SUBJECT: Public hearing to consider lifting the stay of demolihon for the property at 2747
4`" Street and to consider initiation of historic district designation for the west side
of the 2700 block of 4`h Street.
PURPOSE:
The Landmarks Board has been asked to consider miriating local historic district designation for
the west side of the 2700 block of 4`h Street by some residents of the block. This area has been
idenhfied as a potential historic district through surveys and in the Boulder Valley
Comprehensive Plan. Interest m designation was partly prompted by a demolirion apphcation for
the house at 2747 4`h Street. The Board placed a stay of demolition on that property that will
expire July 28, 2003. This memo outlmes options for the Board regarding this issue.
BACKGROUND:
On January 3, 2003, the Plannmg Department received a demolrtion permit apphcahon for the
primary building at 2747 4`h Street. The application was reviewed by the Landmarks design
review committee. The committee referred the demolition permit to the full Landmarks Board
for a pubhc hearing based on the design review commrttee's findmg that the buildmg may be
eligible for designation as an mdividual landmark, as required by the Historic Presarvation
Ordmance. This building is located wrthin an area identified as a potential local historic district
by the Boulder Valley Comprehensive Plan. While the building is not within an established
historic district or locally landmarked, it is over fifty yeazs old and is therefore sub~ect to Section
10-13-23 of the Historic Preservation Ordmance.
The Landmarks Board reviewed the application at their March 5, 2003 meeting and issued a 180-
day stay of demolition m order to allow time for alternahves to demolition to be pursued. That
stay will expire on July 28`h of this year Should no action be taken by the Board prior to that
date, the property owner would be eligible to pull a demolition permit, assuming all other
requirements of the pernut process have been met.
Following the March meeting, the owner of 2747 4~h Street, Alise 5hingles, approached the
Board and requested that the Board reconsider the 180-day stay placed on her property in March.
In addition, other residents of the block came forward with a request that the Board consider
mihating designation of tl~e uea as a local historic district. The Board agreed at their May
meetmg to schedule these two related issues for discussion at the June meeting The Board also

directed staff to schedule a tour of 2747 and a neighborhood meeting.
Two Board members (Egger and Salance) and staff visited the house at 2747 at the request of the
owner on March 27th. Staff also met with ten residents of the neighborhood, representing six of
the eight properties on the block, on the same evening. The meeting was primazily aimed at
providing information and answering questions - no conclusions were reached regarding the
general level of support for district designation.
At the June meeting, the Boazd took no action relative to these issues other than to direct staff to
contmue with outreach to the residents of the proposed district and the immediately surrounding
properties. The goal of this outreach was to conhnue with education efforts regarding district
designation and to gauge property owner support for designation. In keeping with that request,
staff held a second meeting and mvited all residents on both sides of the 2700 block of 4~h Street.
A survey sheet was also distributed to each home in the potential district (see Sample
Announcement and Survey Sheet in Attachment A). The meeting was held on June 19`h. Eight
people attended that meeting, representmg five of the eight homes in the potential district. No
one from the east side of the block attended, though one property owner from that side of the
block called staff to express opposition to the designahon. The meehng afforded staff an
opportunity to informally address many queshons and concerns from the neighbors reguding the
designation process and implications of historic district designation.
Four surveys were returned from property owners in the potential district. (see Survey Responses
m Attachment B) Two of those mdicated support of the district, the other two indicated that
they were unsure at the hme and needed more mformation before making a decision. One
property owner made it clear that he is not in favor of designahon at the June 19`h meetmg,
though no survey was returned. Staff is uncertam of the opmions of the remammg property
owners at this time, though we expect to hear testimony at the July meeting that should clarify
the overall level of support for the district.
Since the last Board meetmg, the property at 2747 4°i Street has been sold Staff attempts to
contact the new property owner have been unsuccessful. The sale of the home has no impact on
the current stay of demolition - that action transfers with the sale of the property. Should the
Board take no action prior to the expiration of the stay on July 28`h the new owner would be able
to pull a demolition permit. Staff has no specific informarion at this rime on the new owner's
intent for the property.
OPTIONS FOR THE BOARD:
The Landmarks Board has already taken action on the only application brought forward to date
by placmg the 180-day stay on the demolitron request for 2747 4`h Street. No additional action is
necessarily required at this time. Howevar, the Board has agreed to discuss possible additional
actions at the request of residents of the block. Therefore, the Boazd has the following options:
1. No Additional Action
The Landmarks Board took action on the demolition request for 2747 4`h Street at their
March 5`h meeting by placing the 180-day stay, based on a finding that the home may be
eligible for individual landmark status and that it would be a contributing buiiding to an

