ZONING: RB1-X (Regional Business One-Redeveloping) CASE MANAGER: Brent Bean VESTED PROPERTY RIGHT: NO; the owner has waived the opportunity to create such right under Section 9-4-12, B.R.C. 1981. This decision may be called up before the City Council on or before June 1, 2002. If no call-up occurs, the decision is deemed final thirty days after the Planning Board's decision. O'Hashi, seconded by B. Pommer, the Planning Board approved (6-1; M. Cowles opposed) Site Review #LUR2001-00033, incorporating the staff memorandum dated May 2, 2002 (preparation date April 19, 2002), the attached Site Review Criteria Checklist as findings of fact, and the conditions of approval as listed with the following amendments: Change Condition 3.c. to read "A detailed plan for the design and placement of outdoor furniture within the 15' X 46' landscaped area along the alley, including a raised grade from the alley;" and add Condition 3.f. to read "The Applicant shall submit a lighting plan that minimizes exterior light pollution onto the public right of way." CONDITIONS OF APPROVAL The Applicant shall be responsible for ensuring that the development shall be in compliance with all approved plans dated March 18, 2002 and on file in the City of Boulder Planning Department, and all plans required to be approved subsequent to this approval. 2. Prior to application for a building permit, the Applicant shall submit final architectural plans, including materials and colors, to insure compliance with the intent of this approval and compatibility with the Downtown Urban Design Plan. for the review and recommendation, of the Downtown Design Advisory Board and review and approval of the City Manager: 3. Prior to a building permit application, the Applicant shall submit a Technical Document Review application for the following items, and subject to the approval of the City: a. A final geotechnical report addressing soil constraints, groundwater discharge and other site constraints. b. A detailed landscape plan, including size, quantity, and type of plants existing and proposed; type and quality of non-living landscaping materials; any site grading proposed; and any irrigation system proposed, to insure compliance with this approval and the Ciry's landscaping requirements. Removal of trees must receive prior approval of the Planning Department. Removal of any tree in City right-of-way must also receive prior approval of the City Forester. c. A detailed plan for the design and placement of outdoor furniture within the 15' X 46' landscaped area along the alley, including a raised grade from the alley. d. A detailed final master utility plan, meeting the City of Boulder Design and Construction Standards, showing proposed private and public utility systems, including water, sewer, electric, gas, drainage, telephone, telecommunications, and any other services that will supply the subject property. e. Dedicate as necessary up to 4' of additional right of way along 9'" Street to provide 4' street tree planters and an 8' sidewalk. f. The Applicant shall submit a lighting plan that minimizes exterior light pollution onto the public right of way. 4. Prior to submission of the final landscape plan and the final utility and landscape plan, the Applicant shall coordinate the two designs to assure that trees and utility service lines do not conflict with each other, while still meeting the requirements of this approval, City landscaping standards, and the City of Boulder Design and Construction Standards. 5. The Applicant shall provide and maintain outdoor furniture within the 15' X 46' landscaped area along the alley.
