Attached is the Notice of Disposition for Site Review #LUR2000-SI016, St. John's Episcopal Church located at 1419 Pine Street. This item went before the Planning Board on July 19, 2001. It was approved by the Planning Board with a vote of 6-0; A. Gunter was absent. This decision may be called up befare the City Council on or before August 18, 2001. There is one scheduled City Councit meeting during the 30-day call-up period: August 7, 2001. Address: 3365 FOLSOM ST CITY OF BOULDER PLANNING BOARD NOTICE OF DISPOSITION You are hereby advised that on July 19, 2001 the following action was taken by the Planning Board based on the standards and criteria of the Land Use Regulations as set forth in Chapter 9-4, B.R.C. 1981, as applied to the proposed development. DECISION: Approved subject to the conditions listed below PROJECT NAME; ST. JOHN'S EPISCOPAL CHURCH DESCRIPTION: Expansion of existing church offices, classrooms, and parish hall. Total square foot addition proposed is 8,900 square feet, and 3,800 square feet of underground parking. LOCATION: 1419 PINE ST COOR: N03W06 APPLICANT: HARTRONFT FAURI ARCHITECTS OWNER: ST JOHNS EPISCOPAL CHURCH APPLICATION: Site Review, Case # LUR200D-SI016 ZONING: MXR-E (Mixed Density Residential-Established) CASE MANAGER: Don Durso VESTED PROPERTY RIGHT: YES; this approval will create a vested property right to commence and complete, within three years from the date of final approval, the following items: This decision may be called up before the City Council on or before August 18, 2001. If no call-up occurs, the decision is deemed final thirty days after the Planning Board's decision, FOR CONDITIONS OF APPROVAL, SEE THE FOLLOWING PAGES OF THIS DISPOSITION. IN ORDER FOR A BUILDING PERMIT APPLICATION TO BE PROCESSED FOR THIS PROJECT, A SIGNED DEVELOPMENT AGREEMENT AND SIGNED MYLAR PLANS MUST BE SUBMITTED TO THE PLANNING DEPARTMENT WITH DISPOSITION CONDITIONS AS APPROVED SHOWN ON THE MYLAR PLANS, IF THE DEVELOPMENT AGREEMENT IS NOT SIGNED WITHIN SIXTY (60) DAYS OF THE FINAL DECISION DATE, THE PLANNING BOARD APPROVAL AUTOMATICALLY EXPIRES. Pursuant to Section 9-4-8 of the Land Use Regulations (Boulder Revised Code, 1981), the applicant must begin and substantially complete the approved development within three years from the date of final approval [or in compliance with the phasing plan]. Failure to "substantially complete" (as defined in Section 9-4-8) the development within three years [or in compliance with the phasing plan] shall cause this development approval to expire. At its public hearing on July 19, 2001 the Planning Board approved, subject to the conditions listed below, the request with the following motion: On a motion by M. Cowles, seconded by A, O'Hashi, the Planning Board approved Site Review #LUR2000-SI016 (6-0; A. Gunter was absent) with the recommended conditions of approval set forth in AttachmentA in the staff memorandum dated July 19, 2001 (preparation date July 3, 2001). T. Nielsen offered a friendly amendment that Condition 4 "Prior to building permit application the applicant must submit an executed lease with the garage located at 15th and Spruce for thirty parking spaces to be used on Sundays, asset forth in its written statement" be deleted. T. Nielsen offered a friendly amendment to add Condition 4 to read "If the City Manager so orders the Applicant shall cease to lease out all or a portion of the 21 parking spaces which are considered to be deferred parking spaces and proposed to be leased to off-site users." B. Pommer offered a friendly amendment to change the wording in Condition 1 to read "The applicant shall be responsible for ensuring that the development shall be in compliance with all approved plans dated June 6, 2001, and the applicant's written statement dated May 7, 2001, on file in the city of Boulder Planning Department, supplemented by the elevations set forth in drawing A-200 presented at the July 19, 2001 Planning Board meeting." T. Krueger offered a friendly amendment to add Condition 5 to read "Prior to a building permit application, the Applicant shall submit a detailed Transportation Demand Management Plan to the Public Works Department for review and approval that provides for a significant and practical shift away from single occupant vehicle use for the daytime, weekday parking uses." T. Kreuger offered a friendly amendment to add Condition 6 to read "The Applicant shall consider the feasibility of adding housing to the site as part of any future subsequent site review for the expansion of floor area on the site." M. Ruzzin offered a friendly amendment to add Condition 7 to read "The Applicant must submit an executed lease with the garages located at 15th and Spruce or 15th and Pearl for 30 parking spaces to be used on Sunday in the event there is no longer free parking in both structures on Sundays." M. Cowles and A. O'Hashi accepted the friendly amendments. CONDITIONS OF APPROVAL The applicant shall be responsible for ensuring that the development shall be in compliance with all approved plans dated June 6, 2001, and the Applicant's written statement dated May 7, 2001, on file in the city of Boulder Planning Department, supplemented by the elevations set forth in drawing A-200 presented at the July 19, 2001 Planning Board meeting. 2. Prior to a building permit application, the applicant shall submit the following items fore the review, and subject to the approval, of the Planning Department: A. Final architectural plans, including materials and colors, to ensure compliance with the intent of this approval. B. A detailed landscape plan, including size, quantity, and type of plants existing and proposed; type and quality of nonliving landscaping materials; any site grading proposed; and any irrigation system proposed, to ensure compliance with this approval and the city's landscaping requirements. C. A tree removal plan. Removal of trees on the site, as well as the removal of any tree in the city right-of-way must also receive prior approval of the City Forester. 3. Prior to building permit application the applicant shall revise and complete their Lot Line Elimination application (LE 2000-2). 4.