identified potential histoiic distiict That stay will expire July 28`~', 2003. If the Board Cakes
no othei action before that date, the apphcant may pull a demolition permit at any time in the
followmg 180 days, assuming all olher requirements of the permit piocess have been met
2. Lift the Stay of Demolition
The 180-day stay piovision of Section 10-13-23 is intended to provide the time necessary to
imtiate historic designation or to consider other alternahves to demolrtion. If the Board
determines that all alternatives to demolition have been exhausted, they could lift the stay. In
this case, however, many alternahves are still bemg considered, mcludmg mdividual and/or
district designation. In addition, no evidence has been formally presented to suggest that the
historic structure could not be moved and/or restored usmg appropriate preservation
techruques Finally, the new owner of the property may have no interest in demolition.
Given the need to further cons~der these various opportunities, lifring the stay would not be
appropnate at this time
3. Initiate Individual Landmark Designation Process
The Board could mitiate the mdividuai landmark designation process if they feel the building
may meet the cnteria for such recognition. That achon would imtiate the standard
des~gnation process, allowing foi additional research and public comment at hearmgs before
both the Landmarks Board and Crty Council
4. Initiate Historic District Designation Process
The eight houses on the west side of the 2700 biock of 4th Street were surveyed as part of the
Boulder Survey of Historic Places m 1992 (see survey sheets in Attachment C). In the late
1990s, the Landmarks Board reviewed previously suiveyed areas to assess potential for local
historic districts and identify potential boundary changes for potential NaYional Register
districts. At that ume, the Board identified the west side of the biock on 4`~' Street as a
potentiallocal distuct as pait of the Year 2000 Update to the Boulder Valley Comprehensive
Plan. A policy encouragmg designation of local districts and a map of existmg and potential
distriets were adopted.
The block is part of the Newlands Addition platted by Molhe Dyei in 1891. Development of
the west side of the 2700 block began m 1900. The survey report suggests that this delay in
development may have been due to the economic setbacks experienced throughout the state
begmning m 1893 and the lack of adequate transportation to the area. The Boulder County
Assessor idenhfies four houses on the west side of the block that were built from 1900-1901,
mcludmg 2747 4~h Street. The remammg oiigmal homes on the block were developed m later
yeazs - between 1912 and 1925. The east side of the block consists entirely of seven modest
post-war ranch houses, all bwlt durmg the 1950s, with thiee older than 50 years The two
sides of the block developed separately and have nothing m common to suggest that both
sides should be considered foi district designatron.
Staff review of the block suggests that six of the eight homes could be considered
contributing to a local historic district. New construction and extensive alterahons at 2737
and 2759 4`~' St would be considered non-contributmg (see Attachment D) The block also
contains a number of historic accessoiy structures that contribute to the potential district.
While additional research is needed, staff's mitial impression is that the west side of the

block meets criteria adopted by the Board for local historic district designarion. Should the
home at 2747 be demolished, however, the area may lose the critical mass of contributmg
buildmgs necessary for such a small district to be supported.
RECOMMENDATION:
A primary responsibility of the Board is to mrtiate historic districts The area appears to meet
the crrteria for districts adopted by the Board. Howevei, the smali scale of this district
demands careful attention to the testimony from property owners expected at the pubhc
hearmg. Should the Board elect to initiate designation, that process will allow for additional
opportuniries for public outreach and comment before actual designahon by City Council.
