SUBJECT: Call Up Item: Floodplain Development Permit - 2121 4'h Street
Sunshine Creek Conveyance Zone
Applicant: Jeff Bosboom
Floodplain Development Permit #LUR2001-00058 was issued on October 8, 2001 for construction
of a concrete patio and in-ground hot tub. The concrete patio will be located partially in the
conveyance zone, constructed 4" above existing grade, and the hot tub will ba constructed in the
conveyance zone but completely below grade. The new patio will replace an existing raised wood
deck (approximately 12" high), with wooden railings, built-in wooden benches, and an above-
ground hot tub. The existing deck to be removed is located partially in the conveyance zone.
Construction of physical improvements that do not adversely impact flood elevations in the
comeyance zone are allowed under local floodplain regulations, as set forth under Sections 9-9-4,
9-9-6 and 9-9-7, B.R.C., 1981, The proposed improvements are located to ensure equivalent
conveyance of flood waters that will not cause any increase in 100-year flood elevations.
Based on design information provided by the applicant, staff has concluded that the proposed
conshuction with grading modifications to provide conveyance will not result in any rise in the 100-
year flood level. In addition to removal of the raised wooden deck, the applicant is proposing to
grade the backyard area adjacent to the deck in order to provide a defined swale to cany flood flows
and provide flood conveyance mitigation. This swale will be appropriately transitioned to match
existing grades downstream of the patio in order to maintain existing flow pattems at the property
boundary.
This decision may be called up before City Council on or before October 29, 2001.
There is one scheduled City Council meeting during the 21-day call-up period on October 16, 2001.

Chapter 9-9, "Floodplain Regulations," Boulder Revised Code 1981. Other Floodplain requirements as
setforth in Chapter 9-9 which are not specifically outlined in the conditions of approval below remain
applicable to this projecUactivity.

Development Permitapplication, as revised on Oct. 2, 2001.
The applicant shall provide written confirmation from the landscape architectthat all improvements
have been completed in conformance with this Floodplain Development Permit
The applicant shall obtain a site inspection and final City approval upon completion of the
improvements.
This permit is subject to call-up for review by the City Counal and is not effective for 21 days from the
date of issuance. In the event the permit is not called up the effective date shall be October 29, 2001.
