REQU~STING DEPARTM~NT: Downtown and University Hill Management Division PresenCer: Molly Winter, Director, Downtown and UniversiCy Hill Management Division/Parking Services FISCAL IMPACT: none PURPOS~: The purpose of this agendn item is to amend Chapter 4-11, B.R.C. 1981 making changes [o the Pead Street Mall permit[ing system and amending the mall zone maps. Specifically, [his ordinance would add an additional information kiosk location to the Mall to better serve the pu6lic and to add 4 days to the current special activity permit issued to a government, bringing the to[al days to 10 per yeac In addi[ion, this ordinance would provide for one or more series of artistic performances for the entertainment of the Mall public. BACKGROUND: The Downtown Boulder Business Improvement District (BID) was formed by a vote of the property owners in the district in November of 1999 and was approved by City Council. The BTD started its operation on January 1, 2000. Currently, there is one information kiosk on the 1300 block of the Pearl Street Mall, which is operated by the BID during the summer season. This ordinance would allow for an additional kiosk on the 1100 block of the Pearl Street Mall during the summer season. At the present time, non-profit groups and government agencies are allowed only 6 event days per calendlr year. While this number works for the majority of non-profits that plan events, it does not work for the Business Improvement DistricPs event promotion division, Downtown Boulder, Ina (DBI), the main promoter of events on the mall. This is no provision in the existing ordinance for an event series, such as Bands on the Bricks ~nd Out to Lunch. ANALY5I5: Providing an additional information kiosk on the 1100 block of the Pearl Street Mall will better ena6le the BID to serve the public entering the mall from [he west end. The kiosk on the 1100 block of Pearl Street will be staffed during the summer months by BID employees. Adding four days to the special activity pennit to n government will allow [he BID to bring more events to the Mall, which, in turn, brings more business to the MaII merchants. Because DBI is the m~in promoter of the major events on the Mall, their event days are used up yuickly. They then need to request sponsors such as the Boulder Convention and Visitors Bureau to sponsor events, thereby using up its allotted days for events. For exlmple, Bands on the Bricks will use up one day instead of 13 dlys as it has done in past years. DBI was required to find other non-profit groups to sponsor 7 nights' of events. PUBLIC COMMENT AND PROCESS: On Maroh 3, 2003, the Downtown Management Commission approved going forward with this ordinance. STAPr R~COMMENDATION: Approved By: Frank W. BE IT ORDAIN~D BY THE CITY COUNCIL OP TH~ CITY OF BOULD~R, COLORADO: Section 1. Section 4-11-3, B.R.C. 1981, is amended to read: 4-11-3 Designation of Mall Zones. (a) In order to carry out the provisions of tl~is chapter, the mall is divided into the following zones: (1) Zone 1 consists of the ten feet of mall property directly adjacent to the north and south mall property lines. (2) Zone 2 consists ofthe areas of mall property that have been designated for pedestrian traftic, emergency and service vehicles, and street furniture. (3) Zone 3 consists of the areas of mall property that have been designated as suitabie for private kiosks. (4) Zone 4 consists of all landscaped areas of the mall. (5) Zone 5 consists of tliose areas where the city manager may install a temporary ar pernianent structure which is managed to answer visitor questions about activities and services on the mall and within the city generally: (b) The boundaries of these zones are established as ilhistrated on maps entitled "Mall Diagrams 1 through &5," which are incorporated by reference into this chapter. (c) Where issuance of a permit depends on the applicant obtaining the written consent of the tenant occupying the building in front of which the applicant desires to locate, such consent need not be obtained if the permit is to be used in zone 1 only when the tenant is not open for business. The zone maps adopted by Section 4-11-3, B.R.C. 1981, are repealed and reenacted to read as shown in Appendix A to this ordinance. Section 3. Section 4-i 1-16, B.R.C. 1981, is amended to read: 4-11-16 Special Activity Permit. (a) Special activity permits may be issued For all zones. An applicant for a special activity permit which is to include any part of zone 1 shall obtain the written consent of the tenant occupying the building in front of which the applicant desires to locate. (b) A special activity permit is valid for one to six days per year upon payment of the fee prescribed by Section 4-20- i l, "Mall License and Permit Fees," B.R.C. 1981. No more than six days total may be permitted to the same person during a calendar year. (c) A special activity permif issued fo a~overnnient is valid for one to ten days per year witfiouf a fee. (d) The city manager may, by contract; provide for one or more series of artistic perforxrianees for the entertainment of the mall puhlic, which series shall involve regularly scheduled performances over four weeks, with a minimum nuxnber of performances of once per week, with each performance lasting a minimum of one hour and a maximum of four hours, 5uch a contract shalt serve as a special activity permit, allowing ,the use of a stage or ,other equipment, and amplified sound, as specified in the; contract: Section 4. This ordinance is necessary to protect the.public health, safety, and welfare of the residents of the city, and covers matters of locai concern. Section 5. The council deems it appropriate that this ordinance be published by title only and orders that copies of this ordinance be made available in the office of the city clerk for public inspection and acquisition.
