4 - Call Up Item: Foothills Community Park, Site Review # SI-2000-1MEMORANDUM TO: Mayor Toor and Members of City Council FROM: Ron Secrist, City Manager Peter Pollock, Planning Director Don Durso, Planner DATE: April 13, 2000 SUBJECT: Call Up Item: Foothills Community Park, Site Review #SI-2000-1 Attached is the Notice of Disposition for the Foothills Community Park, Site Review #SI-2000-1 located north of Locust Avenue, west of Rosewood Avenue, and east of the foothills. This item went before the Planning Board on Apri16, 2000. It was approved by the Planning Board with a vote of 7-0. Conditions 1 through 8 remain the same as the original Site Review approval from 1998 (#SI-97-15). Condition number 9 was changed, and a new condition number 10 was added. These changes were necessary to allow the Park to begin construction of Phase II of the Park prior to secondary emergency access being available. Secondary emergency access will be installed and open prior to the opening of the Park to the public. The changed condition 9 also removes the requirement of secondary vehicular access to the Park. Due to lower traffic volumes to the Foothills Community Housing Site (because of the reduced number of housing units at that site), staff has concluded that having only one primary vehicular access will result in acceptable traffic conditions. Condition 10 requires that if additional units at the Foothills Housing Site become feasible (this depends upon the outcome of the Fourmile Canyon Creek flood study), and a street can be built across Fourmile Canyon Creek, the City of Boulder Housing Authority and the City of Boulder Parks Department will be required to work together to construct secondary access at that time. This decision may be called up before the City Council on or before May 6, 2000. There are two scheduled City Council meetings during the 30 day call-up period:Apri118, 2000 and May 2, 2000. PLANNING BOARD NOTICE OF DISPOSITION You are hereby advised that on Apri16, 2000 the following action was taken by the Planning Board. IN ORDER FOR A BUILDING PERMIT APPLICATION TO BE PROCESSED FOR THIS PROJECT, A SIGNED DEVELOPMENT AGREEMENT AND SIGNED MYLAR PLANS MUST BE SUBMITTED TO THE PLANNING DEPARTMENT WITH DISPOSITION CONDITIONS AS APPROVED SHOWN ON THE MYLAR PLANS. IF THE DEVELOPMENT AGREEMENT IS NOT SIGNED WITHIN SIXTY (60) DAYS OF THE FINAL DECISION DATE, THE PLANNING BOARD APPROVAL AUTOMATICALLY EXPIItES. This decision was arrived at based on the purposes and intent of the Land Use Regulations as set forth in Section 9-4-11, Site Review, of the Boulder Revised Code, 1981 as applied to the proposed development. This decision may be called up before the City Council on or before May 6, 2000. If no call-up occurs, the decision is deemed final thirty days after the Planning Board's decision. Pursuant to Section 9-4-8 of the Land Use Regulation (BRC, 1981), this approval shall expire three years after the final approval date unless development has proceeded as specified in Section 9-4-8. At its public hearing on Apri16, 2000 the Planning Board approved the request with the following motion: On a motion by B. Pommer, seconded by P. Gowen, the Planning Board approved (7-0) the Foothills Community Park Site Review #SI-2000-1, which amends the approved Site Review #SI-97-15, and adopting the staff memorandum dated Apri16, 2000 (preparation date March 23, 2000) as findings of the Board subject to conditions noted in the memorandum. s:\plan\pb-items\dispos\ddfthils. dis City of Boulder Notice of Disposition Re: Foothills Community Park CONDITIONS OF APPROVAL Page 2 1. The Applicant shall be responsible for ensuring that the development is constructed and maintained in compliance with the site plan, landscaping and architectural concepts as shown on the plans dated September 30, 1997 on file with the City of Boulder Planning Department and with the Phasing Plan as shown in Attachment F. 2. Prior to issuance of a building permit for Phase 1, the Applicant shall complete the following: a. Submit, for staff's review and approval, a final Master Utility Plan (at a minimum scale of 1" = 50'), drainage plan, drainage report, and 20 scale engineering drawings for all public improvements which includes a Phasing Plan. The final drainage plan and report must include an analysis of any offsite drainage improvements that may be necessary to serve this development; b. Demonstrate consistency with the architectural intent shown on the approved plans and in the applicant's written statements; staff will review at time of application for a building permit to assure a comparable level of quality recognizing that styles may vary; and c. Submit for staff's review and approval, a final landscape plan; staff will review at time of application for a building permit to assure the provision of adequate street trees, landscaping consistent with Open Space requirements to minimize potential impacts to existing plant communities, and to insure the use of xeriscape and native plants wherever appropriate. d. Grant any required land fora "Utility and Transportation Corridor" for Cherry Street; and e. Sign a Public Improvement Extension Agreement. 3. Prior to issuance of a building permit for Phase 2, the Applicant shall complete the following: a. Grant the appropriate right-of--way corridor and/or utility easement for the construction of the water main extension; b. Prior to approval of the 20-scale engineering drawings and the Master Utility Plan, the applicant shall submit financial guarantees, in a form acceptable to the City Manager, for construction of all the public improvements including the utility main extensions, drainage improvements and transportation improvements. A letter from the Director of Parks and Recreation will be an acceptable form. Prior to final inspection of new development in each phase on the Subject Property, all public improvements required in the phase including the utility main extensions, drainage improvements and transportation improvements shall be completed and accepted by the City of Boulder. 6. Prior to any development in the Fourmile Creek Floodplain, a Floodplain Development permit must be obtained from the Public Works Department. If any of the floodplain extends onto the park site, a permanent floodplain easement maybe required. 7. Prior to final inspection of new development for Phase 2 on the Subject Property, the applicant is required to construct 7th Street in its entirety as it abuts the Subject Property. The Applicant shall ensure that all drainage from the site shall be conveyed in a historic manner without negatively impacting abutting properties. •, 9. Prior to the completion, opening, or use of Phase II (the north half of the Park north of Cherry Street), the applicant shall construct a secondary emergency access to the Park, with the final details, including size, location, subject to the review, approval- and acceptance by the City of Boulder's Planning and Public Works Departments. 10. The applicant agrees to participate in the construction of the extension of Rosewood Avenue or another street mutually agreed upon between the City of Boulder's Department of Parks and Recreation, the City, and the Housing Authority, providing adequate secondary vehicular access.
