Other wetland requirements as set forth in Chapter 9-12 which are not specifically outlined in the conditions of approval below remain applicable to this projectlactivily. , The Applicant shall be responsible for ensuring that all work activities in the wetland buffer area shall comply comply with the "City of Boulder Wetlands Protection Program Best Management Practices (BMPs) and Revegetation Rules". , The Applicant shall be responsible for ensuring that the all underpass construc6on activities shall be in compliance with the "City of Boulder Wetland Permit Application for the Goose Creek Bicycle/Pedestrian Underpass at Foothills Parkway', prepared by Professional Wetlands Consul6ng, Inc, dated March 7, 2002. VI ~ DESIGNATED WETLAND: W0t18T1d # 16, Goose Creek Functional Value Ratings: Goose Creek is designated a significant wetland. The creek corridor is important for storm water and flood conveyance. Highest functional value ratings are for shoreline anchoring and sediment trapping. Additional functional values include flood storage, short-term nutrient retention and removal, within basin food chain support, habitat for fish and wildlife, and passive recreation. Pxo,rEC'r/AC'r~v['ry DESCx[r'rloN: Proposed improvements include construction of a new multi-use path and underpass at Foothills Parkway north of Goose Creek. The new path and underpass will provide an important connection between the east and west segments of the Goose Creek Greenway Path. There will be no permanent ar temporary impacts to Goose Creek regulatory wetland areas. Wetland buffer zone impacts from 1801inear feet of 10-foot wide path will tota12,300 square feet. The impacts to the buffer zone will result from the placement of earth fill along the south side of the path and the placement of concrete for the path surface. To minimize buffer zone impacts, native riparian shrubs will be planted between the south edge of the path and the Goose Creek channel. Silt fencing will be placed along the edges of the Goose Creek path construction area to protect Goose Creek and wetlands from sediment. BASis oF ArrxovAt: Construction of bicycle/pedestrian underpasses may be permitted under Section 9-12-8, "Standards for Wetland Permits," Boulder Revised Code 1981 (B.R.C.), if the applicant has demonstrated: (a) That all adverse impacts on a wetland have been avoided through a reduction in size, scope or density of the project, or through a change in configuration or design, or that it is not feasible to do so; Goose Creek Bicycle/Pedestrian Underpass WETLAND P80JECT DESCRIPTION The proposed project is identified in both the City of Boulder Master Plan and the Greenways Master Plan and will provide an important connection between the east and west segments of the Goose Creek Greenways Path. Impact to the buffer azea could be avoided if the path was constructed outside of the regulated buffer zone. This alternative was considered but is not feaasible due to the steep grades to the north of the proposed path location. (b) That any impact on a wetland has been minimized, will result in minimal impact or impairment to any weUand function, and will not jeopardize the continued existence of habitat for identified plant, animal or other wildlife species; The impact of the proposed project is entirely within the buffer zone of the wetland. Impact will be minimized by the placement of native riparian shrubs between the proposed path and the regulated Goose Creek wetland. No habitat for federally listed Threatened and Endangered Species or city of Boulder species of concern will be impacted. Habitat for the threatened Ute Ladies' Tresses Orchid (Spiranthes diluvialis) or Preble's Meadow Jumping Mouse (Zapus hudsonius preblei) does not exist at the site. Wetland functional value ratings will not be adversely affected as a result of this activity. (c) That the project is in the public interest, considering the public need, the functional values of the wetland that may be affected, the extent and permanence of any adverse effects and the cumulative adverse effects of past activities on the wetland, and the uniqueness and scarcity of the wetland that may be affected. The proposed underpass will provide an important connection between the east and west segments of the Goose Creek Greenways Path. Impacts to the buffer zone of the Goose Creek regulatory wetland are the minimum necessary to provide for the construction of the path. The wetland will not be adversely affected by the proposed improvements. Considering the standards outlined under Section 9-12-8, staff finds that the proposed project meets the intent of 9-12-1, B.R.C.
