Attached is the Notice ofDisposition for the Site Review Amendment #LUR2002-00009, Henry and Anne Beer Residence, located at 1460 Sierra Drive. This item went before the Planning Board on May 2, 2002. It was approved by the Planning Board with a vote of 7-0. This decision may be called up before the City Council on or before June 1, 2002. DECISION: Approved with conditions PROJECT NAME: HENRY & ANNE BEER RESIDENCE DESCRIPTION: SITE REVIEW AMENDMENT: Amendment to an approved site review. The proposed plans eliminate an approved accessory building and include a new 771 sq. ft. studio addition north of the existing attached garage. The addition causes the measured building height to be 4B feet, where the existing house was previously approved by the Planning Board in 1989 to a measured building height of 38 feet. REQUESTED VARIATIONS TO THE LAND USE REGULATIONS: A Building height of 48 feet where 35 feet is the by-right height for a principal building. IN ORDER FOR A BUILDING PERMIT APPLICATION TO BE PROCESSED FOR THIS PROJECT, A SIGNED DEVELOPMENT AGREEMENT AND SIGNED MYLAR PLANS MUST BE SUBMITTED TO THE PLANNING DEPARTMENT WITH DISPOSITION CONDITIONS AS APPROVED SHOWN ON THE MYLAR PLANS, IF THE DEVELOPMENT AGREEMENT IS NOT SIGNED WITHIN SIXTY (60) DAYS OF THE FINAL DECISION DATE, THE PLANNING BOARD APPROVAL AUTOMATICALLY EXPIRES. Failure to "substantially complete" (as defined in Section 9-4-8) the development within three years shall cause this development approval to expire. At its public hearing on May 2, 2002 the Planning Board approved the request, subject to the conditions listed below, with the following motion: On a motion by B. Pommer, seconded by M. Cowles, the Planning Board approved (7-0) Site Review Amendment #LUR2002-00009, incorporating the staff memorandum dated May 2, 2002 (preparation date April 25, 2002) and the attached Site Review Criteria Checklist as findings of fact with the change in Condition 4 to read "At the time of building permit application, the Applicant shall submit a final fence plan including the location, height, and spacing of fence posts and buffer landscaping for the new fence along the east property line, subject to the review'and approval of the Planning Director." CONDITIONS OF APPROVAL 1. The Applicant shall be responsible for ensuring that the development shall be in compliance with all approved plans dated April 9, 2002 and on file in the city of Boulder Planning Department. 2. The Applicant shall comply with all previous conditions contained in the Development Agreement for Planned Unit Development #P-89-10 and Height Review #H-89-5. 3. At the time of building permit application, the Applicant shall submit a grading and erosion control plan, and drainage and soils reports prepared by a licensed engineer and meeting the city of Boulder Design and Construction Standards. 4. At the time of building permit application, the Applicant shall submit a final fence plan including the location, height, and spacing of fence posts and buffer landscaping for the new fence along the east property line, subject to the review and approval of the Planning Director 5. Prior to final inspection, the Applicant shall remove the existing fence located along the east property line. 6. At the time of building permit application, the Applicant shall record a Declaration of Use against the property placing a limitation on the use of the studio addition, stating that 1460 Sierra Drive may only be used as a single family dwelling unit.
