SUBJECT: Public hearing and consideration of a landmark alteration
certificate to install photo-voltaic panels on the roof of a
contributing garage at 454 Pine Street in the Mapleton Hill
Historic District (HIS2006-00229).
STATISTICS:

STAFF RECOMMENDATION:
Staff recommends that the Board approve the installation of the photo-
voltaic panels in that their installation will not adversely impact the contributing
garage, the property, or the district as a whole and that the relatively
inconspicuous and reversible nature of this form of solar technology is generally
consistent with Sections 3.1, 4.3, 4.5, 8.2, and 8.3 of the Guidelines and is consistent
with the Apri126, 2006 motion passed during a joint meeting of the landmarks
board and the EAB. The motion stated that, "Solar collectors and skylights
should be placed on inconspicuous locations, however, as new solar collector
technologies emerge with less noticeable collectors, more flexibility should be
given to solar collector placement." Further, this project represents consideration
of a technology not viable in 2003 when the Guidelines were adopted. Finally, the
proposed project at 454 Pine Street is consistent with Sections 10.13.1(C) and 10-
13-18 of the Boulder Revised Code.

SUMMARY:
- The application to install photo-voltaic panels on the alley facing roof
expanse of the contributing garage at 454 Pine Street was reviewed at the
August 23Td, 2006 design review committee meeting. The design review
committee considered that because of the proposed location of the panels
on a publicly visible roof area of a contributing building, the application
should be reviewed by the full Board in a public hearing.
- The application calls for the installation of 156 sq. ft. of photo-voltaic panel
to be installed on the south (alley) facing roof on the garage.
Staff recommends the Board approve the application to install photo-
voltaic panels as requested in that the proposal will not adversely impact
the contributing garage, the property, or the district as a whole and that
the relatively inconspicuous and reversible nature of this form of solar
technology is generally consistent with the Sections 3.1, 4.3, 4.5, 8.2 & 8.3
of the Gerzeral Desigrt GtcideIirzes and Sections 10.13.1(C) and 10-13-18 of the
Boulder Revised Code.
PROPERTY HISTORY:
As part of the Mapleton Terrace addition to the Mapleton Hill
neighborhood, the property at 454 Pine Street was not developed until the early
twentieth-century when the existing house was constructed. The city directory
lists Donald and Isabel Fraser Grant as having lived on the property in 1910.
Grant was a Scottish born stone mason who moved to Boulder in 1891.

Located on the corner of the alley and 5t'' Street, the garage at 454 Pine
Street was inventoried during the 2005 accessory building survey of the
Mapleton Hill historic district by Kathryn Barth and Lara Ramsey. Based upon
Sanborn map and tax assessor card research, the consultants determined that the
garage v~~as constructed in 1941. While identifying non-historic changes to the
building including the installation of overhead doors, Barth and Ramsey found
the degree of historic integrity sufficient for the building to be considered a
contributing resource to the historic district. The period of significance for the
Mapleton Hill historic district has been identified as extending from 1865 to 1945.
REQUEST:
The applicant proposes the installation of south (alley) facing photo-
voltaic cell panels on the roof of the contributing building.

As proposed, the twelve photo-voltaic panels, totaling 156sq. ft., are to be
affixed to the roof and at it current pitch on rails approximately 2" above the
asphalt shingle surface. An alternating current inverter is shown to be located on
the north (garden) side of the garage with remaining service equipment to be
located on the interior of the building.

BOARD'S DECISION
The Historic Preservation Ordinance specifies that a Landmark
Alteration Certificate may not be approved by the Board or City Council unless it
meets the conditions specified in Section 10-13-18 B.R.C. Specificallv:
(a) The landmarks board and the city council shall not approve an
application for a landmark alteration certificate unless each such agency
finds that the proposed work is consistent with the purposes of this
chapter.
(b) Neither the landmarks board nor the city council shall approve a
landmark alteration certificate unless it meets the following conditi~ns:
(1) The proposed work preserves, enhances, or restores and does not
damage or destroy the exterior architectural features of the landmark or
the subject property within an historic di~trict;
(2) The proposed work does not adversely affect the special character or
special historical, architectural, or aesthetic interest or value of the
landmark and its site or the district;
(3) The architectural style, arrangement, texture, color, arrangement of
color, and materials used on existing and proposed structures are
compatible with the character of the existing landmark and its site or the
historic district; and

(4) With respect to a proposal to demolish a building in an historic district,
the proposed new construction to replace the building meets the
requirements of para~raphs (b)(2~ and ~ of this section.
(c) In determining whether to approve a landmark alteration certificate,
the landmarks board shall consider the economic feasibility of
alternatives, incorporation of energy-efficient design, and enhanced access
for the disabled.

