Roll Call, Roll call was taken, all members were present. There was a quorum. Approval of Minutes (07- 18 -01). Tucker moved, seconded by Graves, that the Authority approve the minutes with a correction to agenda item #5 Dog, Truck & A Boat, Inc. d/b /a Bacchus Wine Made Simple of Boulder that the vote reflect 3 -2. Motion passes 5 -0. 2. Public Hearing and Consideration of a June 27, 2001 Application from Foolish Craig's, LLC d/b /a Foolish Craig's Cafe, 1611 Pearl Street, Craig S. Moelis, 336015' Street, Boulder, CO, Member/Mgr. and Mitchell W. Arden, 3983 Arbor Court, Boulder, CO, Member for a New Hotel - Restaurant type liquor license. Graves moved. seconded by Mulligan. that the Authoritv approve the New Hotel- Restaurant type L_J liquor license. Motion passes 5 -0. r • • 3. Public Hearing and Consideration of a June 29, 2001 Application from The Plaza Group, LLC d/b /a Bova's,1325 Broadway, Ste. 101, Jamie St. John, 78 Evergreen Way, Nederland, CO, Managing Member; Daniel Dorrell, 1535 10` St., Boulder, CO, Member; James D. St. John, 5346 Gallatin Pl., of a 3.2% Beer type license currently held by D & M Young, Inc., d/b /a Bova's Pantry and Deli. Graves moved, seconded by Wallace, that the Authority approve the Transfer of Ownership of a 3.2% Beer type license. Motion passes 5 -0. 4. Public Hearing and Consideration of a July 2, 2001 Application from 75 LLC, d/b /a Mateo, 1837 Pearl Street, Matthew Jansen, 4507 Appleway, Boulder, CO, Member/Mgr. and Brett Zimmerman, 304 E. Hopkins #5, Aspen, CO, Member/Mgr. for a transfer of ownership of a Hotel- Restaurant type liquor license, currently held by JPE.NET, Inc. d/b /a Le Rocher. Tucker moved, seconded by Graves, that the Authority approve the Transfer of Ownership of a Hotel- Restaurant tvpe liquor license. The Authority also informed the licensee that the 2 additional outside tables are not part of the currently licensed premises. Therefore, if the licensee wishes to utilize this space, an application for a Request to Change, Alter or Modify the Premises will be needed. Motion passes 5 -0. 5. Show Cause Hearing concerning whether the 3.2% Beer Off Premise type liquor license held by Silco Oil Company, d/b /a Barn Store #26, 4501 N. Broadway, should be suspended or revoked. Bob Keatlev stated that he had talked with Scott Paulson from Silco Oil, Co. Mr. Paulson stated that he had or intended to surrender their liquor license. Mr. Keatlev directed Mr. Paulson to contact Sonya Oster regarding the matter. Sonya Oster reported that she had not been contacted by Mr. Paulson, but would follow up on the matter. Wallace moved, seconded by Graves, to accept a stipulation to the violation and to accept a surrender of the licenses. Motion passes 5 -0. 6. Show Cause Hearing concerning whether the 3.2% Beer Off Premise type liquor license held by Cono - Services, Inc., d/b /a Conoco #6369, 3375 28 St., should be suspended or revoked. Bob Keatley presented a stipulation of facts agreed to by the licensee. Mr. Keatlev stated that he had come to an agreement with the licensee that the license be suspended for 13 days. 3 days will be served. The date of suspension will take place on August 23, 2001 from 12 :01 am until August 25, 2001 at 11:59 pm. Wallace moved, seconded by Graves, that the Authority accept the stipulation and agreement. Motion passes 5 -0. 7. Show Cause Hearing concerning whether the 3.2% Beer Off Premise type liquor license held by Safeway Stores 46, Inc., d/b /a Safeway Store #919, 4800 Baseline Road, should be suspended or revoked. Bob Keatlev presented a stipulation of facts agreed to by the licensee. Mr. Keatlev stated that he had come to an agreement with the licensee that the license be suspended for 33 days. 13 days will be served. The date of suspension will take place on August 23, 2001 from 12:01 am until September 4, m 2001 at 11:59 p. Graves moved, seconded by Tucker, that the Authority accept the stipulation and agreement. Motion passes 5 -0. is If- • • • 8. Show Cause Hearing concerning whether the 3.2% Beer Off Premise type liquor license held by Equilon Enterprises, LLC, d/b /a Texaco of Colorado #098,1480 Canyon Blvd., should be suspended or revoked. Bob Keatley presented a stipulation of facts agreed to by the licensee. Mr. Keatley stated that he had come to an agreement with the licensee that the license be suspended for 14 days. 4 days will be served. The date of suspension will take place on August 23, 2001 from 12:01 am until August 26, 2001 at 11:59 pm. Wallace moved, seconded by Graves, that the Authority accept the stipulation and agreement. Motion passes 5 -0. 9. Show Cause Hearing concerning whether the 3.2% Beer Off Premise type liquor license held by PDQ Foodstore, Inc., d/b /a PDQ Foodstore #8001, 5200 Manhattan Circle, should be suspended or revoked. Bob Keatley presented a stipulation of facts agreed to by the licensee. Mr. Keatley stated that he had come to an agreement with the licensee that the license be suspended for 16 days. 6 days will be served. The date of suspension will take place on August 23, 2001 from 12:01 am until August 28, 2001, at 11:59 pm. Wallace moved, seconded by Graves, that the Authority accept the stipulation and agreement. Motion passes 5 -0 10. Show Cause Hearing concerning whether the 3.2% Beer Off Premise type liquor license held by Equilon Enterprises, LLC, d/b /a Texaco of Colorado #99, 3185 28` St., should be suspended or revoked. Bob Keatlev Dresented a stipulation of facts agreed to by the licensee. Mr. Keatley stated that he had come to an agreement with the licensee that the license be suspended for 34 days. 14 days will be served. The date of suspension will take place on August 23, 2001 from 12:01 am until September 5. 2001 at 11:59 pm. Graves moved, seconded by Wallace, that the Authority accept the stipulation and agreement. Motion passes 5 -0. 11. Matters from the Deputy City Clerk 1. Set Neighborhood boundaries for September 19 hearing CCRC, Inc. d/b /a La Mariposa Restaurant Boulder 2845 28 St. NORTH: Iris SOUTH: Pearl St. WEST: 20 St. EAST: Foothills Parkway Wallace moved, seconded by Graves, that the Authority approve the boundaries as set forth above. Motion passes 5-0. • 12. Matters from the Assistant City Attorney - None 13. Matters from the Boulder Police Department Officer Paddock reported that they are trying to conduct a "Cops in Shops" program in September. 14. Matters from the Chair and Members of the Authority The Authority requested that an age column be added to the City petition forms. The Authority also discussed the DUI letter and scheduling the discussion for the October hearing.
