IF THE DEVELOPMENT AGREEMENT IS NOT SIGNED WITHIN SIXTY (60) DAYS OF THE FINAL DECISION DATE, THE APPROVAL AUTOMATICALLY EXPIRES. If no such appeal is filed, the decision shall be deemed final fourteen days after the date above mentioned. Appeal to Planning Board expires: Apri17, 2000 Pursuant to Section 9-4-8 of the Land Use Regulations (Boulder Revised Code, 1981), this approval shall expire three years after the final approval date unless development has proceeded as specified in Section 9-4-8. CONDITIONS OF APPROVAL The Applicant shall be responsible for ensuring that the development shall be in compliance with all approved plans dated January 07, 2000 and on file in the City of Boulder Planning Department. 2. Prior to application for a building permit, the Applicant shall submit the following items for the review and approval of the Planning Department: a. Final architectural plans, including materials and colors, to insure compliance with the intent of this approval and compatibility with the surrounding area. The architectural intent shown on the approved plans dated January 07, 2000 is acceptable. Planning staff will review plans to assure that the architectural intent is performed; b. A detailed landscape plan, including size, quantity, and type of plants existing and proposed; type and quality ofnon-living landscaping materials; any site grading proposed; and any irrigation system proposed, to insure compliance with this approval and the City's landscaping requirements. Removal of trees must receive prior approval of the Planning Department. Removal of any tree in City right-of--way must also receive prior approval of the City Forester; c. A detailed lighting plan showing location, size, and intensity of illumination units, showing compliance with Section 9-3.3-17, B.R.C. 1981; d. A sign program to insure compliance with the intent of this approval and the requirements of Chapter 10-11, B.R.C. 1981; e. Provide an assurance that Eco-passes will be made available to all employees and residents of the project, or provide another strategy encouraging alternative transportation use acceptable to the Transportation Division; and f Submit an application for designation of the 2018 18th Street (Cary Hotel) as an individual Landmark to the Ciry of Boulder Planning Department. g. The Applicant shall provide 1.2 unit equivalents for permanently affordable housing consistent with chapter 9-6.5 B.R.C. 1981, one on-site unit and the equivalent for 0.2 unit shall be provided. Prior to requesting a final inspection on any building permit, the Applicant shall complete the paving of the existing alley abutting the property in conformance with the City of Boulder Design and Construction Standards.
