) that an~~ impact on a wetland has been minimized, will result in minimal impact or impairment to any wetland function, and will not jeopardize the continued existence of habitat for identified plant, animal or other wildlife species; Adverse impacts on the wetland have been minimized to the extent possible, and the quality and function of the existing wetland will be improved by proposed wetland restoration. No adverse impacts to habitat for critical species are anticipated from the proposed project. (c) that the project is in the public interest, considering the public need, the functional values of the wetland that may be affected, the extent and permanence of any adverse effects and the cumulative adverse effects of past activities on the wettand, and the uniqueness and scarcity of the wetland that may be affected. The expanded Humane Society facility is needed to meet increased demands for the Boulder area and provides a necessary public benefit. In addition, wetland restoration will greatly improve the quality and function of the existing wetland pond, which is highly degraded and impacted by farm animal use. Considering the standazds outlined under Section 9-12-8, staff finds that the proposed project meets the intent of 9-12-1, B.R.C. CONDITIONS OF APPROVAL: - WP00-06.PMT 2 WETLAND PERMI7' All development activities impacting the regulatory wetland and wetland buffer and the wetland restoration improvements shall conform with the "City of Boulder Wetland Permit Application for the Humane Society of Boulder Valley," prepared by Professional Wetlands Consulting, Inc., dated December 8, 1999. 2. The improvements shall comply with the "City of Boulder Wetlands Protection Program Best Management Practices (BMP's)" and "City of Boulder Wetlands Protection Program Best Management Practices: Revegetation Rules." Wetland monitoring of the existing wetland pond restoration shall be performed for a minimum period of five years following completion of the project. Annual reports shall be submitted to the city for review providing an analysis of the ongoing quality and functions performed by the restored and enhanced wetland. If the Floodplain and Wetlands Coordinator detetmines that unacceptable wetland impacts have occurred as a result of improvement activities in the regulatory wetland and wetland buffer, remedial wetland mitigation activities may be required to avoid wetland losses. NOTE: This permit expires three years after the date ot' final approval, pursuant to Section 9-12-12, "Expiration of Vi'etland Permit," B.R.C.
