DECISION: Approval, with conditions PROJECT NAME: HENRY BEER PUD DESCRIPTION: SITE REVIEW AMENDMENT: Construct two additions (a total of 117 sq. ft.) to an existing single family house. The house was previously approved as a Planned Unit Development and Height Raview to a building height of 38.5 ft. in 1989. The proposal also includes a new 787 sq. ft. accessory building on the southeast corner of the site. If no such appeal is filed, the decision shall be deemed final fourteen days after the date above mentioned. Appeal to Planning Board expires: K3~1~1 ~ 2/~ Z~~~ IN ORDER FOR A BUILDING PERMIT APPLICATION f0 BE PROCESSED FOR THIS PROJECT, A SIGNED DEVELOPMENT AGREEMENT AND SIGNED MYLAR PLANS MUST BE SUBMITTED TO THE PLANNING . DEPARTMENT WITH DISPOSITION CONDITIONS AS APPROVED SHOWN ON THE MYLAR PLANS. IF THE DEVELOPMENT AGREEMENT IS NOT SIGNED W ITHIN SIXTY (60) PAYS OF THE FINAL DECISION DATE, THE PLANNING BOARD APPROVAL AUTOMATICALLY EXPIRES. Pursuant to Section 9-4-8 of the Land Use Regulations (Boulder Revised Code, 1981), the applicant must begin and substantially complete the approved Site Review, Case # LUR2001-00010 within three years from the date of final approval, Failure to "substantially complete" (as defined in Section 9-4-8) the development within three years shall cause the development approval to expire. CONDITIONS OF APPROVAL The Applicant shall be responsible for ensuring that the development shall be in compliance with all approved plans dated April 1, 2001 and on file in the City of Boulder Planning Department. 2. The Applicant shall comply with all previous conditions contained in the Development Agreement for Planned Unit Development #P-89-10 and Height Review #H-89-5. 3. At the time of building permit application, the Applicant shall submit a grading and erosion control plan, and drainage and soils reports prepared by a licensed engineer and meeting the City of Boulder Design and Construction Standards.
