QUASI-JUDICIAL MEETING OUTLINE OF AGENDA 1. Roll Call Roll call was taken. There was a quorum. Approval of Minutes—January 15, 2003.. Wallace moved,seconded by Tucker,that the Authority approve the minutes as submitted. Motion carries 5-0. 2. Matters from the Police Department Officer Aguirre presented the following issues to the Authority: 1) L.E.S.S. Classes are running 60+people per section 2) Gallery Soverign— 1 verbal warning & 3 tickets for public consumption 3) Finishing Touch Spa—Sonya sent a letter and Officer Aguirre followed up on it. 4) Soma—Multiple calls to the police,fights, etc. This will be schedule for a renewal hearing probably in April. 3. Matters from the Responsible Hospitality Group There were no matters from the group. f 4. Public Hearing and Consideration of a December 10, 2002 Application from SHS Hospitality Group, LLC, d/b/a Redfish New Orleans Brewhouse, 2027 IP St., Stephen Shenk, 4390-M Laguna Pl., Boulder, Member/Reg. Manager, for a Transfer of Ownership of a Brewpub type liquor license previously held by Cajun Holdings,Inc. Wallace moved, seconded by Tucker, that the Authority approve the application for a Transfer of Ownership of a Brewpub type liquor license. Motion carries 5-0. 5. Public Hearing and Consideration of a December 30 2002 Application from Republic of Boulder Hotel Group, LLC, d/b/a Ramada Inn, 800 28t4 St., Dan King,255 Manhattan Dr.,Boulder, Managing Member/Reg. Mgr.,Michael Golden,659 Daniel Ct., Wykoff,NJ, Member,Audrey Golden, 659 Daniel Ct., Wykoff, NJ,Member, Keith Goggin, 23 Waverly PI.,#2-5, New York, NY,Member, for a Transfer of Ownership of a Hotel-Restaurant type liquor license previously held by Boulder Hotel Assoc./Urban Boulder Assoc. Tucker moved,seconded by Corielle, that the Authority approve the application for a Transfer of Ownership of a Hotel-Restaurant type liquor license. Motion carries 5-0. 6. Public Hearing and Consideration of a December 30, 2002 Application from TGI Friday's of the Rockies, Inc., d/b/a TGI Friday's,2805 Pearl St., Richard Snead, 11 Ryddington PI.,Dallas, TX,Pres./Tres., Leslie Sharman, 6611 Club House Cir., Dallas, JX, VP, Carol Chopp,5310 Keller Spgs.,#125,Dallas, TX, Sec.,John Lechnier, 9995 W. 82' Pl.,Arvada, Reg. Mgr.,for a Request to Transfer Ownership of a Hotel-Restaurant type liquor license previously held by TGI Friday's, Inc. Wallace moved,seconded by Corielle, that the Authority approve the application for a Transfer of Ownership of a Hotel-Restaurant type liquor license. Motion carries 5-0. 7. Public Hearing and Consideration of a December 31, 2002 Application from Shivam International, LLC,d/b/a Sun Deli,Market & Liquor Store,2299 Pearl St.,#B,for a Request to Change,Alter or Modify the Premise of a Retail Liquor Store type license. Tucker moved seconded by Wallace that the Authority approve the Recluest to Change, Alter or Modifv the Premise of a Retail Liquor Store type license. Motion carries 5-0. 8. Public Hearing and Consigeration of a January 6, 2003 Application from Sol Azteca, LLC, d/b/a Sol Azteca, 3390 28' St.,Jose Guitron, 3483 Marten Ave., San Jose, CA, Manager, Hector Guitron,2709 Cherly St.,Ft. Collins, Manager/Reg. Mgr.,for a New Hotel-Restaurant type liquor license. Corielle moved,seconded by Wallace, that the Authority approve the application for a New Hotel-Restaurant type liquor license. Motion carries 5-0. 9. Public Hearing and Consideration of a January 6, 2003 Application from Metro Oil Co., Inc., d/b/a Total #4057, 1884 Folsom,for a Request to Change, Alter or Modify the Premise of a 3.2% Beer Off-Premise type license. Wallace moved seconded by Corielle that the Authority approve the application for a Request to Change, Alter or Modify the Premise of a 3.2% Beer Off-Premise type license. Motion carries 5-0. 10. Public Hearing and Consideration of a January 6, 2003 Application from Radomil R. Cerny Irrevocable Trust U/A/D 12/24/02,d/b/a L'Atelier Restaurant, 1739 Pearl St., Radomil Cerny, 8087 Meadowdale Sq., Niwot,Trustee,Manager/Reg. Mgr. For a Transfer of Ownership of a Hotel-Restaurant type liquor license previously held by Emiliana, Inc. Tucker moved, seconded by Corielle, that the Authority approve the application for a Transfer of Ownership of a Hotel-Restaurant type liquor license. Motion carries 5-0. 11. Discussion regarding The Dark Horse. Wallace moved, seconded by Corielle,that the Authority move forward with issuing a show cause notice for violation of state Reg. 47-900. Motion carries . 12. Presentation by attorney M.L. Edwards—Request for 500' Elimination for 1729 15`, St. (Cream Puffery Cafe). The Authority decided that they would be supportive of an ordinance change with the To-11owing conditions: Move the restriction from 500' to 400' feet 2) Can only apply to Hotel-Restaurant type liquor licenses 3) The premises has to be 1,200 sq.ft. or less and no more than 35 total seating capacity. 13.
