OVERVIEW:
The Parks and Recreation Deparhnent is requesting a recommendation to City Council
concerning the Parkland disposition resulting from a proposed lot line adjustment consisting
of OA10 acres (435 square feet) located along the east side of Fortune Park, at the northeast
corner of 4th Street and Canyon Boulevard (1920 4th Street).
BACKGROUND:
The Parks and Recreation Department received a donation of a park site {commonly referred to
as "Fortune Park") in August of 1999 from Sheila Fortune. The donated park site is located at
the northeast corner of 4"' Street and Canyon Boulevard (1920 4`h Street) and consists of two lots
(Lots 7 and 8, Block 59, West Boulder) each 50 feet by 140 feet, for a total of 14,000 square feet
(see Attachment A, Vicinity Map}. In the northwest corner of the site is a 1,086 square foot

house which was built sometime before 1935. The site is well landscaped with numerous large
trees and an abundance of shrubs: Currently the site provides a small neighborhood pocket park
with no other improvements.
Sheila Fortune recently purchased the property immediately to the east of Fortune Park at 419
Canyon Boulevard (Lot 9, Block 59, West Boulder) and plans to renovate a house located there.
During the planning process far the renovation it was discovered that a portion of the house at
419 Canyon Boulevazd and the fence on this lot encroach on the Fortune Park site to the extent of
435 square feet (see Attachment B, Site Map and Attachment C, Proposed Property Line
Illustration). The city of Boulder Planning'Department has informed staff that, based on
historical pictures, this house and most likely the fence, appear to have encroached onto the
Fortune Park site for at least 60 years. Sheila Fortune is requesting that the city deed
approximately 435 squaze feet of the Fortune Park site to the property at 419 Canyan Boulevard.
In addition, she will be applying for a required lot line adjustment with the Parks and Recreation
Department as a joint applicant.
Under the City Charter, this proposed land transfer requires the following process for
consideration: "Park lands may be disposed of or leased by the City Council, but only upon the
a~rmative vote of at Zeast four rnerrabers of the Parks and Recreation Advisory Board. An
advisory recommendation, which shall not be binding on the Council, shall be obtained from the
PlanningBoardprior to the disposition or lease ofpark lands."
ANALYSIS:
In view of the generous gift from Ms. Fortune and the circumstances of her request, we are
cooperating to resolve this issue. At this point in time the interested parties are cooperating to
resolve this encroachment without possible litigation as an adverse possession challenge.
If the city deeds the requested 435 square feet along the east property ]ine, it will not significantly
reduce the function of Fortune Park.
PUBLIC PROCESS:
The public process for this item will involve meetings of the Parks and Recreation Advisory
Board, the Planning Board, and City Council. The results of the Parks and Reareation Advisory
Board meeting will be made available at this Planning Board meeting.
STAFT RECOMMENDATION:
Staff recommends that the Planning Board make a positive recommendation to City Council on
the parkland disposition resulting from a proposed lot line adjustment consisting of 0.010 acres
(435 square feet) located along the east side of Fortune Park, at the northeast corner of 4th Street
and Canyon Boulevard (1920 4th Street).

In reviewing the Board's decisions on the comprehensive Plan Land Use Map, we found that one
of the sites was not considered, because we inadvertently left if off your decision list. We
apologize! Information on the proposed change was in the packet of materiais, on the published
map, and notification was sent to the property owners. We have proposed that it be considered at
your Apri15 meeting, so that your decision on this site can be included in the April 17 City
Council public hearing. '