The following is an analysis of the proposal's compliance with the
applicable design guidelines.

The request to install photo-voltaic solar panels on a conspicuous
elevation of a contributing garage is somewhat consistent with Section 8.3.2 of
the General Desigri Guidelines and consistent with Section 8.3.4 of the Guideli~res
which states that such roof-top appurtenances should not "compromise
character-defining roofs, or on roof slopes that are prominently visible from the

street". The request is generally consistent with Sections on Roofs (3.1.1 and
3.1.4), Compatibility (4.3.1), Key Building Elements (4.5.1) and Energy Efficiency
(8.2) of the Gt{ideiines. The review of this energy-efficiency project represents
consideration of a te~hnology not viable in 2003 when the Gi~idelines were
adopted.
At their Apri126~'', 2006 joint meeting with the EAB, the Board passed a
motion that stated that, "Solar collectors and skylights should be placed on
inconspicuous locations, however, as new solar collector technologies emerge
with less noticeable collectors, more flexibility should be given to solar collector
placement".
While the proposed location of the collectors will be publicly visible, the
low profile, angle, and colour of the panels matching the roof, will render them
relatively inconspicuous and not compromise the character defining roof form of
the contributing house. The panels are also highly reversible; affixed to the
asphalt roof of the house by way of four steel rails. Staff considers that the
installation of the photo-voltaic panels will not damage the historic garage, the
historic property, or have an adverse affect on the historic character of the district
as a whole.
FINDINGS:
With the conditions outlined in the staff recommendation, the request for
a landmark alteration certificate to install the photo-voltaic panels on the garage
at 4ti4 Pine Street, will be compatible with the Historic Preservation Ordinance,
in that:
1. The proposed work will not damage or destroy exterior
architectural features of the subject property within an historic
district.
2. The proposed work will not adversely affect the special character
or special historical, architectural, or aesthetic interest or value of
the landmark and its site or the district;
3. The architectural style, arrangement, texture, color, arrangement of
color, and materials used are compatible with the. character of the
existing landmark and its site or the historic district.
4. The request is generally consistent with adopted design guidelines
from the General Design Guidelines, including Sections 3.1, 4.3, 4.5,
8.2, and 8.3.

Kyocera's advanced cell processing technology and automated production facilities produce a highly efficient
multicrystal photovoltaic module.
The conversion efficiency of the Kyocera solar cell is over 16%.
These cells are encapsulated between a tempered glass cover and a pottant with PVF back sheet to provide
efficient protection from the severest environmental conditions.
The entire laminate is installed in an anodized aluminum frame to provide structural strength and ease of installation.
Equipped with plug-in connectors.

§ 38-30-168. Unressonable restricHons on solar energy devices void.
(1) After May 25, 1979, any covenant, restriction, or condition contained in any deed, contract,
security instrument, or other instrument affecting the transfer or sale of, or any interest in, real
property solely on the basis of aesthetic considerations which effectively prohibits or restricts the
installation or use of a solar energy device, as defined in section 38-32.5-1003, is void and
unenforceable.
(2) Subsection (1) ofthis section shall not apply to aesthetic provisions which impose reasonable
restrictions on solar energy devices and which do not significantly increase the cost of the device.
§ 38-32.5-100.3. DeSnitions
As used in this aRicle, unless the context otherwise requires
(1) "Solar easement" means the right of receiving sunlight across real property for any solar
energy device. Such a right may be stated in any deed, will, or other instrument executed by or on
behalf of any owner of land or sky space.
(2) "Solaz energy device" means a solar collector or other device or a structural design feature of
a structure which provides for the collection of sunlight and which comprises part of a system for
the conversion of the sun's radiant energy into thermal, chemical, mechanical, or electrical
energy.
